Consider and act upon whether to direct staff to submit a written notice of appeal on behalf of the Town Council to the Development Services Department, pursuant to Chapter 4, Section 1.5(C)(7) and 1.6(B)(7) of the Town’s Zoning Ordinance, regarding action taken by the Planning & Zoning Commission on any Site Plan or Preliminary Site Plan. Who is requesting the U.S. 380 Bypass Alignment west of Custer? •City of Frisco is not requesting it •Town of Prosper is not requesting it •PISD is not requesting it •City of McKinney is not requesting it (Formally) •Collin County is not requesting it (Formally) •TxDOT 2016 US 380 Collin County Feasibility Study did not include recommendation for it •TxDOT’s 2018 Prosper Corner evaluation shows west of Custer is not better AND FINALLY •Majority of citizens are not requesting it!!!! Support for U.S. 380 staying on current alignment US 380 St. Hwy. 121 US 380 St. Hwy. 121 US 380 St. Hwy. 121 US 75 Overview of Perryman Study: There is no evidence to suggest that a bypass would increase economic development opportunities along the bypass route. In fact, the Perryman study concluded that while there will be some business losses due to displacements along the current US 380, the potential gains from additional development would generate long-term economic benefits for the entire corridor. To be specific, the Perryman Group estimates that the annual fiscal benefits (at maturity) of converting portions of U.S. 380 to a LAR include the following: •Annually: $914.5 million for the State of Texas, $185.1 million for the McKinney ISD, $166.9 million for the City of McKinney, $99.6 million for Prosper ISD,$96.0 million for Frisco ISD,$75.3 million for Collin County,$64.4 million for the City of Frisco,$62.1 million for the Town of Prosper,& millions to other counties, cities, and schools in the state. Economic Consequences of Bypass: Denton Bypass: Loop 288 / US 380 Financial Impact of Anticipated Bypass Alignment Change at NWC Custer and U.S. 380 The estimated annual loss for total sales tax (8.25%) and property tax for all jurisdictions is $4,468,559. •State •Collin County •Collin County Community College •Prosper Economic Development Corporation •Prosper ISD •Town of Prosper and Following Town Special Districts: •Crime Control and Prevention District •Fire Control, Prevention and Emergency Medical Services District 2016 TxDOT U.S. 380 Collin County Feasibility Study Recommendation •$125 Million for Grade Separated Intersection Improvements •Mahard Parkway, Coit Road, Custer Road, Lake Forest Drive, Hardin Boulevard, State Highway 5, Airport Drive, FM 1827 •Prosper has 4 currently constructed on U.S. 380 •(2) Preston, BNSF RR, and (1) DNT •Prosper has 4 currently approved to be constructed on U.S. 380 •(1) DNT, Legacy Drive, Teel Parkway, and FM 423 Third Resolution Recommended for Approval: •The Town Council: o supports the current alignment of U.S. Highway 380 expanding to a LAR. o expresses its strong opposition to any proposed alignment change to Red Alignment Option B and original Red Alignment Option B as bypass options for U.S. Highway 380 within the corporate limits of the Town of Prosper that is not consistent with the Town’s Thoroughfare Plan. o expresses its strong opposition to any alignment that is not consistent with the current alignment of U.S. Highway 380 in the Town. o directs no further Town staff coordination with TxDOT or any other entity related to the preservation of right-of-way for the expansion of U.S. Highway 380 as a Limited Access Roadway while there exists a bypass option for U.S. Highway 380 within the corporate limits of the Town of Prosper. Third Resolution Recommended for Approval (con’t): •Considering the Town’s repeated, strong opposition to any bypass alternatives located in Prosper, the Town Council directs Town staff: o contact TxDOT staff in Austin to request an explanation why any bypass alternatives would ever be considered within Prosper considering the Town’s strong opposition to the same. o request TxDOT staff in Austin provide clarification on why the recommended grade separated intersection improvements from the 2016 US 380 Collin County Feasibility Study are not being pursued as an option in lieu of expanding U.S. Highway 380 as a Limited Access Roadway. o request TxDOT staff in Austin provide a revised Perryman Group economic study to include updated economic impacts associated with any bypass option. o request TxDOT staff in Austin provide a traffic impact analysis of bypass option along the corridor. o contact TxDOT staff in Austin to reaffirm TxDOT’s policy that it will respect the official position of the local jurisdiction affected by construction, and not construct a bypass in the Town of Prosper, if the Town of Prosper opposes it. Conduct a Public Hearing, and consider and act upon an ordinance for a Specific Use Permit for a Wireless Communication and Support Structure, on 0.5±acre, located in Frontier Park, on the south side of Frontier Parkway, south and west of Stadium Drive.
