62-02 O - Extension of Water and Sewer Mains AMo 11/8/62 j • 4. 416 ;/:/t/e )1411 ORDINANCE NO. 411 AN ORDINANCE PROVIDING FOR AN ALTERNATE METHOD FOR THE EXTENSION OF WATER AND DEr1ER MAINS, PROVIDING FOR THE RECOVERING OF THE COST THERE- OF, DECLARING AN EMERGENCY AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE BE IT ORDAINED BY THE TOWN COUNCIL OF THE '.[OWN OF PROSPER, TEXAS. SECTION I. At the option of the Town of Prosper, the following method for ex- tending water and/or sewer mains may be used. The Applicant for such an extension shall make written application to the Commission setting forth the course of such extension and the type of services desired. Should the Commission feel that the extension of such water and/or sew- er mains is to the best interest of the citizens of the Town of Prosper, the Commission may authorize that such extensions be made, provided, however, that adequate safe guards shall be insured to guarantee that such extensions shall be constructed so as to meet the standards and specifications of the Town of Prosper, and such mains shall become the property of the Town of Prosper when the same are completed; provided, also, that no such water or sewer extension shall be constructed ex- cept in a dedicated street or alley or on an easement held by the Town 4 of Prosper. SECTION II. 4 In order to defray a portion of the cost of such extension, the City shall charge and collect from each party who taps such main a fee of 150.00 and remit the same to the party who paid the cost of the extension. A tap shall be considered to be a service line con- nected onto such main or connected onto a lateral line which is served by such main. The aforesaid fee shall be collected by the Town of Prosper at such time as the tap is made and is connected on- to a dwelling, or structure so that such utilities are to be used. .00 Provided, however, that there shall be a maximum period of fifteen (15) years from the date that such extension is completed and accepted by the Town of Prosper, during which such fee shall be collected and remitted to the party constructing such extension. Nothing contained herein shall be construed to give any vested interest to any party to such mains and the same shall always be un- der the completed control and authority of the Town of Prosper. SECTION III. The purpose of this Ordinance is to provide for an alternate method for the extension of water and/or sewer mains and shall not be considered as the exclusive method for such extension. i SECTION IV. The fact that the Town of Prosper does not now have an Ordinance providing for a method of extending water and/or sewer mains creates an emergency and an imperative public necessity; therefore, this Ordi- nance shall take effect immediately upon its passage and approval.
