AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE TOWN OF PROSPER,
TEXAS BY THE GRANTING OF A VARIANCE ON THE AREA SCHEDULE OF A CERTAIN
PROPERTY IN ACCORDANCE WITH THE PROVISIONS OF THE OFFICIAL ZONING
ORDINANCE OF THE TOWN OF PROSPER, TEXAS.
WHEREAS, A REQUEST FOR A VARIANCE FOR CERTAIN REAL PROPERTY LOCATED
WITHIN THE CORPORATE LIMITS OF THE TOWN OF PROSPER, TEXAS HAS BEEN RECEIVED
BY THE CITY SECRETARY; AND
WHEREAS, DUE CONSIDERATION OF THE REQUEST WAS GIVEN AS REQUIRED AND
EVIDENCE WAS HEARD BY THE MAYOR AND CITY COUNCIL OF THE TOWN OF PROSPER,
TEXAS; AND
WHEREAS, THE CITY COUNCIL HAS DULY CONSIDERED THE REQUEST AND ALL
COMMENTS MADE; AND
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE TOWN OF PROSPER, TEXAS:
SECTION.1. THE OFFICIAL ZONING MAP OF THE TOWN OF PROSPER, TEXAS SHALL BE
AMENDED BY RECOGNIZING THE FOLLOWING DESCRIBED PROPERTY AS HAVING BEEN
GRANTED A VARIANCE ON THE S I D E SET -BACK REQUIRED AS DESCRIBED WITHIN THE
OFFICIAL ZONING ORDINANCE OF THE TOWN OF PROSPER, TEXAS.
ABSTRACT 147, COLMN COUNTY SCHOOL LAND SURVEY, SHEET 7, TRACT 19
SECTION Z. IT SHALL BE LAWFUL TO ADVANCE CONSTRUCTION OF A GARAGE ON THE
WEST SIDE YARD AN ADDITIONAL 7 FEET MAKING THE WEST SIDE SETBACK THREE FEET.
SECTION 3. THE CITY ENGINEER IS HEREBY DIRECTED TO AMEND THE OFFICIAL ZONING
MAP OF THE TOWN OF PROSPER, TEXAS.
SECTION 4. THE CITY COUNCIL, HAVING DETERMINED THAT THE IMMEDIATE
EFFECTIVENESS OF THE WITHIN ORDINANCE IS NECESSARY TO THE SAFETY AND
WELFARE OF THE CITIZENS OF THE TOWN OF PROSPER, TEXAS, THIS ORDINANCE SHALL
BECOME EFFECTIVE UPON IT PASSAGE.
