83-01 O - Street Specifications Pertaining to Subdivisions ORDINANCE NO. 83-/ AN ORDINANCE OF THE CITY OF PROSPER , COLLIN COUNTY , TEXAS , PROVIDING FOR THE GENERAL SPECIFICATIONS PERTAINING TO SUB- DIVISIONS WITHIN THE CITY ; PROVIDING FOR THE STREET ARRANGEMENT AND STREET DESIGN IN SUBDIVISIONS WITHIN THE CITY ; PROVIDING FOR BUILDING LINES , DRAINAGE EASEMENTS , AND THE GEOGRAPHICAL SHAPE OF LOTS; PROVIDING SPECIFICATIONS FOR STREETS WITHIN A SUBDIVISION WITHIN THE CITY ; PROVIDING THAT SUCH STREETS BE MAINTAINED BY THE OWNER FOR ONE ( 1 ) YEAR AFTER THE APPROVAL AND ACCEPTANCE OF A STREET BY THE CITY ; PROVIDING FOR THE FILING OF CERTAIN BONDS BY THE OWNER OF A STREET WITHIN A SUBDIVISION OF THE CITY ; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF 10K ORDINANCES IN CONFLICT HEREWITH; AND , PROVIDING FOR PUBLICATION AND THE EFFECTIVE DATE OF THIS ORDINANCE . WHEREAS, it is deemed in the public welfare by the City Council of the City of Prosper , Texas , to have specifications pertaining to subdivisions within the City of Prosper, Texas ; NOW THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PROSPER , TEXAS: SECTION 1 . Section 1 of this ordinance is attached hereto and described as "EXHIBIT A" and consists of eleven ( 11) pages and is made a part hereof the same as if copied and set forth 04100 at length . SECTION 2 . That if any part of this ordinance is , or should be held invalid for any reason, then that fact shall not invalidate the entire ordinance , but the balance thereof shall remain in full force and effect . SECTION 3 . All other ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of such conflict . SECTION 4 . That this ordinance shall be published in accordance with Tex . Rev . Civ . Stat . Ann . SECTION I -- GENERAL SPECIFICATIONS 2. General Specifications pertaining to subdivisions • 3. within Prosper, Texas, having been considered by the City 4. Council shall be as follows: 5. A. Street Arrangement: Unless otherwise approved by imr 6. the City Council, provisions must be made for the 7. extension of existing dead-end streets within 8. recorded adjacent subdivisions. 9. Proposed streets must conform to existing 10. topography as nearly as possible, in order that 11. drainage may be provided. Streets should, 12. wherever possible, follow valleys or depressions 13. so as to form a collection system for surface 14. water. 15. A11 streets must be names and marked by th 1111, 16. developer with permanent metal signs with letters 17. at least four (4) inches high, and the developer 18. shall make sure that there is no conflict with 4 19. the name of another public road or street within 20. the unincorporated part of the County or nearest 21. city. 22. B. Street Design: The minimum width of a street 23. right-of-way within the subdivision shall be 24. sixty (60) feet, unless already platted, the minimum 25. 'radient shall be four-tenths (0.4) percent and the 26. maximum gradient shall be ten (10) percent. 27. Where a County Road abuts the subdivision, 28. the Owner shall set back the subdivision line 29. thirty (30) feet from the centerline of the EXHIBIT A PAGE 1 1. ' existing County road. 2. A list of names roads and streets in the 3. areas of the Town of Prosper will be kept 4. in the office of the City Secretary. mow 5. C. Cul-de-sacs: Cul-de-sacs may be permitted where 6. the form or contour of the land makes it 7. difficult to plat with connecting streets. Such 8. cul-de-sacs shall provide proper access to all 9. lots, and a turn-around shall be provided at the 10. closed end, with an outside street line radius of 11. at least fifty (50) feet. 12. D. Lots: All lots, so far as practicable, shall 13. have the side lines at right angles to the street 14. on which the lot faces, or radial to curved 15. streets lines. All lot corners, angle points, Amp 16. point of curve, etc. shall be marked with steel 17. rods of at least 18" in length or concrete 18. 4 markers. 19. E. Building Lines: Building set-back lines shall be 20. shown on all lots intended for residential use, 21. and shall provide for a minimum set-back of at 22. least thirty (30) feet. A building set-back 23. line from the flood plain boundary of the 100 24. year frequency flood shall be shown, or state that 25. the floor level will be one (1) foot. Each lot 111 26. shall have a useable building lot of a minimum of 27. 75 ft. by 75 ft. (7875 sq. feet in all) . 28. F. Drainage Easements: Provisions shall be made for 29. drainage easements to allow for proper control of 30. drainage, and for future maintenance within the EXHIBIT A PAGE 2 1. easement area. A drainage map showing the 2. drainage area for each culvert or bridge shall 3. accompany the plat submitted. Calculations low 4. showing quantity of water to be carried at each 5. culvert or bridge shall be shown. 