73-110 O - Appointment of Marshall . J T)(16, CITY OF PROSPER, TEXAS ORDINANCE NO. //O AN ORDINANCE DECLARING A NECESSITY FOR THE OFFICE OF MARSHALL FOR THE CITY OF PROSPER, TEXAS , ESTABLISHING SUCH OFFICE; PROVIDING FOR TEMPORARY APPOINTMENT OF MARSHALL; PROVIDING REASONABLE AND NECESSARY POWERS ; PROVIDING FOR OATH AND BOND; PROVIDING FOR A DEPUTY POLICEMAN ; PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS , the Council of the City of Prosper, Texas, has investigated into and has determined that there exists 1111, a need for the establishment for the Office of Marshall in order to insure the full and adequate protection for the Citizens of Prosper, Texas, and WHEREAS , the Office of Marshall is an elective office which said office shall be filled at the time of the general municipal election, but that such election date is now passed without such office having been filled , and WHEREAS , in such event the Council has been given, by state law, the power and authority to appoint a Marshall. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE 7)410 CITY OF PROSPER, TEXAS SECTION 1 : The Office of Marshall is hereby established and created . SECTION 2 : ( /1//,t/fd�/,)Nvi is hereby appointed Temporary Marshall for a probationary period not to exceed one (1) year. 0- L./wly SECTION 3: The Marshall shall be the ex-officio Chief of Police of the Police Department , and shall have the same powers to discharge all duties that may be described by the Ordinances of the City of Prosper, Texas, including but not limited to , the power to quell riots , disorders, and disturbance of the peace within the city limits , and he shall take into custody all persons so offending against the peace of the city. SECTION 4 : The Marshall shall take and subscribe the official oath of office in accordance with Article 16, Section 1 of the Constitution of Texas . The Council may require such additional oath as it may deem best calculate to secure faithful performance of the Marshall 's duties. SECTION 5: The Marshall shall give a good and sufficient bond not less that $ , in order to further secure the faithful performance of his duties . SECTION 6: In order to assist the Marshall in the orderly execution of his duties, the Council may from time to time appoint a Deputy Policeman and such other Deputy Policeman as the Council may authorize . SECTION 7 : As compensation for the duties of the Marshall or any Deputy Policeman appointed by the Council he and they shall receive a salary to be set by the Council.
