CITY OF PROSPER, TEXAS ORDINANCE NO. 83-3
AN ORDINANCE FIXING THE RATE SCHEDULE FOR WATER CONSUMED
WITHIN AND OUTSIDE THE CITY LIMITS OF THE CITY OF PROSPER,
TEXAS; PROVIDING FOR DUE DATES OF SAID CHARGES; PROVIDING
FOR PENALTY; PROVIDING FOR CALCULATION OF CHARGES AND
PENALTIES; PROVIDING FOR DISCONTINUANCE OF WATER SERVICE FOR
NONPAAYMENT OF CHARGES AND PENALTIES WHEN DUE; PROHIBITING
WATER CONNECTION TO CITY LINES BY THOSE WHO MAY HAVE BEEN
DISCONNECTED PRIOR TO PAYMENT OF CHARGES AND PENALTIES IN
ARREARS; PROVIDING RECORDS OF THE CITY OF PROSPER SHALL BE
CONCLUSIVE EVIDENCE OF SUCH CHARGES AND PENALTIES DUE;
PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR AN EFFECTIVE
DATE AND PROVIDING FOR THE PUBLICATION OF THE CAPTION
HEREOF.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PROSPER, TEXAS:
SECTION 1 : From and after the first utility billing in
June, 1983, the water rates for each thirty (30) day period
charged by the City of Prosper for water consumed within the
limits of the said City shall be as follows:
For the first two thousand (2, 000) gallons or any portion
thereof : Five Dollars and Fifty Cents ($5. 50) .
Thereafter the charge for one thousand ( 1 , 000) gallons from
two thousand one (2, 001) gallons thru ten thousand ( 10, 000>
gallons shall be Two Dollars and Twenty Five Cents ($2. 25) .
Thereafter the charge for one thousand ( 1 , 000) gallons from
ten thousand one (10, 001 ) gallons thru twenty thousand
(20,000) gallons shall be Two Dollars
Thereafter the charge for one thousand (1, 000) gallons from
twenty thousand one (20,001 ) gallons to unlimited gallons
shall be One Dollar and Seventy Five Cents ($1 . 75) .
~~ Said charges for one thousand (1 , 000) gallons shall be
prorated per proportionate to the consumption less than a
unit of one thousand ( 1 ,000) gallons.
SECTION 2: The water rates to be charged for all water
consumed outside the City limits shall be 2.0 times the rate
charge for water consumption within the City limits, unless the
City Council shall specify otherwise.
SECTION 3: From and after June 1 , 1983, the following shall
be in effect:
(a) Deposit to insure payment of service charges upon
application for any utility service or services provided by
the City to residential , commercial or industrial property,
a deposit shall be placed with the City, payable to the City
of Prosper, Texas, by applicant. The total deposit for
either water or sewer service, or both water and sewer
service shall be Sixty Dollars ($60. 00) .

The terms of the deposit shall be that any service rendered
by the City and not paid for by the Depositor shall he
charged against the utility deposit and the City shall be
authorized to withdraw from the deposit the amount so
charged. When the Depositor requests the termination of
utility service, the balance of the deposit, if any, after
all City charges have been withdrawn, shall be returned to
the Depositor.
(b) Service Charge - There shall be a charge of Ten Dollars
($10.00) for the connection of service, either new service
or a transfer to a new service when such connection is made
during normal City working hours. The fee for such
connection requested after normal City working hours,
weekends, and/or holidays, shall be Twenty Dollars ($20. 00) „
(c ) Reconnection Fee - Reconnection is defined as a utility
customer connection which is being made subsequent to
termination or disconnection of service due to customer
failure to pay for utility service rendered. The fee for a
reconnection connection shall be: ( 1 ) During normal. City
working hours shall be Fifteen Dollars ($15. 00) , (2) Af te.r-
normal City working hours, weekends, and/or- holidays shall
be Twenty Five ($25. 00) .
(d) Reread Adjustment - There shall be a charge of Five
Dollars ($5. 00) for all rereads of the water meter if no
reader error is discovered. No reread charge shall be
assessed if a reader error is discovered.
(e) Other Charges - There shall be a charge for other
services which shall be:
(1 ) Temporary disconnect and reconnect shall be Ten
Dollars ($10.00) .
(2) Removal or lockup of meter for nonpayment of
charges shall be Twenty Dollars ($20. 00) .
(3) A charge for customer requested meter check if
meter is found to be accurate shall be Seven Dollars
and Fifty Cents ($7. 50) .
(4) A charge for return checks shall be Fifteen
Dollars ($15. 00) .
SECTION 4: All water charges shall be payable monthly at
the City Hall in the City of Prosper, Texas, on or before the
tenth ( 10th) day of the month.
SECTION 5: All water charges, herein provided for, which
shall remain unpaid after the tenth ( 10th) of the month shall
bear a penalty of ten percent ( 10%) , which penalty shall be added
to the amount of any such past due charges.

