AN ORDINANCE ACCEPTING AND APPROVING THE PRE-
LIMINARY PLAT OF THE HIGHLAND GLEN SUBDIVISION:
GRANTING CERTAIN VARIANCES FROM THE ORDINANCES OF
THE CITY OF PROSPER, TEXAS CONCERNING THE SUBDIVI-
SION OF LAND WITHIN THE EXTRATERRITORIAL JURISDIC-
TION OF THE CITY OF PROSPER, TEXAS ; AND ESTABLISH-
ING AN EFFECTIVE DATE
WHEREAS , the location of the proposed Highland Glen Sub-
division at the Western extremity of the City of Prosper ' s
extraterritorial jurisdiction is such that said subdivision
can more properly be considered a rural rather than an urban
development ; and
WHEREAS , at the present time and for the foreseeable fu-
ture the City of Prosper does not desire to provide utility
and other services to said subdivision such as water ,
_j sanitary sewer , street maintenance , etc . ; and
WHEREAS , it is the finding of Council that as a result
of the unusual shape , location or other physical condition of
the land , full compliance with the subdivision ordinance of
the City of Prosper would not substantially benefit the
health , safety and welfare of the citizens of Prosper and
would be unreasonably burdensome on the applicant :
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PROSPER, TEXAS :
Section 1 . The preliminary plat of Highland Glen Subdivision
is hereby approved with the following variances from the or-
dinances of the City of Prosper :
( a) That , as minimum performance standards , streets
shall be constructed to a width of twenty-two ( 22 ) feet
and with five ( 5 ) inches of compacted crushed rock, as-
11, phaltic prime coat and single course asphaltic surface
treatment ;
( b) That there be no requirement for sidewalks ;
( c) That water facilities be constructed using PVC
class 160 water pipe ;
( d) That drainage be constructed in conformance to the
subdivision regulations of Denton County;
( e) To the extent the subdivision regulations of Denton
County are inconsistent with the ordinances of the City
of Prosper , said subdivision shall be in strict compli -
ance with all such regulations as well as the
requirements of the City of Prosper with regard to final
approval , application fees and recording;
( f) That construction inspection fees charged by the
City of Prosper on the basis of cost of the project are
hereby waived, provided that all other charges set forth
in the Fee Schedule Ordinance are paid.

Section 2 . Upon the payment of the required fees and submis-
sion of the final plat , the Mayor and City Secretary shall be
authorized, and are hereby directed, to indicate the approval
of said subdivision on the final original thereof, and said
final plat may thereafter be offered for record.
Section 3 . This ordinance shall be effective immediately
upon its passage .
