2020-83 - OCERTIFICATE WITH RESPECT TO ADOPTION OF AN ORDINANCE THE STATE OF TEXAS COUNTIES OF COLLIN AND DENTON TOWN OF PROSPER We, the undersigned members of the Town Council of the Town of Prosper, Texas (the "Town Council"), hereby certify as follows: 1. The Town Council convened in a SPECIAL MEETING ON NOVMEBER 17, 2020, at the regular designated meeting place, and the roll was called of the duly constituted officers and members of the Town Council, to wit: Ray Smith, Mayor Curry Vogelsang, Jr., Mayor Pro-Tem Jason Dixon, Deputy Mayor Pro-Tem Craig Andres Jeff Hodges Meigs Miller Marcus E. Ray Melissa Lee, Town Secretary and all of the persons were present, except the following absentees: none , thus constituting a quorum. Whereupon, among other business, the following was transacted at the Meeting: the written ORDINANCE NO. 2020-83 BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, CANVASSING A TOWN BOND ELECTION was duly introduced for the consideration of the Town Council. It was then duly moved and seconded that the Ordinance be passed; and, after due discussion, the motion, carrying with it the passage of the Ordinance, prevailed and carried by the following vote: AYES: All members of said Town Council shown present above voted "Aye," except as noted below: NOES: None ABSTAIN: None 2. That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that the Ordinance has been duly recorded in the Town Council' minutes of the Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from the Town Council' minutes of the Meeting pertaining to the passage of the Ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of the Town Council as indicated therein; that each of the officers and members of the Town Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that the Ordinance would be introduced and considered for passage at the Meeting, and each of the officers and members consented, in advance, to the holding of the Meeting for such purpose; that the Meeting was open to the public and public notice of the time, place and purpose of the Meeting as given, all as required by Chapter 551, Government Code. pis, the 17th day of November, 2020 P2�& 'A Mayor ',►►1111�7lI! 4 01-1,F4 !f} 1\, � n ' lit. o .:rttll3l�' TOWN OF PROSPER, TEXAS ORDINANCE NO.2020-83 ORDINANCE BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, CANVASSING A TOWN BOND ELECTION WHEREAS, this Town Council ordered an election to be held in said Town on November 3, 2020 on the PROPOSITIONS hereinafter stated; and WHEREAS, this Town Council has investigated all matters pertaining to said election, including the ordering, giving notice, appointing election officers, holding and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to this Town Council. WHEREAS, it is hereby officially found and determined that the meeting at which this Ordinance was adopted was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: 1. The Town Council officially finds and determines that said election was duly ordered, that proper notice of said election was duly given, that proper election officers were duly appointed prior to said election, that said election was duly held, that the Town has complied with the Federal Voting Rights Act and the Texas Election Code, that due returns of the result of said election have been made and delivered, and that the Town Council has duly canvassed said returns, all in accordance with law and the Ordinance calling said election. 2. The Town Council officially finds and determines that the following votes were cast at said election, on the submitted Propositions by the resident, qualified electors of the Town, who voted at the election: TOWN OF PROSPER, TEXAS SPECIAL ELECTION TOWN OF PROSPER, TEXAS PROPOSITION A THE ISSUANCE OF $30,000,000 TAX BONDS BY THE TOWN OF FOR 11,207 PROSPER, TEXAS FOR PUBLIC SAFETY FACILITIES IN THE TOWN, CONSISTING OF FIRE STATIONS, AN EMERGENCY OPERATIONS CENTER, A PUBLIC SAFETY TRAINING FACILITY AND AGAINST 3,205 ADMINISTRATIVE FACILITIES RELATING THERETO. TAXES SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE IMPOSED. TOWN OF PROSPER TEXAS SPECIAL ELECTION TOWN OF PROSPER, TEXAS PROPOSITION B THE ISSUANCE OF $30,000,000 TAX BONDS BY THE TOWN OF FOR 10,613 PROSPER, TEXAS FOR EQUIPPING PARKS, TRAILS AND RECREATIONAL FACILITIES IN THE TOWN AND THE ACQUISITION OF LAND AND INTERESTS IN LAND FOR SUCH PURPOSES. TAXES AGAINST 3,773 SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE IMPOSED. TOWN OF PROSPER, TEXAS SPECIAL ELECTION TOWN OF PROSPER, TEXAS PROPOSITION C THE ISSUANCE OF $150,000,000 TAX BONDS BY THE TOWN OF PROSPER, TEXAS FOR CONSTRUCTING, IMPROVING, EXTENDING, EXPANDING, UPGRADING AND DEVELOPING STREETS AND ROADS, BRIDGES AND INTERSECTIONS IN THE TOWN AND RELATED DRAINAGE IMPROVEMENTS, UTILITY RELOCATIONS, LANDSCAPING, FOR 11,284 CURBS AND SIDEWALKS, TRAFFIC SAFETY AND OPERATIONAL IMPROVEMENTS, ENTRYWAY SIGNAGE AND OTHER STREET AND ROAD SIGNAGE AND COSTS ASSOCIATED WITH SUCH PROJECTS, AND INTERESTS IN LAND AS MAY BE NECESSARY FOR SUCH PURPOSES; PROVIDED THAT THE FOLLOWING PROJECTS ARE PLANNED TO BE COMPLETED THROUGH FUNDING FROM OTHER OBLIGATIONS OF THE TOWN AND THEREFORE NO PROCEEDS OF THE AGAINST 3,088 BONDS MAY BE USED FOR IMPROVEMENTS TO FRONTIER PARKWAY FROM THE DALLAS NORTH TOLLWAY TO PRESTON ROAD, THE DALLAS NORTH TOLLWAY OVERPASS AT HIGHWAY 380 AND FISHTRAP ROAD FROM TEEL PARKWAY TO STUBER ELEMENTARY SCHOOL. TAXES SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON THE BONDS WILL BE IMPOSED. 3. The Town Council officially finds, determines and declares the result of said election to be that each of the aforesaid Propositions has received a favorable majority vote, and that such Propositions therefore have passed, and that the bonds authorized by the aforesaid Propositions may be issued and the aforesaid bond tax supporting said bonds may be levied by the Town.
