A i TOWN OF PROSPER, TEXAS ORDINANCE NO. 02-34 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS AMENDING PROSPER'S SUBDIVISION ORDINANCE NO. 85-26, SECTION 1 (AUTHORITY), SECTION 7 (PRELIMINARY PLAT AND ACCOMPANYING DATA) AND SECTION 8 (FINAL PLAT); PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the Town Council of the Town of Prosper, Texas ("Town Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the Town of Prosper, Texas ("Prosper") to amend Prosper's Subdivision Ordinance No. 85-26, Section I (Authority), Section 7 (Preliminary Plat and Accompanying Data) and Section 8 (Final Plat) for the purpose of incorporating Prosper's Fee Schedule Ordinance No. 02-33, as it exists or may be amended; and WHEREAS, Prosper has complied with all notices and public hearings as required by law. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: Findings. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendments to Prosper's Subdivision Ordinance No. 85-26, Section 1. Section 1 (Authority) of Prosper's Subdivision Ordinance No. 85-26 is hereby amended as follows: "SECTION 1. AUTHORITY 1.2 Procedures (5) Payment of all required fees established by the Fee Schedule Ordinance No.02-33, as it exists or may be amended." SECTION 3: Amendments to Prosper's Subdivision Ordinance No. 85-26, Section 7. Section 7 (Preliminary Plat and Accompanying Data) of Prosper's Subdivision Ordinance No. 85-26 is hereby amended as follows: "SECTION 7. PRELIMINARY PLAT AND ACCOMPANYING DATA 7.3 Filing Fees ORDINANCE AMENDING SUBDIVISION ORDINANCE NO.85-26 (FEE SCHEDULE) — Page I C:\Documents and Settings\Jennifer\My Documents\Ordinances and Resolutions\Ordinance No. 02-34 Amendment to Sub Regs (Fee Schedule) I .doc c-) CD co 0 r 05213 PD0811 .: Such plat shall be accompanied by all required fees established by the Fee Schedule Ordinance No. 02-33, as it exists or may be amended. No action by the Commission shall be valid until the filing fee established by the Fee Schedule Ordinance No.02-33, as it exists or may be amended, has been paid." SECTION 4: Amendments to Prosper's Subdivision Ordinance No. 85-26, Section 8. Section 8 (Final Plat) of Prosper's Subdivision Ordinance No. 85-26 is hereby amended as follows: "SECTION 8. FINAL PLAT 8.2 Processing of Final Plat (5) When the final plat is filed with the Commission for acceptance, it shall be accompanied by the required fees established by the Fee Schedule Ordinance No.02-33, as it exists or may be amended, and a check or checks payable to the County Clerk in the amount of the recordation fee for filing the final plat." SECTION 5: Penalty Provision. Any person, firm, corporation or business entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding FIVE HUNDRED AND NO/100 DOLLARS ($500.00). Each continuing days violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Prosper from filing suit to enjoin the violation. Prosper retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 6: Savin sg /Repealin Clause. lause. Prosper's Subdivision Ordinance No. 85-26 shall remain in full force and effect, save and except as amended by this or any other Ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 7: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Prosper hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid.
