cCITY OF PROSPER
AN ORDINANCE VACATING THAT PART OF HALL STREET NORTH OF THE NORTH
LINE OF FIFTH STREET AND THAT PART OF COLLEGE STREET NORTH OF THE
NORTH LINE OF FIFTH STREET AND CONFIRMING THE OWNERSHIP OF VACATED
PORTIONS OF CERTAIN STREETS IN THE ADJOINING LANDOWNERS
WHEREAS, the City Council of the City of Prosper, Texas , having
inquired into the matter has determined that the platted portions of
Hall Street and College Street north of Fifth Street have never been
opened or used as public right-of-way; and,
WHEREAS, City Council of the City of Prosper has determined that
it would be in the best interest of the City to vacate such right-of-way;
and,
WHEREAS, it would be in the best interests of the City to confirm
the ownership of the streets to be so vacated,
IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER,
TEXAS:
Section 1. All that portion of Hall Street lying north of and adjacent
to the north line of Fifth Street and all that portion of College Street
lying north of and adjacent to the north line of Fifth Street all within
the City of Prosper, Texas, be, and the same hereby are, vacated and
abandoned by the City of Prosper, Texas .
Section 2. Owners of the following described lots shall be , and they
hereby are,vested with title to the half of the said vacated streets
adjoining their respective lots , to-wit:
Lot 4 , Block 1 , Lot 1 , Block 2 , Lot 4 , Block 2 ,
and Lot 1 , Block 3 , of the Hillside Addition to
the City of Prosper, Texas, as the same is recorded
in Volume 2, Page 62, map records of Collin County, Texas.
Section 3 . This ordinance shall serve to relinquish the claim of the
City of Prosper, Texas upon the use of said property as City right-of-way
and for such other public uses as may be appropriate and shall not consti-
tute any warranty of title to the said premises.
Section 4 . This ordinance shall be effective immediately upon the record-
ing of a certified copy hereof for the records of Collin County, Texas.
