AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE TOWN OF PROSPER,
TEXAS,BY THE GRANTING OF A VARIANCE ON THE AREA SCHEDULE OF A CERTAIN
PROPERTY IN ACCORDANCE WITH THE PROVISIONS OF THE OFFICIAL ZONING
ORDINANCE OF THE TOWN OF.PROSPER,TEXAS.
WHEREAS,A REQUEST FOR A VARIANCE FOR CERTAIN REAL PROPERTY LOCATED
WITHIN THE CORPORATE LIMITS OF THE TOWN OF PROSPER,TEXAS HAS BEEN RECEIVED
BY THE CITY SECRETARY;AND
WHEREAS,DUE CONSIDERATION OF THE REQUEST WAS GIVEN AS REQUIRED AND
EVIDENCE WAS BEARD BY THE MAYOR AND CITY COUNCIL OF THE TOWN OF PROSPER,
TEXAS;AND
WHEREAS THE CITY COUNCIL HAS DULY CONSIDERED THE REQUEST AND ALL
COMMENTS-MADE,AND •
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE TOWN OF PROSEPR,
TEXAS:
SECTION 1. THE OFFICIAL ZONING MAP'OF THE TOWN OF PROSPER,TEXAS SHALL BE
AMENDED BY RECOGNIZING THE FOLLOWING DESCRIBED PROPERTY AS HAVING BEEN
GRANTED A VARIANCE ON THE SET-BACK REQUIREMENTS AS DESCRIBED WITHIN THE
OFFICIAL ZONING ORDINANCE OF THE TOWN OF PROSPER,TEXAS:
LOT 25 BLOCK"B" STONE CREEK ESTATES
SECTION 2. IT SHALL BE LAWFUL TO ADVANCE CONSTRUCTION AN ADDITIONAL 7
FEET WITHIN THE ABOVE DESCRIBED PROPERTY LINE AND BRING THE TOTAL FRONT
YARD SCHEDULE.ON THE ABOVE DESCRIBED PROPERTY TO 18 FEET.
SECTION 3. THE CITY ENGINEER IS HEREBY DIRECTED TO AMEND THE OFFICIAL
ZONING MAP OF THE TOWN OF PROSPER,TEXAS.
SECTION 4. THE CITY COUNCIL,HAVING DETERMINED THAT THE IMMEDIATE
EFFECTIVENESS OF THE WITHIN ORDINANCE IS NECESSARY TO THE SAFETY AND
WELFARE OF THE CITIZENS OF THE TOWN OF PROSPER,TEXAS,THIS ORDINANCE SHALL
BECOME El-FECTIVE IMMEDIATELY UPON ITS PASSAGE.
PASSED AND DULY APPROVED THIS THE 21ST DAY OF APRIL, 1998 BY THE CITY
COUNCIL THE TOWN OF PROSPER,TEXAS.
