Prosper Planning & Zoning Commission

Tuesday, February 3, 2009, 6:00 p.m.
Commissioners present included: Vice -Chair George Dupont, Secretary Ronni Gallup, Sam Johnson, Jason
Dixon, and Reno Jones.
Commissioners absent included: Chair Mark DeMattia
(Commissioner DeMattia contacted staff to inform of his absence.)
Staff present included: Mike Land, Town Manager; Hulon Webb, Director of Development Services; Claire
Swann, Town Attorney with Abernathy, Roeder, Boyd, and Joplin, P.C.; Chris Copple, Senior Planner; and
Melanie Videan, Planning Technician.
2. Recitation of the Pledge of Allegiance.

3a. Consider and act upon minutes from the following Planning & Zoning Commission meetings:
• January 6, 2009 Regular Meeting
• January 20, 2009 Regular Meeting
3b. Consider and act upon a final plat of the Lighthouse Church Addition, Block A, Lot 1, on 4.3f
acres, located on the northwest corner of Prosper Trail and Custer Road. The property is
located in the Extra Territorial Jurisdiction (ETJ). (D09-1).
Motioned by Johnson, seconded by Dixon to approve consent agenda subject to staff recommendations.
Motion approved 5-0.
REGULAR AGENDA
4. A public hearing to consider and act upon a request to rezone 9.6f acres, located on the
southwest corner of Dallas Parkway and future Lovers Lane, from Agricultural (A) to
Commercial Corridor (CC). (Z09-1).
Claris Copple (stcrffl: Summarized request to rezone and listed some appropriate uses for the requested
zoning district. Informed Commission notification was given in accordance with state law, and no public
hearing reply forms were received by the Planning Department. Recommended approval.
• Motioned by Dixon, seconded by Jones to open the public hearing. Motion approved 5-0.
Chea-vl Williams (applicant): Expressed appreciation to staff and requested approval from Commission.

• Motioned by Jones, seconded by Dixon to close the public hearing. Motion approved 5-0.
Commissioners Dixon and Dupont: Asked staff questions regarding the Tollway District.
Hidon Webb and Chris Copple (staffl: Answered Commission questions.
Motioned by Johnson, seconded by Gallup to approve item subject to staff recommendations. Motion
approved 5-0.
5. A public hearing to consider and act upon a request for a Specific Use Permit (SUP) for a
Child Day Care Center and/or Private School on 0.6f acre (601 East Seventh Street), located
on the northeast corner of North Street and East Seventh Street. The property is zoned Single
Family-15. (S09-1).
Chris Copple (staff: Gave background information on the subject property and explained the four criteria
for approval. Informed Commission notification was given in accordance with state law, and no public
hearing reply forms were received by the Planning Department. Recommended approval.
Commissioners Dupont, Gallup, Dixon, Jones, and Johnson: Asked staff and the applicant questions
regarding surrounding properties, the history of the subject property, current screening and future screening
possibilities, parking, traffic issues, rooflines, and estimated cost of adhering to the specific use permit
conditions.
Khosrow Sadeghian (propertv owner/applicant): Answered Commission questions, and assured
Commission he would be able to accommodate any additional conditions upon approval.
• Motioned by Johnson, seconded by Dixon to open the public hearing. Motion approved 5-0.
Motioned by Dixon, seconded by Gallup to close the public hearing. Motion approved 5-0.
Commission discussed additional conditions of approval.
Motioned by Dixon, seconded by Jones to approved item subject to staff recommendations, a six foot
irrigated living screen west of the playground equipment, and a maximum height of twenty feet for outside
accessory playground equipment. Motion approved 5-0.
6. A public hearing to consider and act upon an amendment to Chapter 1, Section 7 of the Zoning
Ordinance (Nonconforming Uses and Structures). (Z09-2).
Chris Copple (staffl: Gave Commission history of amendment process and summary of proposed
amendment. Provided examples of nonconforming uses and structures explaining what the proposed
amendment would and would not allow.
Commissioners Johnson and Dixon: Asked questions of staff and Town Attorney regarding loading, off-
street parking, the advantages of the proposed amendment verses the current regulation, and the approval
process switch from the Board of Adjustments to the Planning & Zoning Commission in regards to
additional parking.
Claire Swann (Town Attorney) and Chris Copple (staffl: Answered Commission questions.
• Motioned by Gallup, seconded by Dixon to open the public hearing. Motion approved 5-0.

Corker Underwood (property owner): Noted his questions were answered during staff s presentation.
Is Motioned by Gallup, seconded by Jones to close the public hearing. Motion approved 5-0.
Conunissioners Dupont, Jones, Johnson, Gallup, and Dixon: Voiced opinions on the item.
Motioned by Johnson, seconded by Gallup to approve the item subject to staff recommendations and
additional language included in the amendment to define "canopy" and "awning". Motion approved 5-0.
7. Update from the Town Manager regarding Town Council's vision and goals for 2009 and
discussion by the Planning & Zoning Commission.
Mike Land (Tone Manager): Gave presentation and explanation of Town goals and visions for the 2009
calendar year, discussed the appointment of the Town's new Planning & Zoning Commission Member, and
explained the current contract with the University of North Texas.
Conunissioner Dixon: Asked questions of staff.
Mike Land and Chris Copple (staff: Answered questions.
8. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