SECTION 6: It shall be the duty of the Mayor of the City of
Prosper or a person designated by him to calculate all charges
and penalties herein provided for and to collect the same and to
receipt thereof on behalf of such City.
SECTION 7: In the event that any water consumer to be
charged as herein provided for, shall permit any such charges or
penalties to remain unpaid subsequent to the 20th day of the
month, such failure to pay the charges and penalties incurred
shall be conclusive evidence on the part of such consumer not to
pay such charges and penalties and such water service shall be
discontinued, and any agent or servant or employee of the City of
Prosper, Texas, is hereby authorized to discontinue and cut off
such water service, and the books and the records of the City of
Prosper, Texas, shall be conclusive evidence of such charges and
penalties due.
SECTION 8: Any person, firm or corporation to whom water
servi ce may have been discontinued under the terms of this
Ordinance shall not be entitled to, or have water service or
connection with the water mains of this City until all such
charges and penalties in arrears, charged against such water
consumer, shall have been paid in full .
SECTION 9: Any and all ordinances and resolution of the
City of Prosper, Texas, heretofore adopted which are in conflict
with this Ordinance are hereby expressly repealed insofar as the
same are in conflict therewith.
SECTION 10: If any section, subsection, paragraph,
sentence, phrase, or clause of this Ordinance shall be declared
invalid for any reason whatsoever, such decision shall not affect
the remaining portions of this Ordinance which shall remain in
full force and effect; and to this end the provisions of this
Ordinance are hereby declared to be severable.
SECTION 11 : The caption of this Ordinance to be published
one ( 1 ) time in a newspaper having general circulation in the
City of Prosper, Texas, and shall be effective with the first
water billing in the month of June 1983.

AN ORDINANCE AMENDING ORDINANCE NO. 83-3 FIXING THE RATE SCHEDULE FOR
WATER CONSUMED BY CUSTOMERS ON THE WATER SYSTEM OF OF THE CITY OF
PROSPER, TEXAS AND PROVIDING FOR PUBLICATION HEREOF AND FOR AN
EFFECTIVE DATE
WHEREAS, Ordinance No . 83-3 of the City of Prosper , Texas , having
been duly adopted , provides for a rate schedule for water consumed
by customers of the water system of the City of Prosper ; and ,
WHEREAS , the City Council has determined that rates thereby estab-
lished are now inadequate ;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PROSPER, TEXAS:
460 Section 1 . From and after the first utility billing following the
effective date of this ordinance , the water rates for each thirty ( 30)
day period charged by the City of Prosper for water shall be as
follows :
For the first 2 ,000 gallons or any portion thereof : $5 . 75 .
Thereafter , the charge for each 1 ,000 gallons from 2 ,001 to
10 , 000 gallons shall be : $2 . 50 .
Thereafter , the charge for each 1 , 000 gallons from 10 , 001 gallons
to 20 ,000 .00 gallons shall be: $2 . 35.
Thereafter , the charge for each 1 ,000 gallons from 20 , 001 gallons
to unlimited gallosn shall be: $2 . 25 .
The following charges for each 1 ,000 gallons in excess of the first
2,000 shall be applicable to each full 1 ,000 gallon measure or any part
thereof .
Section 2 . Section 1 and 2 of Ordinance 83-3 are hereby repealed and
the foregoing section substituted therefor in all respects .
Section 3 . The caption of this ordinance shall be published one ( 1)
time in a newspaper with general circulation in the City of Prosper ,
Texas , and shall be effective with the first billing for water occurring
subsequent to such publication .
