N. Clary Mayor W. H. Field A. E. robison Commissioners C. W. Harper Town Clerk with the following absent: None, constituting a quorum, at which time the following among other business was transacted, to -wit: Commissioner V. H. Field introduced a proposed ordinance. The ordinance was read in full. Commisaioner A. E. Robison made a motion that the rule re- quiring ordinances to be read at more than one meeting be susnended. The motion was seconded by Commissioner W. H. Field. The motion r carried by the following vote! AYES.- Commissioners V. It. Field and A. E. Robison and Mayor U. N. Clary. NCE3: None. Commissioner W. RHERF,AS, the Town Commission has heretofore, on the Bth day of February, 193'."., adopted a resolution and order calling an elec- tion on the question "shall the Board of Commissloners of the Town of Prosper, Texas, be authorized to issue bonds of the Town of Pros- per, Texas, in the sum of Two Thousand (02,000.00) Dollars payable serially within any given number of years not to exceed ten (10) years from the date of said bands, bearing Interest at a rate not exceeding four (0) per centum per annum, interest payable annually, and to levy an ad valorem tax on all taxable nronerty within the limits of said Town sufficient to nay the annual interest on said bonds and provide a sinking fund to ^ay the bonds at maturity; said bonds for the pur,-ose of making permanent improvements to the water works system within the limits of sale. T�mn, that is the laying, of additional water mains within said Town limits, as authorized by the Constitution and Laws of the State of Texas"; and, WHERf;Aq, said election was held, pursuant to said resolution and order, on the 25th day of February, 1939, and resulted favorably to the issuance of said bonds; and, the Town Commission has heretofore adorted a resolu- tion, declaring the results of said election and determining the specific authority of the Town to Issue said bonds; therefore, 19, Y HE IT ORDAINED BY THE TOWN COMMIS31nN OF THE TOWN CF PROSPER, T Y.AS: Sao. 1. That to pay the Interest on said bonds and create a Sinking Fund sufficient to redeem them at maturity, a tax of T-,',ENTY CENTS (20¢) on each $100.00 valuation of all taxable property In the Town of Prosper, Texas, or such an amount as may at all times be legally necessary, shall be annually levied on sai(t property and an- nually assessed and collected, or so much thereof as shall be neces- sary, or in addition then: -to as may be required, until said bonds, with interest thereon, have been fully paid; and said tax of TWENTY CENTS (200 is here now levied for the current year 1939, and so much thereof as shall be necessary, or in addition thereto as may be requi•ed, is hereby levied for each succeeding year while said bonds, or any of them, are outstanding, and the same shall be annually as- sessed and collected and applied to the purposes named. Sec. 11. It shall be the duty of the Mayor to submit the record of said bonds, and of the proceedings authorizing, the same, and said bonds to the Attorney General of the State of Texas for approval and thereafter to have theva registered by the Comptroller of the state of Texas. Said bonds, when properly executed by the Town officials, shall be held by the tiayor of the Town to be delivered by him to the purchaser or Purchasers thereof, and the bonds thus authorized shall pase by delivery. And the Mayor, Town Clerk, and Tomn Treasurer are authorized and directed to do any and all things necessary and/or convenient to carry out the terms of this ordinance. See. 12. All ordinances and resolutions, and parts thereof, in conflict herewith are hereby expressly repealed insofar as they conflict herewith. Sec. 13. By reason of the fact the Town Commission considers the passage of this ordinance necessary for the preservation of the public health and safety of the Town and its citizens, it is hereby declared to be an emergency measure demanding that the rule reeulr- 24. J� ing ordinances to be read at more than one meeting of the Town Com- mission be suspended, andthat this ordinance take effect immediately from and after its passage, and it Is so ordered. WHENAAe, the Town of Prosper, Texas, has taken proceedings approoriate to obtain funds for the purpose of making permanent Improvements to the water works system within the limits of said Town, that Is the laying of additional water mains within said Town limits, as authorized by the Constitution and taws of the State of Texas, and to obtain such funds the Town Commission of the Town of Prosper, Texas, has passed an ordinance on February 28th, 1939, authorizing the issuance of Town of Prosper, Texas, Water Works Hon'.s, Series 1939, in the aggregate amount of 42,000.00, bearing Interest at the rate of 4% per annum, and it being neeess,,:ry to secure non-lltig4.tion certificate, with reference to said bond issue, to the end that approval of said issue may be obtained from the Attorney General of this State. NOW, THEREM E, I, J. C. Cantrell, Clerk of the District Court of Collin County, Texas, do hereby certify that there is no litigation of any nature that is now pending, or to my knowledge threatened in the District Court of Collin County, Texas, to re- strain or enjoin said work proposed to be done by said Town of Prosper, Texas, or the financing of such proposed improvements, or in any manner questioning the authority of the Town of Prosper, Texas, to make the above mentioned permanent improvements, or to finance the construction of such improvements in the manner set out above, nor in any manner questioninc the validity of the bonds to be issued pursuant to the terms of the above mentioned ordinance.
