55-05 O - Establishing Telephone Service Base Rate • are (P _ ' le AN ORDINANCE ESTABLISHING A BASE RATE AREA FOR TELEPHONE SERVICE IN THE CITY OF PROSPER WHEREAS, the Southwestern Bell Telephone Company has requested the approval of a base rate area for telephone service in the City of Prosper, and WHEREAS, the City Commission recognizes that a local exchange rate structure whereby urban customers in areas which are well developed pay a flat rate for local telephone service and customers in relatively undeveloped areas pay in addition thereto reasonable mileage charges, will more equitably spread the burden of producing for the company a fair return on the fair value of its property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM- MISSION OF THE CITY OF PROSPER: Section 1: That approval is hereby granted to the establishment of the Base Rate Area shown on the map attached hereto and made a part hereof, in which Base Rate Area local exchange telephone service shall be furnished by the Southwestern Bell Telephone Company at base rates authorized by the City of Prosper. Section 2: That for local exchange telephone service to urban customers located outside the aforesaid Base Rate Area, the charges to such customers shall be the base rate authorized by the City plus such additional standard excess mileage charges as are set forth in the Telephone Company's General Tariffs. Section 3: That the Base Rate Area of the exchange may be extended by the Telephone Company whenever density of development may justify such extension. A revised map showing the Base Rate Area, including all extensions, shall be maintained on file in the business office of the Telephone Company. Section 4: That the establishment of the aforesaid Base Rate Area shall become effective on the first billing date after final passage of this ordinance. - 2 - Section 5: That nothing in this ordinance contained shall be construed as in any manner, now or hereafter, limiting or modifying the right and power of the City under the law to regulate the rates charged for local exchange telephone service by the Southwestern Bell Telephone Company for its services within the City of Prosper, Texas. Not applicable to service to any residence, dormitory, school, lodge, gymnasium, meeting hall, or any other indoor ar outdoor facility which is not used by the public exclusively for group religious worship services. The terms of the Agreement for Service and the Schedule are modified only as shown herein. DETERMINATION OF DEMAND 66.6$ of the measured kw used in determining the billing demand, but not less than the minimum demand specified in the Schedule to which this rider applies. Clary, Mayor, and City Council City of Prosper Prosper, Texas Gentlemen: Included herein are certain proposed modifications in our schedule of rates, and attached hereto are two riders affecting certain existing and new classes of business and a revised Municipal and Public School Service Schedule, which it is proposed to make effective for bills rendered on or after May 16, 1957, subject to your approval. RESIDENTIAL SERVICE The paragraph now contained in our residential service schedule which reads: "For each Kw in excess of 9, add 75 Kwh to the 4.70 block" is deleted and the following provision substituted: "For three phase service there will be added 0..50 for the first 3 Hp or less and 50¢ for each additiona Hp of rated capacity of 3 phase motors connected, or, at their option, for customers being supplied three phase service as of the date of approval of this modification 75 Kwh will be added to the 4.70 block for each Kw in excess of 9." The rate of 1.50 per Kwh for service to approved water heaters will be reduced to 1.10. PRIMARY SERVICE TO INDUSTRIAL CUSTOMERS The paragraph now contained in Schedule LP-200, "Primary Service Credit," is changed to read as follows: be modern . . . go Stee ! *'" Page #2 "If Customer takes service at 12,500 volts or directly from an established transmission line substation of Company at 4,160 volts or higher and furnishes and maintains transformers and protective devices, a credit from the demand charge will be allowed as follows: 200 per Kw first 200 Kw of demand 120 per Kw next 800 Kw of demand 6¢ per Kw in excess of 1000 Kw of demand." SPECIAL CHURCH RATE The attached Rider RH provides for a discount of 33-1/3% of the measured demand applicable to billing for service supplied to churches. STREET LIGHTING The revised Municipal and Public School Service Schedule MSL-1, likewise attached, supersedes the MSL-1 schedule now in effect and differs only to the extent of providing a method of charging for the installation of special street lighting facilities and for unmetered service. NET MONTHLY RATE 35i per kwh for the first 2,000 kwh 2� per kwh for the next 3,000 kwh 1.5sf per kwh for the next 20,000 kwh 1.259' per kwh for all additional kwh For billing purposes hereunder, the energy supplied the Municipality shall be added to the energy supplied the Schools, and one oaloulation made of the total amount thus obtained in accordance with the foregoing rate schedule. The total billing amount so determined shall be divided between the Municipality and the School System as a whole in proportion to the number of kilowatt-hours supplied each during the month, and Company shall render a separate bill to each for its proportion- ate part of the total. When, in the opinion of Company, the installation of meters for measuring the energy used under this rate for street lighting purposes is impractical or undesirable, the amount of monthly energy used shall be determined as provided on the reverse side hereof. SPECIAL FACILITIES CHARGE APPLICABLE TO FACILITIES INSTALLED SUBSEQUENT TO MAY 16, 1957 For installations requiring the use of metal pole mounting: 509 per month per pole, and For installations requiring underground cable service: 509' per month per 100 feet where not installed under pavement. Where underground service is required under street or sidewalk pavement, customer will furnish and install conduit under such pavement, in which event the footage of cable installed in such conduit shall be disregarded. Minimum: 1) t!unioipal Service - $4.00 per kilowatt of the aggregate input ratings of all lamp assem- blies installed in the street lighting system, but in any event not less than $15.00 per month; plus $1.00 for each meter installed hereunder for other than street lighting service. 2) Public School Service - $1.00 for each separate meter installation. Minus or plus 0.04 mill per kwh of energy taken for eaoh full one-fourth cent by which the average cost per million British thermal units of all fuel delivered at the points of firing at Company's thermal plants was below or above five cents, respectively, during the three months' period ending one month previous to the month under consideration. Minus or plus one-half of one per Dent of the amount computed at the above stated rate for each whole point in the "All Commodities" index below 100 or above 175, respectively. For this pur- pose there shall be employed the average of the twelve most recently published monthly values for the "All Commodities" index taken from "Wholesale Prices" compiled by the United States Department of Labor (adjusted to a 1926 base if any other date should be employed for the base by the United States Department of Labor). A new determination of such twelve-month average shall be made at the beginning of eaoh calendar quarter, and the figure so found shall apply for billing for the whole of such quarter. Failure at any time and from time to time to apply this provision in the event of variation in such "All Commodities" index shall not constitute waiver of rights to apply subsequently such provision above said index of 175. Plus the proportionate part of any new tax, or increased rate of tax, or governmental imposition or charge (except state, county, city, and special district ad valorem taxes and any taxes on net income) levied or assessed against the Company or upon its electric business, or imposed upon the Company under its fuel purchase contracts, as the result of any new or amended laws or ordinances after January 1, 1951. PAYMENT Bills are due when rendered, and become past due if not paid within ten days thereafter. Serv- ioe to oustomers having past due bills may be discontinued as provided in Company's Service Regula- tions.
