01-14 - OTOWN OF PROSPER, TEXAS ORDINANCE NO. 0 AN ORDINANCE OF THE TOWN OF PROSPER, TEXAS AMENDING ORDINANCE NO. 97-10; ADOPTING THE 1997 EDITION OF THE UNIFORM FIRE CODE, VOLUMES 1 AND 2; PRESCRIBING REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE, HAZARDOUS MATERIALS, AND EXPLOSION; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; PROVIDING FOR REPEALING SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the Town Council of the Town of Prosper, Texas ("Town Council") has investigated and determined that it would be advantageous and beneficial to the citizens of the Town of Prosper, Texas ("Prosper") to adopt the 1997 Edition of the Uniform Fire Code. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Adoption of the 1997 Uniform Fire Code. The Uniform Fire Code, Volumes 1 and 2, 1997 Edition, published by the International Fire Code Institute, including Appendix Chapters I-C, II-F, II-G, II-J, III -A, III-C, V-A, and VI-E, save and except the deletions and amendments as set forth herein, is hereby adopted as the file code for Prosper regulating conditions hazardous to life and property from fire, hazardous materials, and explosions in Prosper ("1997 Uniform Fire Code") The 1997 Uniform Fire Code including Appendix Chapters I-C, II-F, II-G, II-J, III -A, III-C, V-A, and VI-E, save and except the deletions and amendments set forth below is made a part of this Ordinance as if fully set forth herein. Three (3) copies of the 1997 Uniform Fire Code are on file in the office of the Town Secretary of Prosper being marked and designated as the Uniform Fire Code, Volumes 1 and 2, 1997 Edition, published by the International Fire Code Institute. SECTION 3: Section 105 of the 1997 Uniform Fire Code (Permits Miscellaneous) shall be amended as follows: 1. Water -based fire suppression system: (Per Square Foot of Building Area) • 0 - 100,000 square feet: $0.015 per square foot ; • 100,001 - 300,000 square feet: $1,500.00 for the first 100,000 square feet plus 0.014 for each additional square foot of area or fiaction thereof; ORDINANCE ADOPTING. Special fire suppression systems (kitchens/cooking)- $50.00 3. Fire alarm systems: • $50.00 per building for less than ten (10) devices; • $75.00 for eleven (11) to twenty-five (25) devices • $150.00 for more than twenty-five (25) devices; • $200.00 for more than one hundred(100) devices; • $400.00 for more than two hundred (200) devices 4. Mechanical Trench Burn $50.00 5. Underground Fire Main (Only): $50.00 6. Single Family Residential Automatic Fire Sprinkler System $50.00 7. Re -inspection Fees (paid prior to scheduling the re -inspection): $30.00 8. Limited access security gates and perimeter fencing: $50.00 per system. SECTION 4: Section 214 (M definitions) of the 1997 Uniform Fire Code shall be amended as follows: MECHANICAL CODE is the Mechanical Code adopted by this jurisdiction. SECTION 5: Section 220 (S definitions) of the 1997 Uniform Fire Code shall be amended as follows: SELF-SERVICE STORAGE FACILITY is the real property designed and used for the purpose of renting or leasing individual storage. SECTION 6: Section 901.4.1 (General) of the 1997 Uniform Fire Code shall be amended as follows: 901.4.1 General. Marking of fire apparatus roads, addresses and fire protection equipment shall be in accordance with Section 901.4. See Section 902.2.3 for fire apparatus access road marking. SECTION 7: Section 902.2.1 (Required Access) of the 1997 Uniform Fire Code shall be amended as follows: The one -hundred fifty (150) feet shall be measured along a ten (10) foot wide unobstructed level pathway not exceeding a slope of 5:1, around the external walls of the ORDINANCE ADOPTING TIIE 1997 UNIFORM FIRE CODE — Page 2 L:/mbox4/prosper/ordinance/tire code ordinance 2001 (1997 UFC)\070501 r s 4979 214 structure. Retaining walls with a shear drop in excess of four (4) feet shall be provided with a fence or barrier to prevent accidental falls. The provision of this section notwithstanding, fire lanes may be required to be located within thirty (30) feet of a building if deemed to by the Prosper Fire Chief to enable proper protection of the building. An unobstructed five (5) foot wide level pathway shall be provided through all barriers. A continuous row of parking between the fire lane and the structure shall be considered a barrier. Fire lane easements