4. Consider and act upon a request for a Site Plan including Solid Living Screening,
for Prosper ISD Elementary School, No. 15, on 14.4± acres, located on the east side
of Legacy Drive, south of Prosper Trail. The property is zoned Planned
Development-66 (PD-66). (D21-0025).
Soto: Summarized the request, presented exhibits, and recommended approval.
Motion by Daniel, second by Long, to approve Item 4, subject to staff recommendations. Motion
approved 7-0.
5. Conduct a Public Hearing, and consider and act upon a request to rezone Planned
Development-86 (PD-86) to Planned Development (PD), on 63.3± acres, to allow for
an age-restricted single family detached, condominium development, located on
the west side of Custer Road, south of First Street. (Z20-0027).
Glushko: Summarized the request, presented exhibits, and recommended approval, subject to
the conditions outlined in the staff report.
John Delin (Applicant): Provided a presentation regarding the proposed rezoning request and
development.
Justin Lansdowne (Applicant): Provided engineering information related to the project.
Bob Benson (260 Yosemite Drive): Spoke in support of the request.
Benjy R. Green (340 Yosemite Drive): Spoke in support of the request.
Commissioners discussed the proposed use, building setbacks, berms, ground cover between
units, sidewalk widths, proposed walls and fencing, and tree mitigation. Generally expressed
support for the proposed use, building setbacks, ground cover between units, and sidewalk
widths. Voiced concern with the use of molded or pre-cast composite walls throughout the
development. Indicated desire to require berms until outcomes of flood study and reclamation is
known. Expressed support for tree mitigation in accordance with Town standards.
Motion by Daniel, second by Charles, to approve Item 5, subject to:
1) The requirement for berms along Custer Road, regardless of flood study or reclamation effort
outcomes;
2) Prohibition of molded or pre-cast composite walls; and
3) Tree Mitigation being required, in accordance with Town standards.
Motion approved 7-0.

Description of Agenda Item:
On January 5, 2021, the Planning & Zoning Commission approved a Final Plat/Conveyance Plat
for the subject property. At that time, the plat included 58 single family residential lots, one (1)
HOA/open space lot, and a Revised Conveyance Plat for Block B, Lot 2R. The layout originally
included a required street stub from the subdivision to the Block B, Lot 2R because Lot 2R was
zoned residential. Block B, Lot 2R was recently rezoned to Office (O) District, Z21-0002, as such
the street stub is no longer required. The applicant has revised the layout by removing the street
stub to Lot 2R and added one (1) residential lot in its place. Access is provided from Prairie Drive.
The Final Plat/Revised Conveyance Plat conforms to the PD-65 development standards.

NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
THAT PROSPER VILLAGES AT LEGACY LLC, acting herein by and through its duly authorized officer, does hereby

with the construction, maintenance, or efficiency of their respective systems in the easements.
8. The Town of Prosper and public utilities shall at all times have the full right of ingress and egress to or from their
respective easements for the purpose of constructing, reconstructing, inspecting, patrolling, maintaining, reading
meters, and adding to or removing all or parts of their respective systems without the necessity at any time

