86-13 O - Zoning Amendment on Northchase Estates (setback variance) ORDINANCE NO. 86-13
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE TOWN OF
PROSPER, TEXAS, BY THE GRANTING OF A VARIANCE ON THE AREA
SCHEDULE OF CERTAIN PROPERTY IN ACCORDANCE WITH THE PROVISIONS
OF THE OFFICIAL ZONING ORDINANCE OF THE TOWN OF PROSPER,
TEXAS AND DECLARING AN EMERGENCY.
WHEREAS, an application requesting a variance for certain real
property located within the corporate limits of the Town of
Prosper, Texas has been received by the City Secretary; and
WHEREAS, due notice of said application was given as required
by law and evidence was heard during special session of the
City Council of the Town of Prosper, Texas ; and
WHEREAS, the City Council has duly considered said application and
any comments made at said meeting,
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE TOWN
111 OF PROSPER, TEXAS:
SECTION 1 . The official zoning map of the Town of Prosper,
Texas shall be amended by recognizing the following described
property as having been granted a variance on the set-back
requirements as described within the official zoning ordinance
of the Town of Prosper, Texas :
Lot 7 Block A Northchase Estates
Lot 8 Block A Northchase Estates
SECTION 2. It shall be lawful to advance construction an additional
Ten (10) feet within the above-described property line bringing
the total front yard schedule on the above-described property to
twenty (20) feet.
SECTION 3 . The City Engineer is hereby directed to amend the
official zoning map of the Town of Prosper, Texas .
SECTION 4. The City Council, having determined that the immediate
effectiveness of the within ordinance is necessary to the public
health, safety or welfare of the citizens of the Town of Prosper,
Texas, this ordinance shall become effective immediately upon
its passage.
PASSED AND APPROVED THIS THE 1st DAY OF APRIL, 1986 BY THE
CITY COUNCIL OF THE TOWN OF PROSPER, TEXAS.
