A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, HEREBY AUTHORIZING THE MAYOR TO PAY THE COSTS, INCLUDING ATTORNEYS' FEES AND EXPERT FEES, ASSOCIATED WITH CONDEMNING THE PROPERTY DESCRIBED AS BEING SITUATED IN COLLIN COUNTY, TEXAS, IN THE'COLLIN COUNT' SCHOOL LAND SURVEY, ABSTRACT NO. 147, AND BEING A STRIP OF LAND 45 FEET WIDE PARALLEL AND ADJACENT TO THE CENTERLINE OF COUNTY ROAD 4 AND THE SOUTH LINE OF A TRACT OF LAND DESCRIBED IN A DEED TO THOMAS D. BULL AND WIFE, INEZ BULL RECORDED IN VOLUME 726,PAGE. 106 OF THE COLLIN COUNTY DEED RECORDS, SAID STRIP BEING 1,950,30 FEET, MORE OR LESS, IN LENGTH, FOR THE PURPOSE OF OBTAINING A RIGHT-OF-WAY TO ENABLE COLLIN COUNTY TO COMPLETE THE EXTENSION OF COUNTY ROAD 4 FROM BUSINESS ROAD 289 TO COUNTY LINE ROAD. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, r:EXAS: S CTION 1: The Town Council ("Town Council") for the Town of Prosper, Texas ("Prosper") has investigated and determined that it is empowered by the legislature of the State of Texas to exercise the right of eminent domain for the purpose of acquiring a right-of-way to enable Collin County to complete the extension of County Road 4 from Business Road 289 to County Line Road. Collin County will pay for and construct, utilizing county bonds, the extension of County Road 4 from Business Road 289 to County Line Road, and Prosper will initiate and pay foi•'the costs, including attorneys' fees and expert fees, of condemning the following property, for the purpose of obtaining the right-of way, which is more particularly described in Exhibit "A" attached hereto and incorporated herein for all purposes: Situated in Collin County, Texas, in the Collin County School Land Survey, Abstract No. 147, and being a strip of land 45 feet wide parallel and adjacent to the centerline of County Road 4 and the south line of a tract of land described in a RESO!-.TITION ti0. ::/ -� --- Page I Oambnx\prospc: ondemn.res Sent by: JetFax M15 9725625514; 03/29/99 4:46PM;Je #147;Page 3/3 Deed to Thomas D. Bull and wife,Inez Bull recorded in Volume 726, Page 106 of the Collin County Deed Records, said strip being 1,950.30 feet, more or less, in length. ££CTt.QIN2.: The Town Council has further investigated and determined that it would be advantageous and beneficial to the citizens of Prosper for Prosper to acquire, by eminent domain, the property described in Exhibit "A" attached hereto for the purpose of obtaining a right-of-way to enable Collin County to complete the extension of County Road 4 from.Business Road 289 to County Line Road. SECTIOi�I 2: The Mayor of Prosper is hereby authorized to pay the costs, including attorneys' fees and expert fees, associated with condemning the property more particularly described in Exhibit "A" attached hereto for the purpose of obtaining a right-of-way to enable Collin County to complete the construction of County Road 4 from Business Road 289 to County Line Road.
