ORDINANCE NO. 86-11
‘40, AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF PROSPER,
TEXAS, AND EXTENDING THE BOUNDRY LIMITS OF THE SAID
CITY TO INCLUDE SAID PROPERTY WITHIN SAID CITY LIMITS
AND GRANTING TO ALL THE INHABITANTS OF SAID TERRITORY
ALL THE RIGHTS AND PRIVILEDGES OF OTHER CITIZENS AND
BINDING SAID INHABITANTS BY ALL THE ACTS, ORDINANCES,
RESOLUTIONS AND REGULATIONS OF SAID CITY; PROVIDING
FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING
FOR FILING HEREOF WITH THE COUNTY CLERK OF THE COUNTY
OF COLLIN, TEXAS.
WHEREAS, a petition having been duly filed for annexing certain
unoccupied territory, hereinafter described, to the City of Prosper,
Texas, which application being in the form of a petition by the sole
owner duly and legally executed, and;
WHEREAS, the Council of the City of Prosper, Texas has investigated
same and determined that all the facts contained in said petition are
true and correct, and;
WHEREAS, the City council of the Town of Prosper, Texas has heard
such petition and all the arguments for and against the same and has
determined that it will be advantageous and beneficial to the City of
Prosper, Texas and its inhabitants, as well as to the hereinafter
described territory, to grant such petition and to annex such territory
to the City of Prosper, Texas :
NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE
TOWN OF PROSPER, TEXAS:
411. SECTION 1 . The territory described on the attached page
and any and all publis streets, roads and alleyways located
within or contigous to the same, be and the same, hereby annexed
into the City of Prosper, Texas :
SECTION 2. From and after the passage of this ordinance,
said territory shall be a part of the City of Prosper, Texas,
and the inhabitants thereof shall be entitled to all the rights,
priviledges and immunities of all the citizens of the City of
Prosper, Texas, and shall be bound by all of the ordinances,
resolutions and regulations enacted pursuant to and in conformity
with the general laws of the State of Texas.
SECTION 3 . Should any part of portion of this ordinance
4mw or of the use created herein affecting the attached property be
declared unconstitutional or invalid by a court of competent
jurisdiction, it is hereby expressly provided that any and all
remaining parts or portions of this ordinance shall remain in
full force and effect.
SECTION 4. A certified copy of this ordinance together
with a certified duplicate of the petition shall be filed in
the office of the County Clerk of Collin County, Texas, and
the City Secretary is hereby authorized and directed to do
so. This ordinance shall be effective immediately upon such
filing.

SITUATED in collin County, Texas, in the Collin County School
Land survey, Abstract No. 147, being a resurvey of the Forty
(40) Acre FIRST TRACT and the Forty (40) Acre SECOND TRACT
described in a deed from Elmo Chesney to Ernest Chesney,
dated January 6, 1977, recorded in Vol . 1034, Page 318, of
the Collin County Land Records, being more fully described
in metes and bounds as follows :
BEGINNING at an iron pin at the junction at the center of
an east-west County Road Five (5) , being a rock road, with
the center of the County Road No. Five (5) , being a rock
road, from the South, at the Northeast corner of said Forty
(40) Acre SECOND TRACT, in the North line of the said School
Land survey, Abstract No. 147 ;
THENCE Sputh 0 degrees 09 minutes 24 seconds East, 2650. 69
feet with the East line of said two (2) Forty (40) Acre tracts
and with the center line of said County Road No. Forty-Nine
(49) to an iron pin set at the Southeast corner of said Forty
(40) acre FIRST TRACT for a corner;
THENCE West, 1333. 88 feet with the South line of said Forty
(40) Acre FIRST TRACT to a 3/4 " by 26" galvanized bolt set
with head down at the Southwest corner of said Forty (40) Acre
FIRST TRACT FOR A CORNER.
THENCE North, 0 degrees 09 minutes 24 seconds West, 2650. 69
FEET WITH THE West line of said two (2) Forty (40) Acre tracts
to an iron pin set at the Northwest corner of said Forty (40)
Acre SECOND TRACT in the center of said County Road No. Five
(5) , in the North line of said School Land survey, Abstract
No. 147, for a corner;
THENCE East with the North line of said Forty (40) Acre
SECOND TRACT, the North line of said School Land survey,
Abstract No. 147, and the center of said County Road No.
Five (5) , 1333 . 88 feet to the PLACE OF BEGINNING and to
contain 81 . 168 acres of land.
