Emergency Water Demand Management Ordinance:

AN ORDINANCE ADOPTING A CITY OF PROSPER WATER CONSERVATION
AND EMERGENCY WATER DEMAND PLAN.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER, STATE
OF TEXAS, THAT:
Section 1: Approval of the Plan. The City Council hereby approves and adopts as the
City's Water Conservation and Emergency Water Demand Plan (hereinafter referred to
j as "the Plan") attached hereto and included in full as a part of this Ordinance as if recited
verbatim herein. The City commits to implement the program according to the
procedures set forth in the adopted plan.
Section 2: The Mayor or the designated representative shall have the authority to institute
and terminate the excess water use pursuant to the terms and conditions in the Plan.
Section 3: The Mayor or the designated representative is the designated official for
implementation of management responses when the trigger conditions as delineated in the
Plan are reached.
Section 4: Users of City water that do not comply with the plan shall be subject to a
penalty and fine or not less than $10.00 per day nor more than $200.00 per day for each
day of noncompliance to be established by the Mayor or the designated representative
and/or disconnection or discontinuance of water services to such users by the City.
Section 5: The City Council finds that all requirements as required by law as to notice,
. public meetings, and procedure have been met and the City Council hereby ratifies,
_ approves and confirms said requirements.

Section 6: This Ordinance is hereby incorporated and made a part hereof of the City
Code of the City of Prosper.
