38-08 R - Canvassing Results of Election,la ELECTION RETURNS STATE OF TEXAS COUNTY OF COLLIN TOWN OF PROSPER We, the undersigned officers, appointed to hold an election In the Town of Prosper, Texas, on the 13th day of August, 1938, on the following proposition: "Shall the Board of Commissioners of the Town of Prosper, Texas, be authorized to Issue Twelve Thousand 012,000.00) dollars, revenue bonds of said Town, maturing serially over a period of years not to exceed Twenty five (25), bearing interest at the rate of four (4,%) per centum per annum, payable semi-annually, for the purpose of purchasing a water works plant and making repairs, dx- tensions and improvements thereto; and to provide for the payment of principal and interest on said bonds by pledging the net revenues from the operation of said water works system." Do hereby certify that there were cast at said election votes, of which there were cast: "FOR THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDG- ING OF THE RE.V/ENUES OF THE WATER WORKS SYSTEM, TO THE PAT,iENT THEREOF" ('5- votes. "AGAINST THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDGING OF THE REVENUES OF THE WATER WORKS SYSTEM TO THE PAYMENT THEREOF" votes. RESOLUTION CANVASSING RETURNS THE STATE OF TEXAS COUNTY OF COLLIN TOWN OF PROSPER _ i On this the ___day of August, 1938, the Town Commission of the Town of Prosper, Texas, being convened in regular session, at the regular meeting place, with the following members thereof, to -wit: U. N. Clary Mayor ` W. H. Field A. E. Robison Commissioners C. W. Harper Town Clerk present, and the following absent: None, constituting a quorum, when, among other proceedings had, were the following: Commissioner W. H. Field introduced the resolution and moved its adoption. The motion was seconded by Commissioner A. E. Robison. The motion carrying with it the adoption of the resolution _ prevailed by the following vote: AYES: Commissioners W. H. Field and A. E. Robison and Mayor U. N. Clary. NOES: None The resolution is as follows: RESOLUTION CANVASSING RETURNS AND DECLARING THE RESULT OF AN ELECTION ON THE QUESTION OF THE ISSUANCE OF $12,000.00 DOLLARS OF REVENUE BONDS FOR THE PURPOSE OF PURCHASING A WATER WORKS PLANT, FOR THE TOWN, AND FINANCING REPAIRS, IMPROVEMENTS AND EXTENSIONS TO SAME, AND THE PLEDGING OF THE REVENUES OF THE WATER SYSTEM TO THE PAYMENT THEREOF, WHEREAS, on July 28th, 1938, the Town Commission adopted a resolution and order calling an election to be held in the Town of 15. (ar Prosper, Texas, on the 13th day of August, 1938, on the following question; "Shall the Board of Commissioners of the Town of Prosper, Texas, be authorized to issue Twelve Thousand ($12,000.00) dollars, revenue bonds of said Town, maturing serially over a period of years not to exceed Twenty five (25), bearing in- terest at the rate of four (4%) per centum per annum, payable semi-annually, for the purpose of purchasing a water works plant and making repairs, extensions and improvements thereto; and to pro- vide for the payment of principal and interest on said bonds by pledging the net revenues from the operation of said water works system"; and WHEREAS, that there were cast at said election_ % votes, of which there were cast; "FOR THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDG- ING OF THE RED/VENUES OF THE WATER WORKS SYSTEM TO THE PAYMENT THEREOF" , 6- votes. "AGAINST THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDGING OF THE REVENUES OF THE WATER WORKS SYSTEM TO THE PAYMENT THEREOF" votes. MAJORITY: "For the issuance of water works revenue bonds, and the pledging of the revenues of the water works system to the payment thereof" // i votes. _ as is reflected in the election returns heretofore filed with the Town Clerk. BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF PROSPER, TEXAS: 1. That said election was duly called; that notice was given in accordance with law and in accordance with the resolution and order calling the election; that the election was held in accordance with law; that due return of said election has been made by the proper of- ficers; that said election has resulted favorably to the issuance of said bonds; that a majority of the qualified voters who had duly ren- dered their property for taxation voting at said election have voted %W in favor of the issuance of said bonds. 16. 51 M 2. That the Town Commission be and it is hereby in all things authorized, ordered and directed to issue said bonds and to do any and all things necessary and/or convenient j.n connection therewith.
