AN ORDINANCE PROVIDING FOR THE APPOINTMENT , TERM OF OFFICE
AND QUALIFICATIONS OF A CHIEF OF POLICE; CONFERRING UPON THE CHIEF
OF POLICE THE DUTIES OF MARSHAL; DISPENSING WITH THE OFFICE OF
MARSHAL ANC DECLARING AN EMERGENCY
WHEREAS , Article 977 , Vernon ' s Annotated Texas Statutes as
enacted and passed by the Regular Session of the 51st Texas
Legislature , 1949 , authorizes the City Council of Cities operating
under the general laws to provide for the filling of the office
of Chief of Police by Appointment , NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER, TEXAS:
SECTION 1 . That the office of Marshal of the City of Prosper
shall be dispensed with in accordance with Article 999a of Vernon' s
Annotated Texas Statutes upon the appointment of a Chief of Police
as hereinafter provided and the Marshal ' s duties shall be conferred
upon the Chief of Police as hereinafter set forth immediately upon
such appointment.
SECTION 2 . That hereafter the Office of Chief of Police
shall be filled by appointment of the City Council . The official
111 title of such police officer shall be "Chief of Police of the City
of Prosper , Texas" . He may also be known and referred to as the
"Police Chief" or as "Chief of the Police Department. "
SECTION 3 . The Chief of Police shall have the powers and
perform the duties as prescribed by the Laws of the State of
Texas , Article 998 of Vernon' s Annotated Texas Statutes , and by
the Ordinances of the City of Prosper, Texas.
SECTION 4 . Said Chief of Police shall be appointed for a
term of office running concurrently with that of the Mayor. He
shall receive such compensation as the City Council may fix by
Ordinance or Resolution, and shall furnish such surety bond as

may be required by the City Council , the premium to be paid by the
cCity. He snail take the Oath required by Law.

SECTION 5 . In the event of temporary absence or inability
to serve of such Chief of Police , the Mayor of the City of Prosper,
Texas may appoint a suitable and qualified person as Acting Chief
of Police to serve for such period of temporary absence or
inability to serve. Provided , that such Acting Chief of Police ,
if so appointed , shall duly take the Oath of Chief of Police of
the City of Prosper.
SECTION 6 . This Ordinance is Declared to be for the
General Welfare.
SECTION 7 . WHEREAS , an emergency is apparent for the N
immediate protection of the Public Welfare , there exists a
necessity that this Ordinance become effective at once so that
same shall become effective from and after the date of its passage
and approval ; accordingly , the effective date of this Ordinance
shall be , and this Ordinance is Now PASSED and APPROVED, on this
