CITY OF PROSPER, TEXAS ORDINANCE NO. 92-05
AN ORDINANCE AMENDING ORDINANCE NO. 79-02 INCREASING THE
FEES CHARGED FOR SEWER SERVICE IN THE. CITY OF PROSPER,
TEXAS; PROVIDING FOR THE PUBLICATION OF THE CAPTION OF THIS 4
ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE HEREOF.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
- CITY OF PROSPER, TEXAS:
WHEREAS, the City Council of the City of Prosper, Texas
("City Council") desires to amend Ordinance No. 79-02, Section 4
to increase the fees charged for sewer service; and
WHEREAS, the City Council of the City of Prosper, Texas has
investigated and determined that it will •be advantageous and
beneficial to the City of Prosper, Texas to increase the fees
charged for sewer service as set forth below.
SECTION 1: Sanitary Sewer Charges.

Except as amended herein, all other provisions of Ordinance

79-02 shall remain in full force and effect.

SECTION 2 : Effective Date.
This Ordinance shall be effective -NOVVRFR
SECTION 3: Severability.
If any section, subsection, paragraph, sentence, phrase or
clause of this Ordinance is, for any reason, held to be
unconstitutional, such decision shall not affect the validity of
the remaining ,portions.,of this Ordinance. The City of Prosper,
Texas hereby declares that it would have passed this Ordinance,
and each section, subsection, clause or phrase thereof,
irrespective of the fact that any one or more sections,
subsections, sentences, clauses, and phrases be declared
unconstitutional.
SECTION 3 : Repeal of Conflicting Ordinances.
Any and all ordinances and resolutions of the City of
Prosper, Texas, heretofore adopted which are in conflict with
this Ordinance, except as provided above, are hereby expressly
repealed insofar as the same are in conflict therewith.
SECTION 4 : Publication.
The caption of this Ordinance shall be published in
accordance with the law and shall be effective immediately upon
its passage and such publication.
