AN ORDINANCE OF THE TOWN OF PROSPER, TEXAS
DECLARING AND ESTABLISHING A PORTION OF S.H. 289
(PRESTON ROAD) FROM THE INTERSECTION OF S.H. 289
(PRESTON ROAD) AND U.S. HIGHWAY 380 NORTH TO THE
INTERSECTION OF S.H. 289 (PRESTON ROAD) AND FM ROAD
1461 A "NO PASSING ZONE"; PROVIDING FOR REPEALING,
SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN
EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR
THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the Town Council of the Town of Prosper, Texas (the "Town
Council') has investigated and determined that it would be advantageous and beneficial to
the citizens of the Town of Prosper, Texas ("Prosper") to declare and establish a portion
of S.H. 289 (Preston Road) from the intersection of S.H. 289 (Preston Road) and U.S.
Highway 380 north to the intersection of S.H. 289 (Preston Road) and FM Road 1461
(the "Roadway") a "No Passing Zone"; and
WHEREAS, the Town Council has investigated and determined that overtaking
and passing or driving to the left of the Roadway is hazardous; and
WHEREAS, the Town Council investigated and determined that it has jurisdiction
over the Roadway for, among other things, the purpose of declaring and establishing the
Roadway a "No Passing Zone"; and
WHEREAS, the Town Council finds it is necessary for the protection and safety
for the citizens of Prosper to declare the Roadway described above as a "No Passing
Zone" as set forth below.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF PROSPER, TEXAS:
SECTION 1: Findings Incorporated. The findings set forth above are
incorporated into the body of this Ordinance as if fully set forth herein.
SECTION 2: Declaration and Establishment "No -Passing Zone". Prosper
hereby declares and establishes S.H. 289 (Preston Road) from the intersection of
S.H. 289 (Preston Road) and U.S. Highway 380 north to the intersection of S.H.
289 (Preston Road) and FM Road 1461 a "No Passing Zone". No driver shall at
any time drive on the left side of S.H. 289 (Preston Road) from the intersection of
S.H. 289 (Preston Road) and U.S. Highway 380 north to the intersection of S.H.

289 (Preston Road) and FM Road 1461 within such "No Passing Zone" or on the
left side of any pavement striping designed to mark such "No Passing Zone"
throughout its length; provided, however, this Ordinance shall not be construed as
prohibiting the crossing of such pavement striping, or the center line within the
"No Passing Zone" marked by signs only, in making a left turn into or out of an
alley, private road or driveway.
SECTION 3: Savings/Repealing Clause. All provisions of any ordinance in
conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such
repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor
shall the repeal prevent a prosecution from being commenced for any violation if occurring
prior to the repeal of the ordinance. Any remaining portions of said ordinances shall
remain in full force and effect.
SECTION 4: Severability. Should any section, subsection, sentence, clause or
phrase of this Ordinance be declared unconstitutional or invalid by a court of competent
jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance
shall remain in full force and effect. Prosper hereby declares that it would have passed this
Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact
that any one or more sections, subsections, sentences, clauses and phrases be declared
unconstitutional or invalid.
SECTION 5: Penalty Provision. Any person violating this Ordinance shall be
deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum of not
less than One Dollar ($1.00) nor more than Two Hundred Dollars ($200.00). Prosper
retains all legal rights and remedies available to it pursuant to local, state and federal law.
SECTION 6: Effective Date. This Ordinance shall be effective upon its passage
and publication as required by law.
