CITY OF PROSPER, TEXAS ORDINANCE NO. 9 4-19
AN ORDINANCE DISANNEXING A STRIP OF ROADWAY FROM
THE CITY OF PROSPER, TEXAS, AND ALTERING THE
BOUNDARIES OF THE CITY TO EXCLUDE THE STRIP OF
- ROADWAY FOR THE PURPOSE OF OBTAINING ROAD
IMPROVEMENTS; AND PROVIDING FOR AN EFFECTIVE DATE
OF THIS ORDINANCE.
WHEREAS, sparsely populated and uninhabited areas in General Law
Municipalities may be disannexed under the provisions of V.T.C.A., Local Government
Code, Section 43.144;
WHEREAS, the strip of roadway consists of at least ten (10) acres which are
contiguous to the municipality and contains fewer than one occupied residence or
business structure for every two (2) acres and fewer than three (3) occupied residences
or business structures on any one acre and therefore qualifies as a sparsely populated
area; and
•
WHEREAS, the governing body of the City of Prosper, Texas ("Prosper") deems
it in the best interest of Prosper in order to obtain certain road improvements to
discontinue the strip of roadway as part of Prosper.
NOW, THEREFORE, BE IT ORDAINED BY.THE GOVERNING BODY OF
THE CITY OF PROSPER, TEXAS:
SECTION 1: The strip of roadway, more commonly known as
S. CRAIG ROAD and more fully described on Exhibits A, B, C and D attached to
this Ordinance, is hereby disannexed from Prosper; the boundary limits of Prosper are
hereby amended to exclude the strip of roadway from Prosper's city limits; and the strip
of roadway shall hereafter be excluded from the territorial limits of Prosper. (See
Exhibits A, B, C and D attached hereto for a legal description of strip of roadway.)
SECTION 2: The City. Secretary is hereby directed to file a certified copy of this
Ordinance with the County Clerk or other appropriate officials and agencies, as required
by state and federal law, or as required by city annexation and disannexation procedures.
SECTION 3: This Ordinance shall become effective immediately upon its
passage. •