shall be provided to serve all buildings through parking areas, to service entrances of buildings, loading areas and trash collection areas, and other areas deemed necessary to be available to fire and emergency vehicles. All commercial buildings and residential subdivisions shall be provided with a minimum of two (2) points of access. (A dead-end street with two (2) points is not considered two (2) points of access.) Residential subdivisions shall not provide a second point of access through commercial developments. The Prosper Fire Chief is authorized to designate additional requirements for fire lanes where reasonably necessary to provide access for fire and rescue personnel. SECTION 8: Section 902.2.2 (Specifications) of the 1997 Uniform Fire Code shall be amended as follows: Section 902.2.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than twenty-four (24) feet and an unobstructed vertical clearance of not less than fourteen (14) feet. For ninety (90) or less degree turns: Twenty-four (24) feet fire lane- minimum radius twenty (20) feet Thirty (30) feet fire lane- minimum radius twenty (20) feet Dimensions for cul-de-sac streets shall be as follows: Fifty-five (55) feet radius right of way Forty-five (45) feet radius curb to curb * * * * * No center island is permitted. Special consideration will be given to increased radius cul-de-sacs however, trees, obstructions, and/or barriers are specifically prohibited in these islands. SECTION 9: Section 902.2.3 (Marking) of the Uniform Fire Code shall be amended as follows: Section 902.2.3 Marking. Either approved striping or signs shall be provided and maintained for fire apparatus roads to identify such roads and prohibit the obstruction thereof or both. 1. Striping- Fire apparatus access roads shall be marked by painted lines of red traffic paint six (6) inches in width to show the boundaries of the lane. The words "NO PARKING FIRE LANE" shall appear in four (4) inch white letters at twenty-five (25) feet intervals on the red border markings along both sides ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 3 L:/mbox4/prosper/ordinance/fire code ordinance 2001(1997 UFC)\070501 4979 2146 of the fire lanes. Where a curb is available, the stripping shall be on the vertical face of the curb. 2. Signs- shall read "NO PARKING FIRE LANE" and shall be twelve (12) inches wide and eighteen (18) inches high. Signs shall be painted on a white background with letters and borders in red, using not less than two (2) inch lettering. Signs shall be permanently affixed to a stationary post and the bottom of the sign shall be six (6) feet, six (6)inches above finished grade. Signs shall be spaced not more than fifty (50) feet apart. Signs may be installed on permanent buildings or walls or as approved by the Prosper Fire Chief. SECTION 10: Section 902.2.4 (Obstruction and control of fire apparatus access) of the 1997 Uniform Fire Code shall be amended as follows: EXCEPTION: Where access gates and perimeter fencing are installed, they must be in compliance with Prosper Fire Department's gating standards. Fences or walls that run parallel to street side access shall be considered barriers from that side of the street and not considered accessible for fire protection. SECTION 11: Section 903 (Water Supplies and Fire Hydrants) of the 1997 Uniform Fire Code shall be amended as follows: 903.4.2 Required Installations. The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises, or both, to be protected as required and approved. A fire hydrant shall be located within (100) one -hundred feet of a fire department connection. Fire hydrants shall be spaced in accordance with the following: Occupancy R-3 and U Occupancies five hundred (500) feet All Others three hundred (300) feet Hydrants shall be provided at all intersecting streets and at intermediate locations between intersections as prescribed above, measured, as the hose would be laid. Hydrants will be installed at all intersecting fire -lanes and at intersections between streets and fire -lanes. Fire hydrants shall be accessible to the fire department apparatus by roads meeting the requirements of Section 902.2. Dead-end water lines shall serve no more than the following number of hydrants: Six (6) inch lines one (1) hydrant ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 4 Ldmbox4/prosper/ordinance/tire code ordinance 2001 (1997 UFC)\070501 4979 2147 Eight (8) inch lines two (2) hydrants' SECTION 12: Section 1003 (Fire Extinguishing Systems) of the 1997 Uniform Fire Code shall be amended as follows: 1003.1.2 Standards. Fire extinguishing systems shall comply with Section 904.2.2 of the 1997 Uniform Building Code and National Fire Protection Association Standards and local amendments set forth below. 