6. G. This specification has been prepared as a guide 7. to the contractors, developers, and City 8. Engineer to provide a long lasting road, an 9. adequate drainage system and to protect the 10. public from septic tank sewage disposal systems 11. that do not function properly. It is understood 12. that although not all details of construction are 13. included, developers are expected to provide a imp 14. high quality road and drainage system in the 15. subdivision herein regulated. 16. Construction: Prior to beginning any 17. .. construction within the subdivision, the Owner 18. shall contact the Registered Professional 19. Engineer appointed by the City Council. 20. The Engineer shall go over the construction plans 21. of the Owner. All streets shown on the Plat must 22. be paved and must meet the following 23. specifications: 24. 1. Asphalt streets with lime stablized 25. subgrade and base. 26. a. The area on which roads are to be 27. constructed shall be cleared and 28. grubbed free of visible organic matter 29. such as, roots, stumps, or grass. EXHIBIT A PAGE 3 '1 b. The road bed is to be graded to an 2. approved level with V-type borrow 3. ditches on each side where applicable. 4. c. Subgrade levels requiring more than 8 S. inches of fill shall be rolled with a 011 6. sheep foot roller before making the • 7. fill. The rolling shall be done on 8. soil having optimum moisture content 9. and shall be rolled until the soil is 10. compacted to 95% procter density to a 11. thickness of 6 inches. The sub-base shall be browned to a 23. width of twenty-six (26') feet and 24. stabilized with lime to a depth of 25. eight inches (8") over a width of 26. twenty-two (22') feet and shall be 111 27. rolled and shaped to provide a hard 28. subgrade over the entire (22') width. 29. Road beds constructed over seep areas: EXHIBIT A PAGE 4 1. (1) Seep areas are to be marked by 2. visual inspection by the 3. contractor and the City 4. Engineer. 5. (2) Seep areas shall be drained to a Nor 6. depth of at least two (2') feet 7. • below subgrade elevation by use of 8. permanent subsurface drainage. 9. (3) After seep areas are drained, the 10. subgrade is to be compacted as 11. described hereinabove. 12. e. The base shall be of a good quality 13. crushed rock or road gravel stabilized 14. with lime to a depth of eight (8") 15. inches in thickness and eighteen (18') 16. feet in width centered on the 22' 17. compacted subgrade surface. The base 18. shall be shaped to provide an eighteen J 19. (18') foot wide pavement and shall 20. slope gradually on each side beyond the 21. 18' width to support fully the entire 22. width of the pavement base and then shall 23. be allowed to set up. 24. f. The asphalt wearing surface shall be 25. either hot mix asphalt or two course 16' 26. penetration asphalt surface treatment. 27. (1) Hot Mix Asphalt 28. (a) The prime coat or tack coat 29. shall be placed during proper EXHIBIT A PAGE 5 weather conditions and shall 2. be allowed to properly cure ' 3. (one day) . 4. Hot mix asphalt shall 5. then be applied during proper 1110 6. weather conditions to a 7. compacted depth of two (2") 8. inches. The asphalt shall be 9. rolled to a proper density. 10. Treatment. 17. (a) A prime coat of asphalt shall 18. be applied to the base and 19. allowed to set for an 20. adequate period of time (one 21. day ordinarily) . Two course 22. penetration asphalt surface 23. treatment shall then be 24. applied by use of clean, 25. tough and durable aggregate go 26. of one-half inch (1/2") 27. maximum size for the first 28. course followed by the second 29. course of three-eights EXHIBIT A PAGE 6 1. ' (3/8") inch maximum sized • 2. aggregate. Aggregates to be. 3. applied in quanities 4. necessary to thoroughly and • 5. properly cover asphalt. 6. (b) Rolling: After aggregates 7. have been applied to the 8. second course, a pneumatic 9. roller is to be used on the 10. entire surface until the 11. aggregates are worked into 12. the asphalt properly to the 13. satisfaction of the 14. Engineer. • 15. 2. Asphalt Streets without lime in subgrade or 16. base. 17. Proceed with specifications l.a. , 1.b. , and 18. 1.c. ,4 hereinabove. 19. d. The sub-base shall be crowned to a 20. width of twenty-two (22') feet and the 21. last layer shall be rolled with a sheep 22. foot roller to create a compacted 23. subgrade of a least 95% procter 24. density; also a test of compaction can 25. be made by use of a heavily loaded dump 26. truck driving over the compacted 27. subgrade without making ruts or surface 28. sinking. A further test is by watching 29. the sheep foot roller feet walk out on EXHIBIT A PAGE 7 1. •, top of the surface. 2. 3. The land owner or developer will be required 3. to install culverts under streets at all 4. entrances and at drainage courses as 5. specified by the City Engineer in 6. accordance with Texas State Highway 7. .Specifications. 8. 