Harper, Town Clerk, with the following absent: None, constituting a quorum, at which time the following, among other business, was transacted, to -wit: Commissioner W. H. Field introduced a nrooposssedd ordinance, which was read in full, and Commissioner e -1XU r mgde a motion that the rule requiring ordinances be read at more than one meeting be suspended, which motion was seconded by Commissioner W. H. Field, and was carried by the following vote: Ayes: Commis- sioner W. Field and Commissioner and Mayor U. N, Clary. Noes: None. ` Commissioner W. H. Field made a motion that the ordinance be massed finally, , which motion was seconded by Commissioner . The motion carried by the following vote: Ayes: Commissioners W. H. The Mayor announced the ordinance had finally been passed which ordinance Is as follows: AN ORDINANCE FIXI:G RATES AND CHARGES FOR CONSUMPTION OF WATER AFFORDED BY THE WATER WORKS SYSTEM OF THE TOWN OF PROSPER, TEXAS, AND PROVIDING FOR THE COLLECTION OF SUCH CHARGES AND FOR THE DISPOSITION OF SUCH SUMS COLLECTED. Be it ordained by the Town Commission of the Town of Prosner, Texas: 1. For water services hereafter to be furnished each month for consumption In the Town of Prosper, Texas, by the Prosper Water Works System, for each connection with said system, the following schedule of rates and charges shall prevail:. For domestic service, a single family dwelling, for the first 2,000 gallons, or less, a minimum of �2.00, and for each additional 1,000 gallons, 50¢. For domestic service, a two or more family dwelling, for the first 4,000 gallons, or less, a minimum of $3.00, and for each ad- ditional 1,000 gallons, 50¢. For barber shops, for the first 4,000 gallons, or less, a mini- mum of $3.00, and for each additional 1,000 gallons, 50¢. For restaurants, for the first 4,000 gallons, or less, a mini- mum of 53.00, and for each additional 1,000 gallons, 50�. For Flour Mill, for the first 8,000 gallons, or less, a mini- mum of 45.00, and for each additional 1,000 gallons, 50¢. For laundry, for the first 8,000 gallons, or less, a minimum of 05.00, and for each additional 1,000 gallons, 50¢. For school, for the first 12,000 gallons, or less, a minimum of 4'7.00, and for each additional 1,000 gallons, 50¢. 2. Each such charge for water furnished shall be payable to the Town Clerk of the Town of Prosper, Texas, on or before the loth day of the calendar month, succeeding the month in which such charges shall have been made. 3. For water services hereafter to be furnished during any gin- ning season to any cotton gin, a minimum charge of $50.00. This charge shall be payable to the Town Clerk of the Town of Prosper, Texas, on or before the loth day of the calendar month succeeding the month in which operation of such gin is commenced, and for which charge a maximum allowance to such gin of 100,000 gallons shall be made, and for each additional 1,000 gallons in excess of such 100,000 gallons, 35¢. Each charge for such excess shall be payable to the Town Clerk of the Town of Prosper, Texas, on or before the loth day of the calendar month, succeeding the month in which charges for. `, such excess shall have been made. i 4. Any charge for water hereafter furnished which shall not ` be promptly paid within the time herein provided shall thereafter be increased lo% as a penalty. 5. Each person, firm, corporation or association desiring or having a water connection for water service from the mains or lines of the water works system of the Town of Prosper, Texas, shall de- posit a fee of $5.00, to be known as meter fee, for each connection with the lines or mains of such water works syste, and each such de- posit shall remain in the Town Treasury so long as the connection, for which such deposit shall have been made, shall be maintained. Such meter fee shall be repaid to the depositor upon discontinuance 4 of the connection for cftiich such deposit shall have been made, how- ever upon discontinuance of the connection for which any such deposit shall have tieen made the Town of Proaper shall have the right to retain out of such deposit any sum which may remain unpaid for water services occasioned by reason of the connection for which such depos- it may have been made. A separate account of meter fees collected shall be kept in the depository of said Town and such meter fees shall not be deemed revenue of the water works system of such Town. 6. The Town Clerk of the Town of Prosper, Texas, will deposit, with the designated depository of said Town, as collected, all revs- j nues from the operation of such water works system into a separate account, designated "system fund", which shall be kept separate and apart from all other funds of the Town. The system fund shall be ad- ministered in the manner provided in the ordinance adopted by the Town of Prosper, Texas, on August 15th, 1938, authorizing and direct- ing the issuance of Twelve Thousand ($12,000.00) Dollars bonds for the purchase of and for making repairs, improvements and extensions to, such water works system. 7. The Town Commission of the Town of Prosper, Texas, shall have the management of said water works system, and all connections therewith shall be made under such rules and regulations as may be established by the Town Commission. Upon failure to pay any charge for water furnished through such system, or any penalty as herein provided, the connection with such system, by reason of which the charge, or penalty, was incurred, shall be immediately discontinued, until due payment for such services shall have been made, and until a fee of 9A.00 shall be paid to the Town Clerk for reconnection of such service, which fee is here fixed for such reconnection. 8. All ordinances of said Town in conflict herewith are here- by expressly repealed. 9. By reason of the fact that the Town Commission considers the passage of this ordinance necessary for the preservation of the public health and safety of the Town and its citizens, it is hereby declared to be an emergency measure demanding that the rule ree_ulring ordinances to be read at more than one meeting of the Town Commission be suspended and that this ordinance take effect Immediately from and after its passage, and it is so ordered.