5. Throughout all buildings greater than two (2) stories in height regardless of occupancy classification. EXCEPTION: Open parking garages when not in a mixed occupancy building. 6. Automatic fire extinguishing systems shall be installed: a. In all new buildings with a gross floor area of five thousand (5,000) square feet or greater. b. In all existing buildings when additions are made that increase the gross floor area to five thousand (5,000) square feet or greater. c. In all existing buildings with a gross floor area of five thousand (5,000) square feet or greater when any alterations are made effecting thirty percent (30%) or more of the building. d. In all new (including but not limited to, areas annexed into the Town) Group S, Division 1 self-service storage warehouses regardless of floor area. e. In all new (including but not limited to, areas annexed into the Town) Group U, Division 1 private garages, and agricultural buildings with a gross floor area of five thousand (5,000) square feet or greater. The use of area separation walls as described in Section 504.6 of the 1997 Uniform Building Code shall not be considered as an alternative to the requirements of this section. EXCEPTIONS: Automatic fire extinguishing systems need not be installed in the following occupancies when not in a mixed -use building: a. Group A, division 4 (Stadium and Amusement Structures) b. Group U, Division 1 carports and. sheds (sheds must be open on two (2) full sides) not exceeding one thousand (1000) square feet of floor space. 7. Group A or B Occupancies which are used by the occupants for the consumption of alcoholic beverages shall be provided with an automatic fire extinguishing system regardless of size. 8. Group E Occupancies shall be provided with an automatic fire extinguishing system regardless of size. 9. Group R, Division 3 Single family dwellings shall be provided with an automatic fire extinguishing system when greater than two (2) stories in height or when the gross floor area exceeds six thousand (6000) square feet. 10. An automatic fire extinguishing system shall be installed in all Group R, Division 1 hotels and motels. 11. An automatic fire extinguishing system shall be installed in all Group R, Division 1 occupancies containing three (3) or more dwelling units. 12. An automatic fire extinguishing system shall be installed in all Group R, division 3 two-family occupancies with a gross floor area of five thousand (5,000) square feet or greater. 13. When requirements found elsewhere in this code conflict with the requirements of this section, the most restrictive shall apply. Note: All Fire Department Connections ("FDC") shall be metal threaded caps to prevent vandalism and tampering. SECTION 13: Section 1003 (Fire Extinguishing s, sy terns) of the 1997 Uniform Fire Code shall be amended as follows: 1003.4 Permissible Sprinkler Omissions 4.4 Other approved fire -protection equipment is installed in such areas. SECTION 14: 1004 (Standpipes) Of the 1997 Uniform Fire Code shall be amended as follows: 1004.3 Location of Class I Standpipes Hose Connections. There shall be a two-way outlet above the roof line on every standpipe when the roof has a slope of less than four (4) units in twelve (12) units horizontal (33.3% slope) ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 6 LdmboxVprosper/ordinance/fire code ordinance 2001(1997 UFC)\070501 4979 214`9 EXCEPTION: Where the stairway extends to the roof, the two-way outlet may be located at the topmost floor landing. All Class I standpipes shall be: 1. Water filled at all times; or 2. Supervised with a minimum often (10) psig and a maximum of forty (40) psig air pressure with a high/low alarm SECTION 15: Table 1004-A. (Standpipe Required Systems) of the 1997 Uniform Fire Code shall be amended as follows: 5. Groups I; H; B; S; M; F, Division I Occupancies less than three (3) stories in height but greater than ten thousand (10,000) square