38-02 R - Adopting Title 28 of Revised Civil StatutesL THE STATE OF TEXAS COUNTY OF COLLIN TOWN OF PROSPER On this 28th day of July, 1938, the Board of Town Com- missioners of the Town of Prosper, Texas, convened in regular session, at its regular meeting place in said Town, with the following members thereof, to -wit: U. N. Clary, Mayor, W. H. Field and A. E. Robison, Commissioners, and C. W. Harper, Town Clerk, present and the following absent, None; constituting a quorum when, among other proceedings had, were the following: Commissioner A. E. Robison Introduced a resolution and order and moved its adoption. The motion was seconded by Com- missioner W. H. Field. The motion carrying with it the adoption of the resolution and order, prevailed by the following vote: Ayes: Commissioner A. E. Robison, Commissioner W. H. Field and Mayor U. N. Clary. Noes: None. The resolution and order is, as follows: (,W RESOLUTION AND ORDER By the Board of Commissioners of the Town of Prosper, Texas, which contains within its corporate limits a manufacturing estab- lishment, to accept the provisions of Title 28, of the Revised Civil Statutes of Texas, 1925, as same relates to cities and towns in lieu of existing charter. WHEREAS, there exists within the corporate limits of the Town of Prosper, Texas, a manufacturing establishment, to -wit: a flour mill; and WHEREAS, it is considered to be for the beat interest of t 0_- said Town to accept the provisions of Title 28, of the Revised Civil Statutes of the State of Texas, 1925, in lieu of the exist- ing charter provided by Statute Law for said Town, THEREFORE,BE IT RESOLVED AND ORDERED BY THE BOARD OF COMMISSIONERS OF THE TOWN OF PROSPER, TEXAS; 1. That the provisions of Title 28 of the Revised Civil Statutes of the State of Texas, 1925, relating to cities and towns be, and they are hereby adopted for and on behalf of the Town of Prosper, Texas, in lieu of its charter provided by statute, and that a copy hereof be entered upon the Journal of the proceedings of this Board, and a copy of the same signed by the Mayor and at- tested by the Town Clerk, under the corporate seal, and filed and recorded in the office of the County Clerk of Collin County, Texas. 1 Passed and approved this the day of July, 1938.