DRAINAGE AND DETENTION EASEMENT
This plat is hereby adopted by the Owners and approved by the Town of Prosper (Called "Town") subject to the following conditions
which shall be binding upon the Owners, their heirs, grantees, successors and assigns: The Portion of Lot 23, Block C, as shown on
the plat is called "Drainage and Detention Easement". The Drainage and Detention Easement within the limits of this addition, will
remain open at all times and will be maintained in a safe and sanitary condition by the owners of the lot or lots that are traversed by
or adjacent to the Drainage and Detention Easement. The Town will not be responsible for the maintenance and operation of said
Easement or for any damage to private property or person that results from conditions in the Easement, or for the control of erosion.
No obstruction to the natural flow of storm water run-off shall be permitted by construction of any type of building, fence or any other
structure within the Drainage and Detention Easement, as herein above defined, unless approved by the Town Engineer. Provided,
however, it is understood that in the event it becomes necessary for the Town to erect or consider erecting any type of drainage
structure in order to improve the storm drainage that my be occasioned by drainage in or adjacent to the subdivision, then in such
event, the Town shall have the right to enter upon the Drainage and Detention Easement at any point, or points, to investigate,
survey or to erect, construct and maintain any drainage facility deemed necessary for drainage purposes. Each property owner shall
keep the Drainage and Detention Easement clean and free of debris, silt, and any substance which would result in unsanitary
conditions or obstruct the flow of water, and the Town shall have the right of ingress and egress for the purpose of inspection and
supervision of maintenance work by the property owner to alleviate any undesirable conditions which may occur. The natural
drainage through the Drainage and Detention Easement is subject to storm water overflow and natural bank erosion to an extent
which cannot be definitely defined. The Town shall not be held liable for any damages of any nature resulting from the occurrence of
these natural phenomena, or resulting from the failure of any structure or structures, within the Easement.
LANDSCAPE EASEMENT
The undersigned covenants and agrees that the landscape easement and restrictions herein set forth shall run with the land and be
binding on the owner(s) of the property in this subdivision, their successors and assigns, and all parties claiming by, through and
under them. In the event a replat is requested on all or part of this property, the Town may require any similar or additional
restrictions at its sole discretion. The sole responsibility for maintenance and replacement of landscape materials thereof shall be
borne by any ‘homeowners’ association hereafter established for the owners of lots in this subdivision and/or the owners of the
individual lots within this subdivision. Such maintenance and replacement shall be in conformance with the requirements, standards,
and specifications of the Town of Prosper, as presently in effect or as may be hereafter amended. This provision may be enforced by
specific performance or by any other remedy allowed by law. This Landscape Easement shall be void of utilities and other elements
unless otherwise approved on the plat.

Agenda Item:
Consider and act upon a Site Plan for an office/warehouse building, on 4.6± acres, on the south
side of Industry Way, east of Cook Lane. The property is zoned Planned Development-26 (PD-

Description of Agenda Item:
The Site Plan shows a one-story office/warehouse building, totaling 64,345 square feet. Access
is provided from Industry Way. The depicted number of off-street parking spaces meets the
minimum standards of the Zoning Ordinance. The Site Plan conforms to the Planned
Development-26 development standards.
As a companion item, the Final Plat/Conveyance Plat (D21-0031), for Prosper Business Park,
Block B, Lots 3 & 9 is on the May 4, 2021 agenda.

The Town will not be responsible for the maintenance and operation of said Easement or for any damage to private property orperson that results from conditions in the Easement, or for the control of erosion. No construction of any type of building, fence or any other structure within the Drainage and Detention Easement, as herein above defined shall bepermitted, unless approved by the Town Engineer. Conduct a Public Hearing, and consider and act upon an amendment to the Thoroughfare Plan
to realign segments of Mahard Parkway, Lovers Lane, Prairie Drive, and Shawnee Trail. (CA21-
0003).
Description of Agenda Item:
The Comprehensive Plan states, “Planning for the Town’s future should be a continuous process,
and this Plan is designed to be a dynamic tool that can be modified and periodically updated to
keep it in tune with changing conditions and trends.” The Thoroughfare Plan currently depicts
Mahard Parkway, Lovers Lane, Prairie Drive, and Shawnee Trail in the configuration of a “football”
as shown below.
The alignment of the “football” was originally established at the request of property owners in
conjunction with zoning that was approved in 2008, and specifically concurrent with the approval
of Planned Development-41 (PD-41), currently know as Prosper West or the Matthews Southwest
property. An exhibit from PD-41, as approved in 2008 is shown below. Following approval of the
zoning, the Thoroughfare Plan was subsequently amended in conjunction with an update to the
Comprehensive Plan to reflect the alignment provided with the zoning.

In 2017, PD-41 was amended which depicted the southeast curve of the “football” to be “squared-
up” at an intersection, as shown below. Following approval of the zoning a Preliminary Site Plan
was also approved which also showed an intersection. Both the zoning and Preliminary Site Plan
approvals were approved with the expectation that a study would be conducted to support the
proposed realignment.

In 2019, all property owners a party to subject roadway alignments contacted Town staff
expressing interest in instigating a study to evaluate the impacts of realignment. In 2020, the
property owners contracted with the Deshazo Group to perform the analysis. The study was
completed in 2021. It demonstrated realignment does not have a detrimental impact with respect
to circulation and traffic flow in the area. The Engineering Department has reviewed the study
and the recommendations of the study and is supportive of the proposed realignment, as shown
below.
Legal Obligations and Review:
The Planning & Zoning Commission is required to hold a Public Hearing prior to acting on an
amendment to the Thoroughfare Plan.
