In regard to item 2, Mayor Bristol asked staff to explain the shortfall in revenue in the
Intergovernmental Revenue (Grants) line and would also like an update regarding the
Healthcare Fund.
Mr. Northcutt explained there are $1.2 millon of reimbursements related to MVCPA
grants that are still outstanding. These are on hold due to the Governor's executive order
disallowing the use of state funds for ALPR technology. Staff expects this hold will be
removed since the order was issued after our grant agreement. There are other
reimbursements for operating grants such as COPS and STEP that come after
September. These financials are on a cash basis and do not include many revenue items
that are received after September 30. The ACFR will show the true picture of how we
finished the year.
Mr. Luton indicated The Town’s Health Insurance Fund is projected to finish the fiscal
year under budget once all anticipated stop-loss insurance reimbursements have been
received. While current expenditures may reflect higher costs due to large medical
claims, the pending reimbursements will offset a portion of these expenses and improve
the fund’s overall financial position. Based on current projections, staff anticipates the
Health Insurance Fund will close the fiscal year with expenditures below the budgeted
amount.
Councilmember Andres made a motion to approve item 2. Councilmember Reeves
seconded the motion. Motion carried unanimously.

Economic Overview 9/30/2026
During the third quarter of 2026, the Federal Open Market Committee (FOMC) raised the federal funds target range by 25 basis points to 3.75%–4.00% at its September meeting, reflecting
continued concerns over elevated inflation despite solid economic activity. The FOMC maintained a data-dependent approach, with its September projections indicating a median year-end
federal funds rate of 4.1%, up from 3.8% in June. Inflation remained above the Fed’s 2% target, with Core PCE increasing 3.1% year-over-year in September, compared to 3.0% in August, while
headline PCE rose 3.6%, reflecting continued price pressures. By September, Core CPI was 2.6% year-over-year, while headline CPI reached 3.7%, driven largely by rising energy prices. Labor-
market conditions showed signs of slowing, with nonfarm payroll employment declining by 10,000 in July, increasing by 133,000 in August, and increasing by 29,000 in September, for an
average gain of approximately 51,000 jobs per month during Q3. The unemployment rate ended the quarter at 4.2%. Energy markets remained volatile as geopolitical tensions and ongoing
disruptions to Middle East oil supplies continued to influence global prices. WTI crude oil averaged approximately $87 per barrel during Q3, increasing from an average of approximately $80 in
July to $97 in September. Treasury yields increased during the quarter, with the yield curve remaining positively sloped on a 2-year/10-year basis. Persistent inflationary pressures, geopolitical
uncertainty, energy-market disruptions, and evolving monetary policy expectations continued to contribute to financial-market volatility.

Re: Library Board Amendments
Town Council Meeting –November 10, 2026
Strategic Visioning Priority: Provide Excellent Municipal Services
Agenda Item:
Consider and act upon an Ordinance amending Division 2, "Library Board," of Article 1.04,
"Boards, Commissions and Committees," within Chapter 1 of the Town's Code of Ordinances by
amending Section 1.04.033, "Term of Office" and adding Section 1.0434, “Vacancies,”
renumbering sections, and correcting scrivener’s errors.
Description of Agenda Item:
The Prosper Town Council formally established the Library Board in September 2014. The Library
Board was originally established as a seven (7)-member board. In September 2025, the Town
Council amended the Code to expand the Board by adding two (2) members, increasing its
membership to nine (9). However, the provisions governing terms of office were not updated to
reflect the expanded membership, and the Code does not currently include a provision addressing
vacancies. Accordingly, staff recommend amending these sections of the Code to ensure they
accurately reflect the Board’s nine (9)-member composition and establish provisions for
vacancies.
Additionally, staff conducted a further review of this division of the Code of Ordinances and
recommends additional amendments to correct technical and scrivener’s errors, clarify existing
provisions, and ensure consistency with Division 2 governing the Library Board. These
amendments are intended to improve the accuracy and clarity of the Code without making
substantive changes.
Budget Impact:
There is no budgetary impact affiliated with this item.
Legal Obligations and Review:

