96-13 O - Increase Water Rates CITY OF PROSPER, TEXAS ORDINANCE NO. 9 6- 13
AN ORDINANCE ESTABLISHING INCREASED WATER RATES FOR
CUSTOMERS BOTH WITHIN AND OUTSIDE THE CITY LIMITS;
PROVIDING FOR SAVINGS, REPEALING AND SEVERABILITY CLAUSES;
PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE
PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the City of Prosper, Texas ("Prosper") has previously adopted Ordinance
No. 93-07 providing for, among other things, water rates for customers inside and outside the city
limits; and
WHEREAS, Prosper, after considering the costs associated with providing water to

customers inside and outside the city limits, has determined that it is in the best interest of the
citizens of Prosper that all customers, both inside and outside the city limits of Prosper, water
rates should be increased as listed in this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PROSPER, TEXAS, THAT:
SECTION 1: From and after the first utility billing in August 1996, the water rates for
each thirty (30) day period charged by Prosper for all water consumed both inside and outside the
city limits shall be as follows:
Inside the City Limits
The base rate is increased to $8.75 for the first 2,000 gallons of usage.
Thereafter, for each additional 1,000 gallons of usage, the rate shall be
increased to $3.40.
Outside the City Limits
The base rate is increased to $19.75 for the first 2,000 gallons of usage.
Thereafter, for each additional 1,000 gallons of usage, the rate shall be
increased to $3.40.

SECTION 2: All Ordinances or provisions of Ordinances in conflict with this Ordinance
are hereby repealed to the extent they are in conflict. Any remaining provisions of conflicting
ordinances shall remain in full force and effect.
SECTION 3: It is hereby declared to be the intention of the City Council that if any
phrase, clause, sentence, paragraph or section of this Ordinance is declared unconstitutional or
invalid by judgment or decree of a Court of competent jurisdiction, then such unconstitutionality
or invalidity shall not affect any other remaining phrase, clause, sentence, paragraph or section of
this Ordinance; and the City Council hereby declares it would have passed the remaining portions
even though it had known the affected parts would be held unconstitutional or invalid.
SECTION 4: This Ordinance shall become effective from and after its adoption and the
caption of this Ordinance shall be published two (2) times in a newspaper having general
circulation in the City of Prosper, Texas and shall be effective with the first water billing in the
month of August 1996.
