N. CLARY, MAYOR ROY SKELTON COMMISSIONER D. C. REESE COMMISSIONER at which time the following, ordinance was adopted: Commnissio..er 30J T /viutraduced the proposed ordinance. The ordinance was read in full. AlSrle Commissioner ELe-GL--- made a motion that any rule requiring ordinances to be read at more than one meeting; be suspended. The motion was seconded by Commissioner S /r€ 1-0-2 tV, and carried by the followini vote: AYES: Mayor Clary and Commissioners Skelton and Reese. NOES: None. Commissioner $ key)-O&'made a motion that said ordinance be finally passed ad adopted. The motion was seconded by Commissioner J I ag-C C-and carried by the follow- in vote: w.• AYES: Mayor Clary and Commissioners Skelton and Reese. NOES: None. The Mayor announced that the ordinance had bee finally passed aid adopted. The ORDIi-ACE is as follows: "AN ORDINANCE by the City Commission of the City of Prosper, Texas, accepting for and on behalf of the City of Prosper, Collin County, Texas, the provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendee its thereto, re- lating to cities and towns." WHEREAS, Article 961, Revised Civil Statutes of Texas, 1925, as amended, provides: "An incorporated city, town or village in this State, containing six hundred inhabitants or over, however legally incorporated, and any incorporated city, town or village of whatever population containig one or more manu- facturing establishments, within the corporate limits, may accept the provisions of this title relating to cities and town, in lieu of any existing charter, by a two-thirds vote of the council of such city, town or village, had at a regular meeting thereof, and entered upon the journal of their proceedinr,;a, and a copy of the same signed by the mayor and attested by the clerk or secretary under the corporate seal, filed and recorded in the office of the county clerk in which such city, town or village is situated, and the provisions ..... of this title shall be in force, and all acts theretofore passed incorporating said city, town or village which may be i., force by virtue of any existing charter, shall be repealed from and after the filing cf said copy of their proceedings, as aforesaid. When such city, town or village is so incor- porated as herein provided, the same shall be known as a city or town, subject to the provisions of this title relating to cities and towns, and vested with all the rights, powers, privileges and immunities and franchises therein conferred. The provisions of this title shall not apply to any city, town or village until such provisions have been accepted by the council in accordance with this article. Acts. 1875, P. 113; O. L. vol. 9, P. 657; Acts 1915, p. 64; Acts 1919 P. 110.", and WHEREAS, the City of Prosper in the County of Collin, State of Texas, pursuant to order of the County Judge of said County entered on the day of 11-- ' , , 19 11(, was duly incorporated in conformity with he provisions and re- quirements of Chapter 12, Title 23, Texas Revised Civil Statutes of 1925, which said order of the County Judge of said County declaring the result of the election to incorporate said Tow i is of record in Book u , page '1 1 Minutes of the Commis- sioners' Court of Collin County, Texas, and was also pissed of record in Volume page a9 ,6 of the Deed Records of said County, on the , 4,4 ,day of )1 . , 19 14 3 and WHEREAS, it is found and declared that said City contains one or more, to-wit: 4e. manufacturing establish- ments within its corporate limits; and WH.MEAS, the City Commission of said City deems it advisable for said City to accept and adopt provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, relating to cities and towns, and thereby become vested with all the rights, powers and privileges conferred upon cities and towns incorporated under the General Laws of this state; therefore 4Mair BE IT ORDAINED BY THE CITY COMMISSION OP THE CITY 0 PROSPER, TEXAS: SECTION 1: That the City of Prosper, Texas, hereby adopts and accepts as its organic law all of the provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, relating to cities and towns. SECTION 2s That said City shall hereafter be subject to all provisions of Title 28, Texas Revised Civil Statutes of 1925, and amendments thereto, relating to cities and towns in-- corporated under the General Laws, and shall be vested with all the rights, powers, privileges and immunities and franchises therein conferred. SECTION 3: That this ordinance shall be entered upoL the official Minutes of the City Commission of the City of Prosper, Texas, and a copy thereof signed by the Mayor and attested by the City Clerk, under the corporate seal of the City, shall be filed and recorded i s the office of the County Clerk of Collin County, Texas.