of Article 1.04, "Boards, Commissions and Committees," within Chapter 1 of the Town's Code of
Ordinances by amending Section 1.04.042, “Chair/Vice-Chair/Quorum,” renumbering sections
and correcting scrivener’s errors.
Description of Agenda Item:
The Prosper Town Council appointed the Community Engagement Committee (CEC) in
December 2020 as an Ad Hoc Committee and by September of 2022 was formally established as
a standing committee. When the CEC was formally established, three members of the Town
Council serving as liaisons were carried over into the Ordinance with the responsibility of

Upon review, there are currently no Town Council liaisons serving on any of the other Town’s
standing Board, Commissions, and Committees. Therefore, staff is recommending to remove this
provision within the Ordinance. In addition, staff have conducted an additional review of this
Division within the Code of Ordinances and are recommending additional amendments. The
amendments are intended to correct technical errors, clarify existing provisions, and ensure
consistency with Division 2 of the Code governing the Library Board, without making substantive
changes.
Budget Impact:
There is no budgetary impact affiliated with this item.

Re: Solid Waste Contract Amendment No. 4 and Annual CPI Adjustment
Town Council Meeting – November 10, 2026
Strategic Visioning Priority: Provide Excellent Municipal Services
Agenda Item:
Consider and act upon approving Amendment No. 4 to the Solid Waste and Recycling Services
Agreement with Allied Waste Services, Inc. dba Republic Services of Lewisville to approve a
revised fee schedule effective February 1, 2027, adjusting commercial and residential prices for
the twelve-month CPI change.
Description of Agenda Item:
The original solid waste services contract was awarded to Republic Services on June 27, 2023,
for a seven-year initial term with three one-year renewals. The current contract includes a
provision for an annual cost adjustment that is reflective of the annual Consumer Price Index (CPI)
for solid waste services, which was 5.23% for the period of September 2025 to September 2026.
Per the contract, the annual cost adjustment shall not exceed five percent (5%) in any single year,
nor exceed a cumulative increase of fifteen percent (15%) over a four-year period.
In June 2024, the Council approved Amendment No. 2 to the contract, which included a cost
adjustment of 3.8%. Amendment No. 3 included a 5% cost adjustment. Amendment No. 4
includes a proposed 5% increase beginning on February 1, 2027, which is the maximum increase
allowed by contract. As a result, Republic Services will only be entitled to an additional 1.2%
increase in 2028. The 5% rate increase will be applied to all residential and commercial services
effective on February 1, 2027.
Budget Impact:
The fees in Appendix D are passed through to Republic and will not have budget impact. The
Town charges a monthly fee of $2.00 for cart financing, which will not be increased. The monthly
administrative fee will be increased from $0.80 to $1.00 to cover increases in Solid Waste
administrative costs.

Re: First Amendment to License Agreement
(Prosper Rotary Foundation)
Town Council Meeting – November 10, 2026
Strategic Visioning Priority: Provide Excellent Municipal Services
Agenda Item:
Consider and act upon authorizing the Town Manager to execute a First Amendment to the
License Agreement between the Prosper Rotary Foundation and the Town of Prosper, Texas,
related to the location and construction of a Donors’ Wall adjacent to the Veterans’ Memorial in
Frontier Park.
Description of Agenda Item:
On December 14, 2021, the Town of Prosper and the Prosper Rotary Foundation entered into a
License Agreement for the construction of a Veterans’ Memorial in Frontier Park. The License
Agreement granted the right for the Prosper Rotary Foundation to construct a Veterans’ Memorial
inside the “circle” property located on the northwest side of Frontier Park. The Prosper Rotary
Foundation recently completed the construction of the Veterans’ Memorial inside the “circle”
property, that includes a center raised memorial star for the six (6) branches of the military, six (6)
granite walls with names of those that lived in Prosper and served in the military, brick pavers with
names engraved of those that served in the military, and three (3) flagpoles for the American,
Texas and POW flags.
To commemorate those that provided financial assistance to the Veterans’ Memorial, the Prosper
Rotary Foundation would like to construct a Donors’ Wall at the site. The proposed location of the
Donors’ Wall would be outside the “circle” property, which is not within the area granted to the
Prosper Rotary Foundation for construction of a Veterans’ Memorial. To maintain the sacredness
of those honored within the “circle” property, the first amendment to the License Agreement grants
the right for the Prosper Rotary Foundation to construct a Donors’ Wall outside the “circle”
property.
Budget Impact:
There is no cost to the Town related to the design and construction of the proposed Donors’ Wall.
Per the terms of the License Agreement, upon completion of the construction of the improvements,
the Town shall pay for all utilities and maintenance of the Veterans’ Memorial, which would include
the proposed Donors’ Wall.

