85-05 O - Ordinance Amending the Official Zoning Map (Niswanger) -g ORDINANCE NO. .8 5 AmyAN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF PROSPER, TEXAS; AUTHORIZING THE USE OF CERTAIN PROPERTY IN ACCORDANCE WITH THE OFFICIAL ZONING MAP AS AMENDED AND DECLARING AN EMERGENCY WHEREAS, an application to change the zoning classification for cer- tain real property located within the limits of the City of Prosper, Texas has been received by the City Council ; and, WHEREAS , due notice of said application was given as required by law and a public hearing held on said notice; and, WHEREAS , City Council has duly considered said application and any comments made at said hearing , IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER, TEXAS: Allow Section 1. The official zoning map of the City of Prosper, Texas , shall be amended by changing the following described property from a classification of SF (single family) to a classification of LC ( Light-Commercial) : BEING a tract of land located in the City of Prosper , Texas, in Lot 30 , COLLIN COUNTY SCHOOL LAND SURVEY, A-12 , Collin County , Texas, said Lot 30 being conveyed to John W. Baker, on the 20th day of February , 1877 , and being more particularly described as follows: BEGINNING at an iron rod for corner, South 89 deg. 59 ' 47" East, 109 .65 feet from the Northeast corner of a 1 .0 acre tract con- veyed to Carson Gotcher of record in Vol. 637 , page 331 , Deed Records of Collin County, Texas; THENCE South 89 deg. 59 ' 47" East, with the South line of First Street , 106. 21 feet to an iron rod at fence post; 160 THENCE South 01 deg . 24 ' 44" West , with a fence line , 289 . 12 feet to an iron rod for corner; THENCE North 85 deg. 25 ' 09" West, 110 .32 feet to an iron rod for corner; THENCE North 02 deg. 13 ' 26" East, 280 . 44 feet to the PLACE OF BEGINNING, and containing 0 .707 acres of land, more or less , and being part of the property conveyed to Kathryn H. Craig by Deed dated April 16 , 1935 , recorded in Deed Records of Collin County, Texas. Section 2. illy It shall be lawful to use said property for any use permitted in the LC ( Light-Commercial) use classification as provided in the ordinances of of Prosper, Texas. Section 3 . The City Engineer is hereby directed to make appropriate modifications to the official zoning map of the city. Section 4 . City Council having determined that the immediate effectiveness of the within ordinance is necessary to the public health , safety, or wel- fare of the citizens of the City of Prosper, Texas, this ordinance shall Air become effective immediately upon publication by the City Secretary.
