ORDINANCE PROVIDING FOR A TWENTY (20) FOOT SETBACK FROM
CHURCH STREET FOR RESIDENCES ERECTED ON LOTS 1A, 1B, 2B,
2A, 3A, 3B, 4B, 4C, 4A & 5 OF BLOCK B IN VALLEY VIEW ADD-
ITION TO THE TOWN OF PROSPER AND PROVIDING A VARIANCE FROM
PLAT PLAN OF RECORD IN VOLUMN 4, PAGE 77 AS FILED FOR RE-
CORD BY THE COUNTY CLERK IN COLLIN COUNTY ON THE 4th OF
JUNE, 1964.
WHEREAS, A SETBACK OF TWENTY (20) FOOT FROM THE STREET FOR ALL RESIDENTIAL
STRUCTURES HAS GENERALLY PREVAILED, IT DID NOT BECOME A REQUIREMENT UNTIL
SEPTEMBER 2, 1969, AND
WHEREAS, ALL OF THE IMPROVEMENTS ON LOTS 1A, 1B, 2B, 2A,3A,3B,4B,4C,4A &
5 HAVE BEEN MADE SINCE SEPTEMRER 2, 1969 AND ARE IN CONFORMITY WITH THE SET-
BACK REQUIREMENTS OF THE TOWN OF PROSPER, AND
WHEREAS, THE THIRTY (30) FOOT SETBACK REQUIREMENT FOR RESIDENTIAL DWELLr
INGS IN THE PLAT PLAN FOR VALLEY VIEW ADDITION #1 TO THE TOWN OF PROSPER
WAS UNKNOWN BY THE TOWN OF PROSPER AT THE TIME THE RESIDENCES WERE ERECT-
ED, ONLY THE PREVAILING TWENTY (20) FOOT SETBACK WAS REQUIRED.
THEREFORE,
THE CITY COUNCIL OF PROSPER, TEXAS, IN REGULAR SESSION ON THE 11th
OF APRIL, 1989 AFTER A PUBLIC HEARING AND NOTICE TO THE PRESENT
OWNERS OF THE PROPERTY INVOLVED; APPROVED A VARIANCE FROM THIRTY
(30) FOOT TO TWENTY (20) FOOT SETBACK FROM THE STREET EASEMENT TO
THE MAIL BUILDING LINE, EXCLUDING POACHES, FOR ALL DWELLINGS NOW
EXISTING ON LOTS 1A, 1B, 2B, 2A, 3A, 3B, 4B, 4C, 4A & 5 OF BLOCK
B IN THE VALLEY VIEW ADDITION TO THE TOWN OF PROSPER, TEXAS.
