84-09 O - Creation of a Municipal Court and Judge ORDINANCE NO. a — 41r AN ORDINANCE CREATING A MUNICIPAL COURT IN THE CITY OF PROSPER, COLLIN COUNTY, TEXAS; PROVIDING FOR THE JURISDICTION OF SAID COURT; PROVIDING FOR THE APPOINTMENT OF A JUDGE AND FOR THE TERM OF OFFICE; PROVIDING FOR A CLERK AND FOR THE TERM OF OFFICE; PROVIDING FOR THE COMPENSATION TO BE PAID SAID JUDGE; AND DECLARING AN EMERGENCY AND EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER: SECTION 1 : There is hereby created in the City of Prosper, Collin County, Texas, a Municipal Court, which shall have jurisdiction within the territorial limits of said city in all criminal cases arising under the ordinances of said city and shall also have concurrent jurisdiction with any justice of the peace in the precinct in which said town is situated in all criminal cases arising under the criminal laws of this 41, state, in which punishment is by fine only, and where the maximum of which fine may not exceed $200. 00 and arising within such territorial limits of the City of Prosper. SECTION 2: The City Secretary of the City of Prosper shall be exofficio clerk of the Municipal Court and shall hold said office during his or her tenure as City Secretary. The clerk shall keep minutes of the proceedings of said court, issue all process , and generally perform all of the duties of the clerk of a court as prescribed by law for a county clerk in so far as the same may be applicable. SECTION 3: The judge of the Municipal Court shall be such qualified S judge or Justice of the Peace appointed by the duly elected Mayor of the City of Prosper, Texas, subject to confirmation by the City Council; such Judge shall be appointed to a term of 2_ years, and may be removed by the Mayor, subject to approval by City Council ; such Judge shall receive such compensation as shall be determined by City Council . SECTION 4: The fact that at present , there is no Municipal Court in the City of Prosper, and such deficiency creates a grave public need and public necessity and creates an emergency, this ordinance to take effect immediately upon its passage.
