02-33 - O2002- 0147732 TOWN OF PROSPER, TEXAS ORDINANCE NO. 02-33 AN ORDINANCE OF THE TOWN OF THE PROSPER, TEXAS; REPEALING ORDINANCE NOS. 86-25 AND 98-02; ESTABLISHING A COMPREHENSIVE FEE SCHEDULE; PROVIDING FOR WATER AND SEWER RATES; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the Town Council of the Town of Prosper, Texas ("Town Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the Town of Prosper, Texas ("Prosper") to repeal Ordinance Nos. 86-25 and 98-02; and WHEREAS, the Town Council has investigated and determined that it would be advantageous and beneficial to the citizens of Prosper to update and establish a comprehensive fee schedule as set forth below; and WHEREAS, the Town Council has investigated and determined that it would be advantageous and beneficial to the citizens of Prosper to provide for water and sewer rates as set forth below. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: Findings. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Repeal of Ordinance Nos. 86-25 and 98-02. Ordinance Nos. 86-25 and 98- 02 are hereby repealed. Such repeal shall not abate any pending prosecution for violation of the repealed Ordinance Nos. 86-25 and 98-02, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of Ordinance Nos. 86-25 and 98-02. SECTION 3: Construction Permits and Fees. A. Building Permits/Inspection Fees. The building permit and inspection fees as set forth in Exhibit "A" (I. Building Permits/Inspection Fees), attached hereto and incorporated herein for all purposes, are hereby adopted for various construction type projects in conjunction with, among others, residential, commercial and industrial structures prior to the start of construction. A determination of the valuation for any enclosed structure other than residential shall be determined at the discretion of Prosper. B. Development Inspection Fee. A development inspection fee shall be charged for each inspection in the amount of three percent (3%) of Prosper's estimates of the costs of the public works utilities and streets of new construction which are to be dedicated to Prosper. These fees shall be paid prior to the start of construction. SECTION 4: Mechanical/Plumbing Permit Fees. The mechanical/plumbing permit fees set forth in Exhibit "A" (II. Mechanical/Plumbing Permit Fees) are hereby adopted. SECTION 5: Electrical Permit Fees. The electrical permit fees set forth in Exhibit "A" (III. Electrical Permit Fees) are hereby adopted. SECTION 6: Sign Permit Fees. The sign permit fees set forth in Exhibit "A" (IV. Sign Permit Fees) are hereby adopted. SECTION 7: Development Fees. The development fees set forth in Exhibit "A" (V. Development Fees) are hereby adopted and shall be applied in accordance with the procedures established by Prosper's Subdivision Ordinance No. 85-26, as it exists or may be amended, and Prosper's Comprehensive Zoning Ordinance No. 84-16, as it exists or may be amended. SECTION 8: Peddler/Solicitor's Fee. The peddler/solicitor's fee set forth in Exhibit "A" (VI. Peddler/Solicitor's Fee) is hereby adopted and each itinerant merchant, peddler, vendor or itinerant taking orders for sale or offering of any items or service will pay such fee in addition to complying with Prosper's Ordinance No. 02-04, as it exists or may be amended, prior to solicitation. SECTION 9: Reconstruction of Streets. The reconstruction of streets fee set forth in Exhibit "A" (VII. Reconstruction of Streets) is hereby adopted. SECTION 10: Miscellaneous. The miscellaneous fees set forth in Exhibit "A" (VIII. Miscellaneous Fees) are hereby adopted. SECTION 11: Water and Sewer Rates. The water and sewer rates set forth in Exhibit "B", attached hereto and incorporated herein for all purposes, are hereby adopted. A. Late Fees. All utility bill payments are due by the 10`h day from the date of the bill except when the tenth day falls on Saturday, Sunday or legal holiday under which condition they are due by 5:00 p.m. Central time on the next working day. 2. All payments made after the tenth (10`h) day will bear a late fee, as set forth in Exhibit `B", of the unpaid balance of the account. B. Pro-Rata Water Service and Sewer Charges. The individual, corporation or partnership requesting the service shall pay Prosper an amount equal to the cost of all materials, labor, equipment and other costs to provide the requested extension. At any time additional connections are made to the water and/or sewer mains, Prosper may collect from the individual connecting to the main(s) an amount equal to the proportional amount of footage of the connector's land abutting the sewer and/or water and repay the same to the original requestor(s) of service or designated recipients. SECTION 12: Impact Fees. Any and all impact fees assessed shall be in accordance with Prosper's Impact Fee Ordinance No. 95-01, as it exists or may be amended. SECTION 13: Penalty Provision. Any person, firm, corporation or business entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding Five Hundred Dollars ($500.00). Each occurrence in violation of this Ordinance shall constitute a separate and distinct offense. The penal provisions imposed under this Ordinance shall not preclude Prosper from filing suit to enjoin the violation nor shall it preclude Prosper from taking such other lawful action as is necessary to prevent or remedy any violation. Prosper retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 14: Savin sg /Repealin Clause. lause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 15: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Prosper hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 16: Effective Date. This Ordinance shall become effective from and after its adoption and publication as required by law.
