COMPLAINTS OF ORDINANCES OR REGULATION VIOLATIONS WITHIN THIS AREA WILL BE ANSWERED AND INVESTIGATED WITHIN 60 DAYS OF THE EFFECTIVE DATE OF THE ANNEXATION ORDINANCE. 2. AS DEVELOPMENT AND CONSTRUCTION COMMENCE IN THIS AREA, SUFFICIENT PERSONNEL WILL BE PROVIDED TO FURNISH THIS AREA THE SAME LEVEL OF ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES AS ARE FURNISHED THROUGHOUT THE CITY. D. PLANNING AND ZONING SERVICES THE PLANNING AND ZONING JURISDICTION OF THE CITY WILL EXTEND TO THIS AREA WITHIN 60 DAYS OF THE EFFECTIVE DATE OF THE ANNEXATION ORDINANCE. CITY PLANNING WILL THEREAFTER ENCOMPASS THIS PROPERTY,AND IT SHALL BE ENTITLED TO ORDINANCE 97-04 CONSIDERATION FOR ZONING IN ACCORDANCE WITH THE CITY'S COMPREHENSIVE PLAN. Ui E. PARK AND RECREATION SERVICES O 1. RESIDENTS OF THIS PROPERTY MAY UTILIZE ALL EXISTING PARK AND CFI RECREATIONAL SERVICES,FACILITIES,AND SITES THROUGHOUT THE CITY, BEGINNING WITHIN 60 DAYS OF THE EFFECTIVE DATE OF THE ANNEXATION N ORDINANCE. 2. ADDITIONAL FACILITIES AND SITES TO SERVE THIS PROPERTY AND ITS RESIDENTS WILL BE ACQUIRED,DEVELOPED,AND MAINTAINED AT LOCATIONS AND TIMES PROVIDED BY APPLICABLE PLANS,POLICIES AND PROGRAMS AND DECISIONS OF THE CITY OF PROSPER THIS PROPERTY WILL 3. BE INCLUDED IN ALL PLANS FOR PROVIDING PARKS AND RECREATION SERVICES TO THE CITY. THE SAME LEVEL OF PARKS AND RECREATION SERVICES SHALL BE FURNISHED TO THIS PROPERTY AS IS FURNISHED THROUGHOUT THE CITY. 4. EXISTING PARKS,PLAYGROUNDS,AND OTHER RECREATIONAL FACILITIES WITHIN THIS PROPERTY SHALL,UPON DEDICATION TO AND ACCEPTANCE BY THE CITY,BE MAINTAINED AND OPERATED BY THE CITY OF PROSPER,BUT NOT OTHERWISE. F. SOLID WASTE COLLECTION 1. SOLID WASTE COLLECTION SHALL BE PROVIDED TO THE PROPERTY IN ACCORDANCE WITH EXISTING CITY POLICIES,BEGINNING WITHIN 60 DAYS OF THE EFFECTIVE DATE OF THE ANNEXATION ORDINACNE. RESIDENTS OF THIS PROEPRTY UTILIZING PRIVATE COLLECTION SERVICES AT THE TIME OF ANNEXATION SHALL CONTINUE TO DO SO UNTIL IT BECOMES FEASIBLE BECAUSE OF INCREASED DENSITY OF POPULATION TO SERVE TH EPROPERTY MUNICIPALLY.COMMERCIAL REFUSE SERVICE COLLECTION SERVICES WILL BE PROVIDED TO ANY BUSINESS LOCATED IN THE ANNEXED AREA AT THE SAME PRICE AS PRESENTLY PROVIDED FOR ANY BUSINESS CUSTOMER WITHIN THE CITY OF PROSPER,UPON REQUEST. 2. THE CITY OF PROSPER'S EXISTING POLICIES WITH REGARD TO STREET MAINTENENCE,APPLICABLE THROUGHOUT THE ENTIRE CITY, SHALL APPLY CFI TO THIS PROPERTY BEGINNING WITHIN 60 DAYS OF THE EFFECTIVE DATE OF THE ANNEXATION ORDINANCE. UNLESS A STREET WITHIN THIS PROPERTY HAS BEEN CONSTRUCTED OR IS IMPROVED TO THE CITY'S STANDARDS AND CD SPECIFICATIONS,THAT STREET WILL NOT BE MAINTAINED BY THE CITY OF PROSPER. CJI 2. Box 307 Prosper, Texas 75078-0307 RE: Preliminary Plat Gentle Creek Estates Dear Mayor Coffman: I reviewed a Preliminary Plat and submittal documents dated April 4, 1997, for the subdivision of 148 acres in the extraterritorial jurisdiction of the City of Prosper into eighty single family residential lots one acre and larger. The subdivision is on the south side of FM 1461 and between Gentle Creek and Wilson Creek. The developer proposes to install septic tanks according to the regulations of Collin County. The developer proposes to install a 12" waterline conforming to your rmpact Fee Ordinance from near Chandler Circle north along U.S. 289 and east along F.M. 1461 to Wilson Creek. The total waterline distance is 15,000 feet. The developer requests variances with regard to street paving width and cul-de-sac length. I am recommending that the City Council accept the Preliminary Plat with the following considerations. 1. I estimate that the waterline will cost the developer approximately $450,000.00 to construct. Of this investment you can credit the developer about $287,600.00 in impact fees for his development. During the 10 years following the date the Final Plat is filed, you may reimburse the developer for his additional cost from impact fees received from developments that benefit from the waterline. I suggest that the developer be reimbursed at the rate of approximately$660.00 from each impact fee received until he has been paid the amount of reimbursement to which he is entitled. The City of Prosper should retain the remaining amount from the impact fees in order to pay for the cost of a water well, P.O. It will be consistent with your prior practice not to collect wastewater impact fees for subdivisions that will be served by septic tank systems. 3. I recommend that you grant the variance to authorize streets constructed of concrete twenty-four feet wide and six inches thick as you have previously done for residential estate subdivisions. 4. I recommended that you grant the variance with regard to the cul-de-sac length as requested by the developer. The longer cul-de-sacs are compatible with the larger lots proposed for the residential estate subdivision. 5. Utility easements should be designated along the rear of all lots. 6. Drainage easements should be located in Block A between Lots 6 and 7, between Lots 10 and 11, and between Lots 17 and 18. • 7. A drainage easement should be designated across Lot 9 of Block C. 8. The 100 year flood plain along Wilson Creek should be designated as drainage easement. 9,. The 100 year drainage zone along Gentle Creek should also be designated as a drainage easement. 10. A drainage easement should be designated from the culvert on Gentle Way at Lot 33 of Lot B to Gentle Creek. 11. The culvert and other drainage structures should be designed on the basis of flow rates calculated using a run-off coefficient of 0.50, a time of concentration of 15 minutes, and a rainfall intensity of 7.6 inches per hour.