4. All utilities to be in place and stubbed out 9. from under the street paving to the street 10. right-of-way line so as not to disturb the 11. road surface in the process of extending and 12. connecting services to each property. 13. 5. The land owner or developer will be required 14. to contact the Engineer for an on-site 15. inspection prior to the commencement of any 16. work in the development or addition, in 17. order that the City Council may 18. approve the same or make specific J 19. recommendations as to any drainage 20. structures that may be required for the 21. addition. 22. A drainage plan showing drainage areas, 23. culvert sizes, slopes and types with 24. accompanying drainage calculations which 25. show the quantity of water to be carried by 26. each culvert. 27. The drainage plan is to show where 28. water is to flow through the subdivision and 29. away from said subdivision. EXHIBIT A PAGE 8 1. The recorded plat shall show drainage 2. easements of necessary width to accomodate 3. water flowing in same. 4. H. In order to insure that the streets and alleys in 5. accepted and approved subdivisions are 6. constructed in accordance with the above 7. specifications, and to guarantee that they are 8. maintained to the satisfaction of the City 9. Council in a good state of repair 10. for the period of one (1) year after the approval 11. and acceptance of each street, or portion 12. thereof, shown on said subdivision plat, the 13. Owner shall file a Construction Bond, and a • 14. Maintenance Bond, each executed by some Surety 15. Company authorized to do business in this State, +`„ 16. payable to the City of Prosper, Texas 17. in the amounts to be fixed in the amount 18. of the estimated cost of 19. 4 construction. 20. The condition of said Construction Bond 21. shall be that the Owner of said approved and 22. accepted subdivision shall begin construction of 23. such streets and alleys as are shown on the 24. subdivision plat within a period of ninety (90) 25. days from the date of the letter of intent for 26. approval of the plat of said subdivision by the 27. City Council, Prosper, Texas, and 28. prosecute and complete such construction in 29. accordance with the specifications herein EXHIBIT A PAGE 9 1. provided within a reasonable number of working 2. days to be determined and agreed upon by the 3. Owner and the City Council, and 4. said Construction Bond shall remain in full force Nor 5. and effect until all of the streets and alleys in 6. said approved and accepted subdivision have been 7. completed to the satisfaction of the 8. City Council. 9. In the event any or all of the streets and 10. alleys as constructed by the Owner fail to meet 11. • the requirements of the specifications herein 12. provided and are not accepted and approved by the 13. City Council and said Owner fails or 14. refuses to correct the defects called to his 15. attention in writing by said City tow 16. Council, the unfinished improvements 17. shall be completed at the cost and expense of 18. 4 obligees as in said orders provided. In lieu of 19. the Maintenance Bond the Owner may post with the 20. City Council a cash bond in the amount of ten 21. (100) percent of the costs of construction. 22. I. The condition of said Maintenance Bond shall be 23. that the Owner shall guarantee to maintain, to 24. the satisfaction of the City Council, 25. all of the streets and alleys shown on an 26. accepted and approved subdivision plat, in a good 27. state of repair for the period of one year from 28. the date of such acceptance and approval. 29. The Maintenance Bond by its terms shall EXHIBIT A PAGE 10 1. ' provide that liability thereunder shall begin on - 2. any or all of the streets and alleys shown on an 3. accepted and approved Subdivision Plat and remain 4. in full force and effect for the period of one 5. year thereafter from the date of the acceptance 6. of the construction of each street or portion 7. thereof, by the City Council in 8. writing. 9. Periodical inspection of all of the streets 10. and alleys that have been approved and accepted 11. • in an accepted and approved subdivision will be 12. made by the Engineer during the period of 13. liability covered by the Maintenance Bond and in 14. the event any or all of said streets and alleys Cr 15. are not being maintained in a good state of 16. repair, the Owner will be so advised in writing 17. and if after a reasonable time he fails or 18. refuses to properly maintain said streets and 19. alleys, they shall then be maintained at the cost 20. and expense of obligees as in said orders 21. provided. 22. J. Maintenance: One year after acceptance of the 23. streets the City Council will assume the 24. maintenance responsibility of the streets within sit 25. the subdivision, after said streets have been 26. constructed in accordance with the specifications 27. set forth herein; at such time any bond proceeds 28. remaining shall be returned to the developer. 29.