THIS FIRST AMENDMENT TO THE LICENSE AGREEMENT BETWEEN THE
TOWN OF PROSPER, TEXAS, AND THE PROSPER ROTARY FOUNDATION
(“Amendment”), entered into on the 10th day of November, 2026, is between the Town of
Prosper, Texas (“Town”), and the Prosper Rotary Foundation (“Foundation”), relative to
the location and construction of a Donors’ Wall (“Donors’ Wall”) immediately adjacent to
the Veterans’ Memorial (“Veterans’ Memorial”) in Frontier Park in the Town, and the
Parties agree as follows:
WHEREAS, on or about December 14, 2021, the Town and the Foundation
entered into a License Agreement (“License Agreement”) relative to the construction of a
Veterans’ Memorial located in Frontier Park in the Town; and
WHEREAS, at the present time, the Town now wishes to allow the Foundation to
construct a Donors’ Wall outside the “circle” paved area of the Veterans’ Memorial in the
Town, subject to the terms contained herein.
NOW, THEREFORE, the Town and the Foundation agree as follows:
1. The Foundation’s license area in Frontier Park, as depicted in the License
Agreement, shall be expanded to allow the Foundation to construct a Donors’ Wall
adjacent to the “circle” paved area of the Veterans’ Memorial, subject to the general
design and location depicted in Exhibit A and Exhibit B, attached hereto and incorporated
by reference.
2. Upon completion of the Donors’ Wall, it will be considered a part of the
Veterans’ Memorial, and the remaining terms of the License Agreement shall remain

Re: Backup Infrastructure Hardware Replacement
Town Council Meeting – November 10, 2026
Strategic Visioning Priority: Provide Excellent Municipal Services
Agenda Item:
Consider and act upon authorizing the purchase of replacement backup infrastructure hardware
and associated support, through SHI Government Solutions, Inc., utilizing a Texas Department of
Information Resources (DIR) Purchasing Contract, for $70,777. (LJ)
Description of Agenda Item:
The Town utilizes a backup platform to provide data protection and recovery capabilities for its
two virtual server clusters. These clusters provide the storage and computing resources necessary
to operate the Town's on-premise critical software systems, including computer aided dispatch
and records management (CAD/RMS), the Town's document archival platform, geographic
information system (GIS) servers, and other critical applications used throughout Town operations.
The existing backup hardware will reach its end-of-life in February 2027, necessitating
replacement to maintain continued supportability, reliability, and data protection capabilities. The
backup platform is a critical component of the Town's cybersecurity infrastructure, providing the
ability to recover essential systems and data in the event of hardware failure, data corruption,
ransomware, or other cybersecurity incidents.
This item provides for the replacement of the existing backup hardware with updated equipment,
including associated support and connectivity components. The replacement will allow the Town
to maintain its existing backup and recovery capabilities while ensuring continued hardware
support and operational reliability.
The purchase will be made through SHI Government Solutions, Inc., utilizing a Texas Department
of Information Resources (DIR) Purchasing Contract.
Budget Impact:
The total cost of the replacement hardware, associated support, and connectivity components is
$70,777 and will be funded from the Information Technology Department's FY 2026-2027

