04-010 - O TOWN OF PROSPER, TEXAS ORDINANCE NO. 04-10 AN ORDINANCE OF THE TOWN OF PROSPER, TEXAS ACCEPTING A PETITION TO EXTEND ITS EXTRATERRITORIAL JURISDICTION TO INCLUDE ALL PORTIONS OF A 2,174 ACRE TRACT OF LAND, MORE OR LESS THAT IS NOT PRESENTLY IN THE EXTRATERRITORIAL JURISDICTION BEING WITHIN ALL OR PARTS OF THE FOLLOWING SURVEYS (1) A. WHEREAS, the Town Council ("Town Council") of the Town of Prosper, Texas ("Town") has investigated and determined that it will be advantageous and beneficial to Prosper and its inhabitants to extend its extraterritorial jurisdiction ("ETJ") as set forth below; and WHEREAS, the Town Council has received a petition from Ernest Mahard ("Owner") requesting that the Town's ETJ be extended to include all portions a 2,174 acre tract of land, more or less, that is not presently in the ETJ being within all or parts of the following surveys (1) A. Roberts Survey, Abstract No. 1115; (2) B.L. Rue Survey, Abstract No. 1113; (3) L. Netherly Survey, Abstract No. 962; (4) T. Button Survey, Abstract No. 88; (5) M.E.P. & P.R.R. Survey, Abstract No. 1476; (6) C.L. Smith Survey, Abstract No. 1681; (7) J.P. Bates Survey, Abstract No. 1620; (8) J. Sailing Survey, Abstract No. 1675; (9) P. Barnes Survey, Abstract No. 79; (10) B.R. Hodges Survey, Abstract No. 593; (11) A. Jamison Survey, Abstract No. 672; (12) B. Weedon Survey, Abstract No. 1369; (13) J. Morton Survey, Abstract No. 793; (14) L. Rue Survey, Abstract No. 1110; (15) P. Rue Survey, Abstract No. 1555; (16) R. Yates Survey, Abstract No. 1538; (17) H. Sailing Survey, Abstract No. 1628; (18) J. Teter Survey, Abstract No. 1262, Denton County, as more particularly described in the petition which is attached hereto as Exhibit "A" and incorporated as if fully set forth herein ( the "Property"); and WHEREAS, the Town Council has determined that the Property is contiguous to the otherwise existing ETJ of the Town; and WHEREAS, the Town Council finds that it is authorized to expand the Town's ETJ to include the Property as requested by Owner pursuant to Section 42.022(b) of the Local Government Code. C:\Shanae\ORDINANCES&RESOLUTIONS\ORDINANCES\2004 Ordinances\04-10,Ordinance to Extend ETJ(Mahard).doc Page I NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Extraterritorial Jurisdiction of Town Expanded. The petition by Owner is hereby granted and the ETJ of Town is hereby expanded to include the Property. SECTION 3: Savings/Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 4: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Prosper hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 5: Effective Date. This Ordinance shall be effective immediately upon its passage. DULY PASSED AND APPROVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS on this 31 day of January, 2004.
