ORDINANCE PRESCRIBING RATES FOR CITY'S
WATERWORKS AND SANITARY SEWER SYSTEM

ON THIS, the 7th day of January, 1955, the City
Commission of the City of Prosper, Texas, convened in special
session at the regular meeting place thereof in the City Hall,
there being present and in attendance, the following members,
to-wit:
U. N. CLARY, MAYOR
ROY SKELTON COMMISSIONER
D. C. REECE C MISSIONER
and with the following absent : None
constituting a quorum; at which time the following, among other
business was transacted, to-wit :
Commissioner Reece introduced a pro-
posed ordinance, The ordinance was read In full .
Commissioner issioner Skelton made a motion that any
mac requiring ordinances to be read at more than one meeting be
suspended. The motion was seconded by Commissioner Reece
and carried by the following vote:
AYES : Mayor Clary and Commissioners Skelton
and Reese.
NOES : None.
Commissioner Reece made a motion that the
ordinance be passed finally. The motion was seconded by Corn-
missioner �Skelto� , and carried by the following vote:
AYES : Mayor Clary and Commissioners Skelton
and Reese.
NOES : None.
The Mayor announced that the ordinance had been
finally passed ,
The ORDINANCE is as follows:
"AN ORDINANCE by the City Commission of the City of
Prosper, Texas , prescribing rates to be charged
for services furnished by the Waterworks and
Sanitary Sewer System owned and operated by the
said City, repealing all ordinances, orders,
resolutions, or parts thereof, in conflict,
and declaring an emergency."
WHEREAS, HERETOFORE, to-wit : on the 17th day of
December, 1954, an election was duly held for the purpose, and
a majority of the qualified electors of said city voting at
said election, authorized the issuance of $25,000 "City of
Prosper, Texas, Waterworks and Sewer System Revenue Bonds" ; and
WHEREAS, thereafter, to-wit : on the 7th day of
January, 1955, the City Commission of said City passed and
adopted that certain ordinance authorizing the issuance of said
bonds, under authority of Articles 1111 et seq. , Texas Revised
Civil Statutes of 1925, as amended, being --
"AN ORDINANCE by the City Commission of the City
of Prosper, Texas, authorizing the issuance of
bonds in the principal sum of $25,000 for
the purpose of constructing a Sanitary Sewer
System in and for said City, as authorized by
the general laws of the State of Texas , parti-
cularly Articles 1111 et seq. , Revised Civil
Statutes of Texas, 1925, as amended; prescribing
the form of the bonds and the form of the interest
coupons; pledging the revenues of the City's
combined Waterworks and Sanitary Sewer System
to the payment of the principal and interest of
said bonds, after deduction of reasonable ex-
penses of operating and maintaining said system;
enacting provisions incident and relating to the
subject and purpose of this ordinance; and de-
claring an emergency." ;
said ordinance being recorded in Book , page
et seq. , of the Minutes of this City Commission, to which refer-
ence is here made, and which said ordinance provided and stipu-
lates that the City shall fix and maintain rates and collect
charges for the facilities and services afforded by its Water-
works and Sanitary Sewer System which will provide revenues
sufficient at all times to pay for all operation, maintenance,
depreciation, replacement and betterment charges of the System,
and to establish and fully maintain a Special Waterworks and
Sewer System Revenue Bond Retiree ent and Reserve Fund; and

WHEREAS, it now appearing to this City Commission that
it is necessary and proper to prescribe a schedule of rates or
charges to be paid by the inhabitants of said City for services
rendered by the City's Waterworks and Sanitary Sewer System;
therefore
BE IT ORDAINED BY THE CITY COMMISSION (P THE CITY OF
PROSPER, TEXAS :
SECTION 1: That the monthly rates or charges for
service furnished by the waterworks system shall be as follows :

Each additional 1,000 gallons,
Two family dwelling, Minimum, 2,000 gallons, monthly, 3.7!
Each additional 1,000 gallons, 60

For two meters, Minimum 2,000 gallons, monthly, .60
Each additional 1,000 gallons,

Retail stores, garages and elevator, same as one family.
SECTION 2: That the monthly rates or charges for
services furnished by the Sanitary Sewer System shall be as
follows :

All others, same as one family dwelling.
Connections must be a»roved by Town of Prosper.
SECTION ;j: That such rates and charges hereby fixed
and prescribed shall be paid by the users of the Waterworks and
the Sanitary Sewer System to the City Clerk in advance of the
10th day of each month, and which shall be the date such rates
or charges shall become due and payable, and in case any user
or customer of such system does not pay the amount due by such
user or customer within fifteen (15) days from the date the same
became due and payable, then it is hereby made the duty of the
City Clerk to add a ten per cent (1070 penalty to the amount
past due and unpaid.
SECTION k: In the event any user or customer does not
pay matured rates and charges within thirty (30) days from the
date same becomes due and payable, it is hereby made the further
duty of the City Clerk to disconnect the water service; and
whenever the amount past due and delinquent is paid by such user
or customer, such service may be resumed, but there shall be

charged and collected a re-connection charge of $ 4
SECTION 5: That no free service shall be allowed,
and to the ex;.ent the City and its various departments avail
themselves of the services afforded by the Waterworks and
Sanitary Sewer System they shall pay therefor the same rates
charged other consumers .
,SECTION 6: That all ordinances, orders, resolutions,
or parts thereof, heretofore passed and adopted by this City
Commission, in conflict herewith, shall be, and the same are
hereby repealed.
SECTION 7: The public importance of this measure and
the fact that it is to the best interest of the City to pres-
cribe rates and charges for the City's Waterworks and Sanitary
Sewer system at the earliest possible date, constitute and
create an emergency and an urgent public necessity requiring
that any rule providing for ordinances to be read and voted
upon at more than one meeting of the City Commission be sus-
pended, and requiring that this ordinance be passed and take
effect as an emergency measure, and such rules and provisions
are accordingly suspended, and this ordinance is passed as an
emergency measure, and shall take effect and be in full force fine
and after its passage.
