Prosper Planning & Zoning Commission

Tuesday, May 1, 2007 6:00 p.m.
Commissioners present included: Chairman Mark DeMattia, Jessica Arce, Reno Jones, Ronni Gallup, and
Marcus Ruark.
Staff present included: Hulon Webb, Director of Development Services; Chris Copple, Development and
Parks Planner; and Matthew Denton, Town Secretary.
2. CONSENT AGENDA
a. Consider and act upon minutes from the following Planning & Zoning Commission meetings:
• April 17, 2007 Regular Meeting
b. Consider and act upon a final plat of Legacy Lakes, Phase 1, being 223 single family residential
lots on 114.6t acres located on the south side of Prosper Trail, 800f feet east of Legacy Drive.
The property is zoned Planned Development-23. (D07-15).
C. Consider and act upon a site plan and a final plat & conveyance plat of Prestonwood Baptist
Church — North Campus, Phase 1, being a house of worship on 29.4f acres located on the south
side of Prosper Trail, 1,000 feet east of Dallas Parkway. The property is zoned Planned
Development-33. (1307-14).
Motioned by Gallup, seconded by Ruark to approve the consent agenda. Motion approved 5-0.
REGULAR AGENDA
A public hearing to consider and act upon an amendment to the Zoning Ordinance regarding
the creation of the Downtown Retail District and the amending of the Downtown Residential
District, the Downtown Office District, and the Downtown Commercial District, including, but
not limited to, the permitted uses and development standards. (Z07-8).
Chris Copple, Development and Parks Planner, gave the Commission background information on this item.
Motioned by Ruark, seconded by Arce to open the public hearing. Motion approved 5-0.
Chairman DeMattia opened the public hearing at 6:12 p.m.
There were no comments by the public.
Motioned by Ruark, seconded by Jones to close the public hearing. Motion approved 5-0.

• 4. A public hearing to consider and act upon a request to rezone 32.9t acres from Single Family-
15 (SF-15) to Downtown Commercial (DTC) along McKinley Street; 11.6f acres from Single
Family-15 (SF-15), Office (0), and Downtown Office (DTO) to Downtown Retail (DTR) along
Broadway Street, west of Coleman Street; 2.9t acres from Single Family-15 (SF-15) to
Downtown Office (DTO) west of Coleman Street at Fifth Street; and 9.3f acres from Single
Family-15 (SF-15) to Downtown Office (DTO) east of Coleman Street, along Church Street.
(Z07-9).

Motioned by Ruark, seconded by Jones to close the public hearing. Motion approved 5-0.

5. A public hearing to consider and act upon a request to rezone 40.4f acres located on the south
side of Prosper Trail, 1,500t feet east of Coleman Street to amend Planned Development-30
(Prosper Creek Estates). (Z07-11).
Chris Copple, Development and Parks Planner, gave the Commission background information on this item.
Motioned by Gallup, seconded by Ruark to open the public hearing. Motion approved 5-0.
Chairman DeMattia opened the public hearing at 6:36.
Don Sutton, 701 Sibyl, asked questions regarding the retaining wall bordering his property.
Chris Blair, 841 Sibyl, addressed the commission regarding the proposed retaining wall.
Motioned by Gallup, seconded by Arce to table the item until the May 15, 2007 Planning and Zoning
Commission meeting. Motion approved 5-0.
6. A public hearing to consider and act upon a request to rezone 40.Of acres located 2,500f feet
north of Prosper Trail, on the east side of Dallas Parkway from Single Family-15 (SF-15) to
Commercial Corridor (CC). (Z07-6).

Motioned by Gallup, seconded by Jones to approve item 6. Motion approved 5-0.
7. A public hearing to consider and act upon a request to rezone 226.5f acres on the north side of
Prosper Trail, 1,200 feet east of Dallas Parkway to amend Planned Development-8 (Lakes of
Prosper) to include an additional 39.5t acres. (Z07-5).
Chris Copple, Development and Parks Planner, gave the Commission background information on this item.
Motioned by Jones, seconded by Ruark to open the public hearing. Motion approved 5-0.
Chairman DeMattia opened the public hearing at 7:08 p.m.
Marty Brown, owner representative, answered questions for the Commission.
Motioned by Ruark, seconded by Gallup to close the public hearing. Motion approved 5-0.

8. A public hearing to consider and act upon an amendment to the Zoning Ordinance regarding
Chapter 1, Section 8.4(B) — Changes and Amendments to all Zoning Ordinances and Districts
and Administrative Procedures. (Z07-9).

Motioned by Gallup, seconded by Jones to open the public hearing. Motion approved 5-0.
Chairman DeMattia opened the public hearing at 7:26 p.m.
There were no comments by the public.
Motioned by Arce, seconded by DeMattia to close the public hearing. Motion approved 5-0.
Motioned by Ruark, seconded by DeMattia to deny the amendment to the Zoning Ordinance and recommend
and request a charter amendment to match the wording of the Zoning Ordinance. Motion approved 5-0.
9. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
Ronni Gallup requested an item on a future agenda regarding a liaison with the Town Council and ways to
improve the information flow between the Commission and Council.
