Land Survey, Abstract No. 147, Tracts 39 & 67) 14521 2057 99- 012 76' u'' ORDINANCE NO.99-44 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF PROSPER,TEXAS; AUTHORIZING THE USE OF CERTAIN PROPERTY IN ACCORDANCE WITH THE OFFICIAL ZONING MAP AS AMNDED AND DECLARING ITS EFFECTIVENESS. WHEREAS AN APPLICATION TO CHANGE THE ZONING CLASSIFICATION FOR CERTAIN REAL PROPERTY LOCATED WITHIN THE CITY OF PROSPER,TEXAS HAS BEEN RECEIVED BY THE CITY COUNCIL,AND; WHEREAS,DUE TO NOTIFICATION OF SAID APPLICATION WAS GIVEN AS IS REQUIRED BY LAW AND A PUBLIC HEARING WAS HELD ON SAID NOTICE,AND; WHEREAS,THE CITY COUNCIL HAS DULY CONSIDERED SAID APPLICATION AND ANY COMMENTS MADE AT SAID HEARING. IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER,TEXAS: SECTION 1. THE OFFICIAL ZONING MAP OF THE CITY OF PROSPER,TEXAS SHALL BE AMENDED BY CHANGING THE FOLLOWING DESCRIBED REAL PROPERTY FROM A CLASSIFICATION AGRICULTURAL TO COMMERCIAL. rr, COLLIN COUNTY SCHOOL LAND SURVEY,ABSTRACT NO. 147,SHEET 2,TRACTS 39 AND 67, (` BEING 9.68 ACRES. SECTION 2. IT SHALL BE LAWFUL TO USE SAID PROPERTY FOR ANY USE PERMITTED IN THE COMEMRCIAL CLASSIFICATION AS PROVIDED IN THE ORDINANCE OF THE CITY OF PROSPER,TEXAS. SECTION 3. THE CITY ENGINEER IS HEREBY DIRECTED TO MAKE APPROPRIATE MODIFICATIONS TO THE OFFICIAL ZONING MAP OF THE CITY. SECTION 4. THE CITY COUNCIL,HAVING DETERMINED THAT THE IMMEDIATE EFFECTIVENESS OF THE WITHIN ORDINANCE IS NECESSARY TO THE PUBLIC WELFARE OF THE CITIZENS OF THE CITY OF PROSPER,TEXAS.
