ELECTION ORDER
THE STATE OF TEXAS
COUNTY OF COLLIN
TOWN OF PROSPER
On this, the Bth day of February, 1939, the Board of Town
Commissioners of the Town of Prosper, Texas, convened in regular
session, at the regular meeting place, with the following members
thereof, to -wit:

A. E. Robison

C. W. Harper
Town Clerk
present, and the following absent: None, constituting a quorum,
when, among other proceedings had, were the following:
Commissioner A. E. Robison introduced a resolution and order
and moved its adoption. The motion was seconded by Commissioner
W. H. Field.
The motion carrying with it the adoption of the resolution
and order, prevailed by the following vote:
AYES: Commissioner A. E. Robison, Commissioner W. H. Field
and Mayor U. N. Clary.
NOES: None.
The resolution and order is, as follows:
RESOLUTION AND ORDER
BY THE BOARD OF COMMISSIONERS OF THE TOWN OF
PROSPER, TEXAS, CALLING AN ELECTION ON THE
QUESTION OF THE ISSUANCE OF TWO THOUSAND
($2,000,00) DOLLARS BONDS OF SAID TOWN FOR THE
PURPOSE OF MAKING PERMANENT IMPROVEMENTS TO THE
WATER WORKS SYSTEM WITHIN THE LIMITS OF SAID
TOWN,
WHEREAS, there is a necessity for the laying of additional
water mains, to the water works system, within the limits of said
Town of Prosper, Texas, and which will be permanent improvements
within the limits of said Town, and
WHEREAS, it is considered to be to the beet interest of said
Town to finance the cost of said permanent improvements, that is the
laying of said water mains, through the issuance of bonds of said
Town of Prosper, Texas, to be Issued in the amount of TWO THOUSAND
($2,000.00) DOLLARS, and to be paid by an ad valorem tax levied upon
taxable property within the limits of said Town, and
WHEREAS, the Town Commission deems it necessary and proper
that the question of the issuance of such bonds and the levy of a
tax for the payment of the principal and interest thereof be sub-
mitted to the qualified eleotors of said Town,
THEREFORE, BE IT RESOLVED AND ORDERED BY THE BOARD OF
COMMISSIONERS OF THE TOWN OF PROSPER, TEXAS?
1. That an election be held on the 25th day of February, A.D.
1939, at which election the following proposition shall be submitted:
"Shall the Board of Commissioners of the Town of Prosper, Texas,
be authorized to issue bonds of the Town of Prosper, Texas, In the
sum of Two Thousand ($2,000.00) Dollars, payable serially within any
given number of years not to exceed ten (10) years from the date of
said bonds, bearing interest at a rate not exceeding four (4,%) per
centum per annum, interest payable annually, and to levy an ad valorem

tax on all taxable property within the limits of said Town sufficient
to pay the annual interest on said bonds and provide a Sinking Fund to
pay the bonds at maturity; said bonds for the purpose of making per-
manent improvements to the water works system within the limits of
said Town, that is the laying of additional water mains within said
Town limits, as authorized by the Constitution and Laws of the State
of Texas.'
2. That said election shall be held at the High School building
within said Town, and the following named persons are hereby appointed
managers thereof, to -wit:
C. B. Shipley, Presiding Judge, Lee Gilmer, Judge,
Mrs. C. G. Hays, Clerk, Mrs. R. H. Nesbitt, Clerk.
3. That said election shall be held under the provisions of
and in accordance with the laws governing the issuance of municipal
bonds in towns, as provided in the General Laws of the State of
Texas, and only qualified electors, who own taxable property in the
Town and who have duly rendered the same for taxation, shall be
qualified to vote.
All voters, who favor the proposition to issue the said bonds,
shall have written or printed on their ballots the following words:
"FOR THE ISSUANCE OF WATER WORKS IMPROVEMENT BONDS, AND THE
LEVY OF A TAX IN PAYMENT THEREOF."
And those opposed to the proposition to issue the said bonds
shall have written or printed on their ballots the words:
"AGAINST THE ISSUANCE OF WATER WORKS IMPROVEMENT BONDS, AND THE
LEVY OF A TAX IN PAYMENT THEREOF.'
4. That a copy of this resolution and order, signed by the
Mayor of said Town and attested by the Town Clerk, shall serve as
proper notice of said election.
The Mayor is authorized and directed to cause this notice of
the election to be posted at three public places within said Town,
one of which shall be at the Prosper State Bank Building, which Is
used as the Town Hall and is the regular meeting place of the Board

of Commissioners, for at least fourteen full days prior to the date
of said election.
5. The Board of Commissioners here finds that no newspaper
is published within the Town of Prosper and therefore notice of
election shall be by posting only.
