98-26 R - Excessive Force during Nonviolent Civil Rights Demonstrations CITY OF PROSPER,TEXAS RESOLUTION NO. 98-26 A RESOLUTION OF THE CITY OF PROSPER,TEXAS, COLLIN COUNTY,STATE OF TEXAS, ESTABLISHING RULES REGARDING THE USE OF EXCESSIVE FORCE DURING NONVIOLENT CIVIL RIGHTS DEMONSTRATIONS. WHEREAS, the City of Prosper,Texas, is a participant in the Texas Community Development Program (TCDP) and a recipient of TCDP grant funds;and WHEREAS, it is a condition of the TCDP contract between the Texas Department of Housing and Community Affairs and the City of Prosper, Texas, that a resolution establishing rules regarding the use of excessive force during nonviolent civil rights demonstrations be passed during the contract period;and WHEREAS, it is within the power and proper responsibility of government to prevent the use of excessive force during nonviolent civil rights demonstrations; NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PROSPER,TEXAS: ARTICLE I • Section 1: That the City of Prosper, Texas, adopts a policy of prohibiting the use of excessive force by the law enforcement agencies within its jurisdiction against any individual engaged in nonviolent civil rights demonstration. The City also prohibits the physical barring of any entrance or exit of such a facility and will enforce all applicable state laws regarding same. ARTICLE II Section 1: Any person found to be violating any provisions of this resolution shall be served by the City with written notice stating the nature of the violation. Section 2: Any person guilty of this violation shall be guilty of a misdemeanor, and on conviction thereof shall be fined in the amount not exceeding one hundred dollars($100.00)for each violation. Bach day in which any such violation shall continue shall be deemed a separate offense.
