AN ORDINANCE OF THE TOWN OF PROSPER, TEXAS, AMENDING zr-
CERTAIN PROVISIONS OF THE 1994 EDITION OF THE UNIFORM FIRE cD
CODE, VOLUMES 1 AND 2 AND ORDINANCE NO. 89-3, ORDINANCE NO.
96-10 AND ORDINANCE NO. 97-10; PRESCRIBING AMENDMENTS TO THE

REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND CA
PROPERTY FROM FIRE, HAZARDOUS MATERIALS, AND EXPLOSION;
PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS ORDINANCE;
PROVIDING FOR REPEALING AND SEVERABILITY CLAUSES;PROVIDING
FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR
THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the Town Council of the Town of Prosper, Texas ("Town Council")has
investigated and determined that it would be advantageous and beneficial to the citizens of the
Town of Prosper, Texas ("Prosper")to amend certain provisions to the 1994 Edition of the
IPUniform Fire Code and Ordinance No. 89-3, Ordinance No. 96-10 and Ordinance No. 97-10.
NOW, THEREFORE,BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF PROSPER, TEXAS:
SECTION 1: Findings. The findings set forth above are incorporated into the body of
this Ordinance as if fully set forth herein.
SECTION 2: Amendments to the Uniform Fire Code. The Uniform Fire Code, Volume
I and II, 1994 Edition,published by the International Fire Code Institute,including Appendix
Chapter II-F, save and except the deletions and amendments as set forth in Ordinance No. 89-3,
IDOrdinance No. 96-10 and Ordinance No. 97-10, ("1994 UFC") is hereby amended as follows:
• Section 902 of the 1994 Uniform Fire Code relating to Fire Department
Access shall be amended as follows:
A. Section 902.2.2.1 Dimensions. Fire apparatus access roads shall have an
unobstructed width of not less than 24 feet and an unobstructed vertical
clearance of not less than 13 feet 6 inches. Vertical clearances or widths

shall be increased when, in the opinion of the chief, vertical clearances or
widths are not adequate to provide fire apparatus access.
B. Section 902.2.2.2 Surface. Fire apparatus access roads shall be designed
to support the imposed loads of fire apparatus and shall be provided with a
surface equal in design and materials to the minimum standards for streets
in the Town of Prosper, Texas.
• Section 1003 of the 1994 Uniform Fire Code relating to Fire Extinguishing
Systems shall be amended as follows:
A. Section 1003.1.1 Standards. Fire extinguishing systems shall comply
with the requirements of the 1996 Edition of the National Fire Protection
Association 13 ("1996 NFPA 13"). Group R Occupancies shall comply
with the requirements of 1996 NFPA 13, however,the exceptions
contained in the 1996 NFPA 13 Sections 2 through 6 are hereby deleted
and shall not apply.
(yam B. Section 1003.2.2 Automatic fire-extinguishing system. An automatic
fire-extinguishing system shall be installed:
5. Throughout all buildings two or more stories in height regardless
of occupancy.
6. In all new buildings 6,000 square feet or greater in total area.
7. In all existing buildings where additions are made that increase the
total area to 6,000 feet or greater.
8. In all existing buildings 6,000 feet or greater when any alterations
are made.
9. In all Group R, Division 1 hotels and motels and shall comply with
the requirements of the 1996 NFPA 13.
10. In all Group R,Division 1 Occupancies containing three (3) or
more dwelling units.
11. In all Group R, Division 3 two-family Occupancies 6,000 square
feet or greater in total area.
12. Exceptions: An automatic fire-extinguishing system need not be
installed in the following occupancies when not in a mixed use
building.

a. Group A, Division 4 (Stadium and Amusement Park
Structures)
b. Group S, Division 4 (Open Parking Garages)
c. Group U, Division 1 (Accessory Buildings)
d. Temporary structures
e. Group R, Division 3 (Single family dwellings must be
provided with an automatic fire-extinguishing system only
when greater than two stories in height or when the fire
flow does not meet the minimum requirements in Table A-
III-A-1 of the 1994 Uniform Fire Code.
13. When requirements found elsewhere in this code conflict with the
requirements in this section, the most restrictive shall apply.
• Appendix Chapter II-F is amended as follows:
SECTION 1 - SCOPE
Storage and dispensing of motor fuels into the fuel tanks of motor
vehicles from protected above-ground tanks located outside
buildings shall be in accordance with Appendix II-F. Storage and
dispensing of motor fuels from above ground tanks shall be limited
to private facilities only and shall not be accessible to the public.
SECTION 4- TANK DESIGN
4.3 Size Primary Tanks. Primary tanks shall not exceed 10,000
gallon individual capacity and 15,000 gallon aggregate capacity.
SECTION 3: Penalty. Any person, firm, corporation or business entity violating this
Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a
sum not exceeding Two Thousand Dollars ($2,000.00). Each continuing day's violation under
this Ordinance shall constitute a separate offense. The penal provisions imposed under this
Ordinance shall not preclude Prosper from filing suit to enjoin the violation. Prosper retains all
legal rights and remedies available to it pursuant to local, state and federal law.

SECTION 4: Conflicting Ordinances Repealed. All ordinances in conflict with this
Ordinance are repealed to the extent they are in conflict, and any remaining portions of the
conflicting ordinance shall remain in full force and effect.
SECTION 5: Severability. Should any section, subsection, sentence, clause or phrase of
this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is
expressly provided that any and all remaining portions of this Ordinance shall remain in full
force and effect. Prosper hereby declares that it would have passed this Ordinance, and each
section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections,
subsections, sentences, clauses, and phrases be declared unconstitutional or invalid.
( SECTION 6: Effective Date. This Ordinance shall take effect immediately from and
after its passage and publication in accordance with the laws of this state, and it is accordingly so
ordained.