Strategic Visioning Priority: Provide Excellent Municipal Services
Agenda Item:
Consider and act upon authorizing the annual renewal of the Town's managed cybersecurity
platform, through SHI Government Solutions, Inc., utilizing a Texas Department of Information
Resources (DIR) Purchasing Contract, for $94,335. (LJ)
Description of Agenda Item:
In October 2025, the Town Council approved the purchase of the Town's managed cybersecurity

response, vulnerability management, endpoint detection and response (EDR) monitoring, security
information and event monitoring (SIEM), security orchestration and automation (SOAR), cloud
security monitoring, ransomware protection, and a 24/7 security operations center (SOC).
The REDACTED platform provides continuous monitoring, threat detection, and incident response
capabilities across the Town's technology infrastructure. These services assist the Information
Technology Department in identifying and responding to potential cybersecurity threats, reducing
security risks, and protecting critical municipal systems and data.
This item renews the Town's existing managed cybersecurity platform for an additional one-year
term from November 17, 2026 through November 16, 2027. The renewal includes continued
managed threat detection and response services, ransomware prevention, and associated
security monitoring and incident response capabilities.
The renewal will be purchased through SHI Government Solutions, Inc., utilizing a Texas

Town Council Meeting – November 10, 2026
Strategic Visioning Priority: Grow and Diversify the Tax Base
Agenda Item:
Conduct a Public Hearing to consider and act upon an Ordinance amending the Project and
Finance Plan for Tax Increment Reinvestment Zone Number One (TIRZ No. 1) increasing the
Maximum Construction Payment to $76,714,144.
Description of Agenda Item:
The Town Council created Tax Increment Reinvestment Zone Number One (TIRZ No. 1) in 2008
to facilitate the construction of The Gates of Prosper to be developed by Blue Star Land
Development. The maximum construction payment to reimburse the developer was approved in
2014 in the amount of $58,000,000 with a total cap for the maximum construction payment plus
interest set at $93,079,000.
Construction costs have significantly increased since that time the total estimate to complete the
improvements is now $76,714,144. The proposed amendment increases the maximum
construction payment to this amount. If approved, the projected completion of construction
reimbursements to the developer is September 2033.
A public hearing must be held prior to the approval of any amendments to the zone project plan.
Budget Impact:
The proposed amendment increases the maximum construction payment to $76,714,144, but no
change is proposed for the maximum construction payment plus interest that would remain at
$93,079,000.

Re: TIRZ No. 1 Amended Development and Finance Agreement
Town Council Meeting – November 10, 2026
Strategic Visioning Priority: Grow and Diversify the Tax Rate
Agenda Item:
Consider and act upon approval of the Second Amendment to the First Amended and Restated
Development and Finance Agreement with the Prosper Economic Development Corporation and
Blue Star Land Development increasing the Maximum Construction Payment to $76,714,144 for
development of the Gates of Prosper in accordance with the Tax Increment Reinvestment Zone
Number One (TIRZ No. 1) Project Plan.
Description of Agenda Item:
The Town Council created Tax Increment Reinvestment Zone Number One (TIRZ No. 1) in 2008
to facilitate the construction of infrastructure in The Gates of Prosper to be developed by Blue Star
Land Development. The maximum construction payment to reimburse the developer was
approved in 2014 in the amount of $58,000,000 with a total cap for the maximum construction
payment plus interest set at $93,079,000.
Construction costs have significantly increased since that time; therefore, the total estimate to
complete the improvements is currently at $76,714,144. The proposed amendment increases the
maximum construction payment to this amount. If approved, the projected completion of
construction reimbursements to the developer is September 2033.
This agreement facilitates the reimbursement of Blue Star Land Development up to the maximum
construction payment and interest utilizing revenues collected within TIRZ No. 1. These revenues
are made up of Collin County property tax, Town property and sales tax, and Prosper EDC sales
tax. The agreement also includes an exhibit showing all remaining improvements for the
development.
Budget Impact:
The proposed amendment increases the maximum construction payment to $76,714,144, but no
change is proposed for the maximum construction payment plus interest that would remain at
$93,079,000.
