02-58 - RTOWN OF PROSPER, TEXAS RESOLUTION NO.02-58 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, ORDERING AN ELECTION TO BE CONDUCTED ON SATURDAY, FEBRUARY 1, 2003 FOR THE PURPOSE OF APPROVING OR DISAPPROVING THE PROPOSITION OF REDUCING THE TAX RATE IN THE TOWN OF PROSPER, TEXAS FOR THE CURRENT YEAR, FROM 2002 TO 2003; AUTHORIZING THE TOWN SECRETARY TO MAKE SUBMISSIONS TO THE UNITED STATES JUSTICE DEPARTMENT FOR PRE -CLEARANCE APPROVAL; ESTABLISHING OTHER PROCEDURES FOR CONDUCTING THE ELECTION; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF. WHEREAS, on or about November 12, 2002, the Town Council of the Town of Prosper, Texas ("Town Council"), received a petition signed by qualified voters of the taxing unit of the Town of Prosper, Texas ("Prosper") to require that an election be held to determine whether or not to reduce the tax rate adopted for the current year, 2002-2003, to the rollback tax rate calculated as provided by Chapter 26 of the Texas Tax Code (the "Petition"); and WHEREAS, Chapter 26 of the Texas Tax Code requires that an election be ordered; and WHEREAS, by this Resolution, it is the intention of the Town Council to order an election on the issue and to establish procedures for conducting the election; and NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: SPECIAL ELECTION ORDERED. A special election is hereby ordered by the Town Council of the Town of Prosper, Texas to be held Saturday, February 1, 2003, at which the following shall appear on the ballot: PROPOSITION NO.1 FOR REDUCING THE TAX RATE IN THE TOWN OF AGAINST PROSPER, TEXAS FOR THE CURRENT YEAR FROM $0.36 TO $0.319905. SECTION 2. METHOD OF VOTING: The Town Secretary is hereby authorized and instructed to provide and furnish all necessary election supplies to conduct the Special Election in accordance with this resolution. Voting at the election shall be by electronic voting machines and shall be conducted in accordance with the Texas Election Code. SECTION 3. GOVERNING LAW AND QUALIFIED VOTERS: The election shall be held in accordance with the Constitution of the State of Texas, the Texas Election Code and the Texas Tax Code, and all resident qualified voters of the Town shall be eligible to vote at the election. SUBMISSIONS TO THE UNITED STATES JUSTICE DEPARTMENT: The Town Secretary of the Town of Prosper is authorized to make such submissions as are necessary to the United State Justice Department to seek pre -clearance approval for additional length of the absentee voting period. SECTION 5. DELIVERY OF RETURNS: In accordance with the Texas Election Code, immediately after the closing of the polls on the day of the election, the election officers shall make and deliver the returns to the election in triplicate as follows: one copy shall be retained by the Presiding Judge; one copy shall be delivered to the Mayor of the Town; and one copy of the returns together with the ballot boxes and all election supplies shall be delivered to the Town Secretary. All election records and supplies shall be preserved by the Town Secretary in accordance with the Texas Election Code. SECTION & NECESSARY ACTIONS: The Mayor and the Town Secretary of the Town, in consultation with the Town Attorney, are hereby authorized and directed to take any and all actions necessary to comply with the provisions of the Texas Election Code, the Texas Tax Code and any other state or federal law in carrying out and conducting the election, whether or not expressly authorized herein. SECTION 7: EFFECTIVE DATE. This Resolution shall become effective immediately upon its passage.
