TOWN OF PROSPER,TEXAS RESOLUTION NO. 07-046 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, CONCERNING PROPOSED RESTORATION OF THE TOWN'S MEMBERSHIP IN THE UPPER TRINITY REGIONAL WATER DISTRICT. WHEREAS, the Town of Prosper was a founding member of Upper Trinity Regional Water District from 1990 to 1999; and WHEREAS, as a Member entity, the Town made significant contributions to the planning, policies, and progress achieved by Upper Trinity during the early development of new regional systems and services; and WHEREAS, the Town allowed its membership to lapse in 1999, due to the fact that the Town did not see the benefit of continuing coordination of long-range needs with Upper Trinity at that time; and WHEREAS, in recent years, Upper Trinity has been implementing its master plan for water and wastewater services in the northeast portion of its service area, proceeding to take strategic steps to provide adequate services for the long-term growth of this area; and making service available in the vicinity of Prosper; and WHEREAS, since 1999,Prosper has developed a clear vision of the Town's future; and WHEREAS, the Town Council of Prosper believes that it would be mutually beneficial for the Town to restore its membership in, and to participate in regional services of, Upper Trinity; and WHEREAS, Prosper understands and agrees that it should pay all fees and charges that would have been due and payable if its membership had not lapsed; and WHEREAS, the Town Council of Prosper desires to bring a regional view to the governance of Upper Trinity, believing that our mutual interest will be served by appointing to the Upper Trinity Board an enterprise-minded citizen, and that the Town commit to a fill term for said appointee, subject to removal for cause; and WHEREAS, the Town of Prosper desires to contract for participation in the proposed Doe Branch Water Reclamation Project, and as a condition of membership the Town will participate in said Project for full service for at least that portion of Prosper that is within Denton County; and WHEREAS, it appears that wastewater treatment service from Upper Trinity would be the most direct and efficient alternative available to Prosper, especially since it would enable gravity-flow of the Town's wastewater;and NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: That the Town Council of the Town of Prosper does hereby request that the Town's membership in Upper Trinity Regional Water District be restored in conjunction with the Town's participation in Doe Branch Water Reclamation Project. SECTION 2: This Resolution shall take effect immediately upon its passage. RESOLVED THIS THE 22th day of May, 2007.