feet per floor. SECTION 16: 1003.2.4 (Group E Occupancies) of the 1997 Uniform Fire Code shall be amended as follows: 1007.2.41 General Group E Occupancies shall be provided with a fire alarm system in accordance with Section 1007.2.4. Group E, Division 1 Occupancies, and Group E, Division 3 shall be provided with an approved manual fire alarm system In Division 3 occupancies, system smoke detectors shall be installed in all rooms used by children. SECTION 17: 1007(Fire Alarm Systems) of the 1997 Uniform Fire Code shall be amended as follows: 1007.2.12.2.1 General. Occupancies, each having floors used for human occupancy located more than fifty-five (55) feet above the lowest level of fire department vehicle access, shall be provided with an automatic fire alarm system and a communication system in accordance with Section 1007.2.12.2. EXCEPTION: Open parking garages in compliance with Section 311.9 of the Uniform Building Code. ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 7 LJmbox4/prosper/ordinance/fire code ordinance 2001 (1997 UFC)\070501 4979 2150 SECTION 18: 1007.2.12.2 (High-rise building) of the 1997 Uniform Fire Code shall be amended as follows: 1007.2.12.2.3 Emergency voice alarm -signaling system. The operation of any automatic fire detector, sprinkler or water -flow device shall automatically sound an alert tone followed by voice instructions giving appropriate information and direction on a general or selective basis to the following terminal areas: 1. Elevators 2. Elevator lobbies 3. Corridors 4. Exit stairways 5. Rooms and tenant spaces exceeding one -thousand (1,000) square feet in area 6. Dwelling units in apartment houses 7. Hotel guest rooms or suites 8. Areas of refuge (as defined in Prosper's Building Code) A manual override for emergency voice communication shall be provided for all paging zones. The emergency voice alarm -signaling system shall be designed and installed in accordance with Prosper's Building Code and UFC Standard 10-2. Actuation of any automatic or manual device shall initiate an alarm signal on the alarming floor, the floor above and the floor below and identify on an annunciator the zone and address from which the alarm signal originated. SECTION 19: Section 1007 (Fire Alarm Systems) of the 1997 Uniform Fire Code shall be amended as follows: 1007.3.1 Design standards. Fire alarm system, automatic fire detectors, emergency voice alarm communication systems and notification devices shall be designed, installed and maintained in accordance with UFC Standard 10-2 and other nationally recognized standards. All alarm systems new or replacement serving fifty (50) or more alarm actuating devices shall be addressable fire detection systems. Alarm systems serving more than seventy-five (75) smoke detectors or more than two hundred (200) total alarm activating devices shall be analog intelligent addressable fire detection systems. ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 8 L:/mbox4/prosper/ordinance/tire code ordinance 2001 (1997 UFC)\070501 4979 21S1 SECTION 20: Section1007.3.3.8 (Wiring) and 1007.3.3.9 (Flow detectors and electronic monitoring) of the 1997 Uniform Fire Code shall be amended as follows: 1007.3.3.8 Wiring. All fire alarm systems shall be installed in such a manner that the failure of any single alarm -actuating or alarm -indicating device will not interfere with the normal operation of any other such devices. All systems shall be Class "A' wired with a minimum of six (6) feet separation between supply and return loops. IDC- Class "A" style- E- SLC Class "A" Style 6- notification Class "B" Style X. 1007.3.3.9 Flow detectors and electronic monitoring. Sprinkler and standpipe system water -flow detectors shall be provided for each floor tap to the sprinkler system and shall cause an alarm upon detection of water flow for more than fifteen (15) seconds. All control valves in the sprinkler and standpipe systems except for fire department hose connection valves shall be electrically supervised to initiate a trouble signal at the central control station upon tampering. The fire - pump system shall also be supervised for "power available," "phase reversal" and "pump running" conditions by trouble signal on distinct circuits. SECTION 21: (Texas Accessibility Standards) . At a minimum, visual signal appliances must be provided in