38-05 R - Calling August 1938 Bond Electiontw THE STATE OF TEXAS COUNTY OF COLLIE TOWN OF PROSPER ELECTION ORDER On this, the 2 8' day of July, 1938, the Board of Town Commissioners of the Town of Prosper, Texas, convened in regular session, at the regular meeting place, with the following members thereof, to -wit: `, U. N. Clary Mayor W. H. Field A. E. Robison Commissioners C. W. Harper Town Clerk present, and the following absent: None, constituting a quorum, when, among other proceedings had, were the following: Commissioner A. E. Robison introduced a resolution and order and moved its adoption. The motion was seconded by Commissioner W. H. Field. The motion carrying with it the adoption of the resolution and order, prevailed by the following vote: AYES: Commissioner A. E. Robison, Commissioner W. H. Field and Mayor U. N. Clary. NOES: None. The resolution and order is, as follows: 3. . A -1f- RESOLUTION AND ORDER BY THE BOARD OF COMMISSIONERS OF THE TOWN OF PROSPER, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF TWELVE THOUSAND ($12,000.00) DOLLARS REVENUE BONDS FOR THE PURPOSE OF PURCHASING A WATER WORKS PLANT AND MAKING CERTAIN REPAIRS, EXTENSIONS AND IMPROVE- LIENTS TO SUCH SYSTEM AND THE PLEDGING OF THE REVENUES OF THE SYSTEM TO THE PAYMENT THEREOF, ` WHEREAS, there is necessity for the purchase of a water works Plant and making certain repairs, extensions and improvements there- to, to be used as a water system in and for the Town of Prosper, Texas; and WHEREAS, it is considered to be to the best interest of the Town that such purchase and repairs, extensions and improvements be financed by the issuance of Revenue Bonds, payable solely from and secured by an exclusive first lien on and pledge of the revenues of such water works system of said Town, after deduction of reasonable operation and maintenance expenses, all in accordance with the pro- visions of Articles 1111 - 1118, both inclusive, of the 1925 Revised Civil Statutes of Texas, as amended, and in no wise supported by an ad valorem or other tax on property in the Town; and WHEREAS, the Town Commission deems it necessary and proper that the question of the issuance of such revenue bonds and the pledging of such revenues be submitted to the qualified electors of said Town, THEREFORE, BE IT RESOLVED AND ORDERED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF PROSPER, TEXAS: 1, That an election be held on the day of August, 1938, at which election the following proposition shall be submitted: "Shall the Board of Commissioners of the Town of Prosper, Texas, be authorized to issue Twelve Thousand (412,000.00) dollars, 4. revenue bonds of said Town, maturing serially over a period of years not to exceed Twenty five (25), bearing interest at the rate of four (4%) per centum per annum, payable semi-annually, for the purpose of purchasing a water works plant and making repairs, ex- tensions and improvements thereto; and to provide for the payment of principal and interest on said bonds by pledging the net revenues from the operation of said water works system." 2. That said election shall be held at the within said Town, and the following named persons are hereby appointed man- agers thereof, to -wit: Presiding Judge, Judge, `1Y�h Jv9 n•C)1N, S Clerk, YVWa 7L •I�. Clerk. 3. That said election shall be held under the provisions of and in accordance with the laws governing the issuance of municipal bonds in cities, as provided in the General Laws of the State of Texas, and only qualified electors, who own taxable property in the Town and who have duly rendered the same for taxation, shall be qualified to vote. All voters, who favor the proposition to issue the said bonds, shall have written or printed on their ballots the following words: "FOR THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDG- ING OF THE REVENUES OF THE WATER WORKS SYSTEM TO THE PAYP;IENT THEREOF." And those opposed to the proposition to issue the said bonds shall have written or printed on their ballots the words: "AGAINST THE ISSUANCE OF WATER WORKS REVENUE BONDS, AND THE PLEDGING OF THE REVENUES OF THE WATER WORKS SYSTEM TO THE PAYMENT THEREOF." 4. That a copy of this resolution and order, signed by the Mayor of said Town and attested by the Town Clerk, shall serve as proper notice of said election. • n 4W The Mayor is authorized and directed to cause this notice of the election to be posted at three public places within said Town, one of which shall be at the Prosper State Bank Building, which is used as the Town Hall and is the regular meeting place of the Board of Commissioners, for at least fourteen full days prior to the date of said election. 5.
