variance process for certain private clubs in conjunction

•Properties annexed after the May, 2006 local option
election are “dry.”
•Private Clubs are allowed to operate in “dry” areas
per TABC
•Current distance requirement is 800 feet from a
church, public hospital, public/private school or a
residential district.
•Current ordinance does not permit a variance request
•Council requested an amendment to consider
variance requests to the distance requirement on a
case-by-case basis –similar to the recently approved
amendment for big box grocery stores

•Detached,accessory dwelling unit used to house family membersand/or guests of the owner
•Minimum ½acre lot size
•Cannot be sold separately or sub-let
•Meet same setbacks as main structure

•The number and size of guest houses only controlled by lot size andsetbacks
•2½story guest house with one story main house is permitted
•A one-acre lot could accommodate five (5),6,000 sq.ft.guesthouses
•There are over 950 existing or platted lots,½acre or greater,inProsper
•New trend for attached guest houses
