04-015 - R TOWN OF PROSPER, TEXAS RESOLUTION 04-15 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, COLLIN COUNTY, TEXAS, ORDERING A GENERAL ELECTION TO BE HELD ON MAY 15, 2004, FOR THE PURPOSE OF ELECTING THREE (3) COUNCIL MEMBERS TO SERVE FOR A TERM OF TWO (2) YEARS, DESIGNATING THE POLLING PLACE AND APPOINTING ELECTION OFFICIALS FOR SUCH GENERAL ELECTION; PROVIDING THE FORM OF THE BALLOT AT SUCH GENERAL ELECTION; DIRECTING THE GIVING OF NOTICE OF SUCH GENERAL ELECTION; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS THAT: Section 1. In accordance with the general laws and Constitution of the State of Texas, a General Election is hereby called and ordered for the 15"' day of May, 2004, the same being the third Saturday in May, at which general election all qualified voters of the Town may vote for the purpose of electing two (2) Town Council members to fill the expiring terms of the Prosper Town Council Place 3, Place 4 and Place 5, for a term of two (2) years ending May 2006. Section 2. No person's name shall be placed upon the ballot as a candidate for Council Member unless such person has filed his or her sworn application as provided by Section 141.03 of the Texas Election Code, with the Town Secretary of the Town at the Town Hall Office, located at 113 W. Broadway Street, Prosper, Texas 75078, not later than 5:00 p.m. on the 15th day of March, 2004. The Town Secretary shall note on the face of each such application the date of such filing. Such application shall include the office the candidate is seeking. Section 3. The election shall be held in each of the heretofore established election precincts and polling within the Town and the election officials for said precincts shall be as follows: County Election Precincts Polling Place Precinct 13 & Precinct 29 Prosper High School - Library 300 Eagle Lane Prosper, Texas 75078 Election polls shall be open from 7:00 a.m. until 7:00 p.m. on the date of the election. Election Officials 1) Glenn Gammons, Presiding Judge 2) Dan Tolleson, Deputy Judge and Alternate Presiding Judge The Town Secretary is hereby authorized and directed to provide a copy of this Resolution to each judge as written notice of the appointment as required by Section 32.009 of the Texas Election Code. The Presiding Judge shall have the authority to appoint no more than four(4)clerks to assist in the holding of such election, but in no event shall the Presiding Judge appoint less than two clerks. Said election officers shall also serve as the Early Voting Ballot Board for such election; In accordance with Section 87.001 et seq., of the Texas Election Code, said Presiding Judge shall appoint at least two(2)other members to said Board. The Presiding Judge shall also serve as the Presiding Officer of the Early Voting Ballot Board. Resolution Page 1 of 2 The Election Judge shall be compensated at an hourly rate of$10 and election clerks shall be compensated at an hourly rate of$8 as provided by Title 3, Section 32.091 (a) of the State Election Code. The Election Judge shall be compensated in the amount of $25 for the delivery of election equipment and supplies as provided by Title 3, Section 32.091 (a) of the State Election Code, if such delivery is necessary. The Town will pay for any required training of the Town's election Judges and Clerks,with the prior written approval from the Town to attend said training. Section 4. The Town Secretary is hereby appointed clerk for early voting; the appointment of a deputy clerk or clerks for early voting by the Town Secretary shall be in accordance with Section 83.001 et seq. of the Texas Election Code. The Town Hall of the Town of Prosper located at 113 W. Broadway Street, Prosper, Texas 75078 is hereby designated as the place for early voting for such election. Said clerks shall keep said office open during the hours that the Town Hall is regularly open for business, that is, from 8:00 a.m. until 5:00 p.m. , Monday through Friday on each day for early voting which is not a Saturday, a Sunday, or any official State holiday, beginning on April 28, 2004 and continuing through May 11, 2004. Said clerks shall not permit anyone to vote early by personal appearance on any day which is not a regular working day for the clerk's office, and under no circumstances shall they permit anyone to vote early by personal appearance at any time when such office is not open to the public. The above-described place for early voting is also the clerk's mailing address to which ballot applications and ballots voted by mail may be sent. The early voting clerk, in accordance with the provisions of the Texas Election Code, shall maintain a roster listing each person who votes early by personal appearance and each person to whom a ballot to be voted by mail is sent. Section 5. Said election shall be held in accordance with the Constitution and laws of the State of Texas, and all duly qualified resident electors of the Town of Prosper, Texas, shall be entitled to vote. Section 6. The Town Secretary is hereby authorized and directed to furnish all necessary election supplies to conduct such election. Section 7. The voting at such election shall be upon paper ballots. Early voting at such election shall also be by paper ballot. Section 8. Notice of this election shall be given in accordance with the provisions of the Texas Election Code and returns of such notice shall be made as provided for in said Code. The Mayor shall issue all necessary orders and writs for such election, and returns of such election shall be made to the Town Secretary after the closing of the polls. Section 9. Said election shall be held in accordance with Texas Election Code and the Federal Voting Rights Act of 1965, as amended.
