Prosper Planning & Zoning Commission

Tuesday, February 20, 2007 6:00 p.m.
Commissioners present included: Chairman Mark DeMattia, Secretary Ronni Gallup, Jessica Arce, George
Dupont, and Reno Jones. Commissioner Marcus Ruark arrived at 6:28 p.m.
Vice -Chair Troy Brock was not present.
Staff present included: Hulon Webb, Director of Development Services and Chris Copple, Development and
Parks Planner.
2. CONSENT AGENDA
a. Consider and act upon minutes from the following Planning & Zoning Commission meetings:
• February 6, 2007 Regular Meeting
• February 6, 2007 Joint Work Session
Arce requested items 4b and 4c be pulled from the consent agenda.
Motioned by Gallup, seconded by Dupont to approve the balance of the consent agenda.
Motion approved 5-0.
b. Consider and act upon a final plat of Prosper Creek Estates Addition, being 77 single family
residential lots on 39.1f acres located on the south side of Prosper Trail, 1,400f feet east of
Coleman Street. The property is zoned Planned Development-30. (D06-25).
Arce asked staff about the street names proposed on the plat. Staff explained the procedure to name streets.
Motioned by Dupont, seconded by Arce to approve item 4b. Motion approved 5-0.
C. Consider and act upon a preliminary plat of Legacy Lakes, being 496 single family residential
lots on 258.1f acres located on the east side of Legacy Drive, 900t feet north of West First
Street. The property is zoned Planned Development-23. (D06-34).
Arce asked staff if the development would include lakes. The development will include retention ponds.
Motioned by Gallup, seconded by Dupont to approve item 4c. Motion approved 5-0.
REGULAR AGENDA
3. A public hearing to consider and act upon a request to rezone 99.6t acres at the northeast and
southeast corner of Legacy Drive and West First Street from Agricultural (A) to Retail (R)
21.5f acres, and Commercial (C) 78.1t acres. (Z06-22).
Chris Copple, Development and Parks Planner, reviewed the zoning request with the commission.

• Motioned by Dupont, seconded by Gallup to open the public hearing. Motion approved 5-0.
Scott Norris, representing the applicant, spoke in favor of the zoning case and answered questions from the
commission.
Commissioner Ruark arrived at 6:28 p.m.
Phil Darland, representing the Bell property to the east, spoke in favor of the zoning case. Mr. Darland has
concerns about the thoroughfare alignment but was pleased with the alternatives he has discussed with the
applicant.
Motioned by Jones, seconded by DeMattia to close the public hearing. Motion approved 6-0
Motioned by DeMattia, seconded by Dupont to approve the zoning request as submitted.
Motion approved 6-0.
4. A public hearing to consider and act upon an amendment to the Subdivision Ordinance
regarding the procedure for final acceptance. (SA07-1)
Hulon Webb, Director of Development Services, reviewed the proposed amendment to the Subdivision
Ordinance with the commission.
Motioned by Dupont, seconded by Ruark to open the public hearing. Motion approved 6-0.
• There were no comments by the public. Motioned by Dupont, seconded by Gallup to close the public hearing. Motion approved 6- 0
Motioned by Dupont, seconded by Ruark to approve the amendment to the Subdivision Ordinance as
submitted. Motion approved 6-0
5. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
DeMattia asked staff to include the name of the owner and applicant for each case in the future.
6. Adjourn.
Motioned by Ruark, seconded by Dupont to adjourn. Motion approved 6-0.
The meeting was adjourned at 7:06 p.m.