restrooms and any other general usage areas (e.g., meeting rooms and break rooms), hallways, lobbies, and any other area for common use. If emergency warning systems are provided, then they shall include both audible alarms and visual alarms. SECTION 22: Section 1102.3 (Open Burning) of the Uniform Fire Code shall be amended as follows: 1102.3.1 General. Open burning shall be conducted in trenches with equipment approved by the Texas Natural Resource and Conservation Commission ("TNRCC") and in accordance with Section 1102.3. Open burning shall also be conducted as required by any other governing agencies regulating emissions. EXCEPTION: Recreational fires shall be in accordance with Section 1102.4. SECTION 23: Article 79 (Flammable and Combustible Liquids) of the 1997 Uniform Fire Code shall be amended as follows: 7902.6.11 Secondary Containment. An approved method of secondary containment shall be provided for underground tank systems, including tanks, piping and related components. See Appendix II-G. ORDINANCE ADOPTING THE 1997 UNIFORM FIRE CODE — Page 9 LdmboxVprosper/ordinance/fire code ordinance 2001 (1997 UFC)\070501 4979 2152 SECTION 24: Article 82 (Liquefied* Petroleum Gases) shall be amended as follows: . 8203.2.1.10 Portable Gas Grills. LP -Gas containers are allowed to be used to supply portable gas grills at residential occupancies. Such containers shall not exceed twenty (20)-pound (9.Okg) water capacity. SECTION 25: Section 8204 (Location of Containers) of the 1997 Uniform Fire Code shall be amended as follows: 8204.2 Maximum Capacity within Established Limits. Within the limits established by law restricting the storage of LP -gas for the protection of heavily populated or congested commercial areas, the aggregate capacity of any one (1) installation shall not exceed a two -thousand (2,000)-gallon water capacity. EXCEPTION: Except as permitted in 8203.4, LP -Gas containers are not allowed in residential areas that offer natural gas. SECTION 26: Appendix I-C- (STAIRWAY IDENTIFICATION) of the 1997 Uniform Fire Code shall be adopted as written. SECTION 27: Appendix II-F of the 1997 Uniform Fire Code shall be amended as follows: Section 1- Scope: Storage and dispensing of motor fuels into the fuel tanks of motor vehicles from protected aboveground tanks located outside buildings shall be in accordance with Appendix II-F. Storage and dispensing of motor fuels from above ground tanks shall be limited to private facilities only and shall not be accessible to the public. SECTION 28: Appendix II-F (Section 4 Tank Design) of the 1997 Uniform Fire Code shall be amended as follows: 4.3 Size. Primary tanks shall not exceed a twelve thousand (12,000) gallon individual or twenty thousand (20,000) gallon aggregate capacities. SECTION 29: Appendix III -A FIRE FLOW REQUIREMENTS of the 1997 Uniform Fire Code shall be adopted as written. SECTION 30: Appendix III-C INSPECTION, TESTING AND MAINTENANCE OF WATER -BASED FIRE PROTECTION SYSTEMS shall be adopted as written. SECTION 31: Appendix VI-E REFERENCE TABLES FROM THE UNIFORM BUILDING CODE shall be adopted as written. All traffic -controlled intersections installed in Prosper shall be equipped with a device that is compatible with the 3M Opticom Priority Control System. All Optical detectors shall be mounted at or near the intersection that permits a direct, unobstructed line -of -sight to the oncoming vehicle. Card racks and phase selectors must be mounted in traffic control cabinets. SECTION 33: Penalty Provision. Any person, firm, corporation or business entity violating this ordinance or any provision of Prosper Ordinance No. 97-10, or as amended, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding Two Thousand Dollars ($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Prosper from filing suit to enjoin the violation. Prosper retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 34: Savings/Repealing Clause. Prosper Ordinance No. 97-10 shall remain in full force and effect, save and except as amended by this or any other Ordinance. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 35: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Prosper hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. SECTION 36: Effective Date. This Ordinance shall become effective from and after its adoption and publication as required by law.
