The meeting was called to order at 6:00 p.m.

Prosper Planning & Zoning Commission

Tuesday, November 2, 2010, 6:00 p.m.
Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Herb Trenham,
Christopher Blair, Chris Keith, and Rick Turner.
Staff present included: Chris Copple, Planning & Zoning Manager; and Melanie Videan, Planning
Technician.
2. Recitation of the Pledge of Allegiance.
3. Consider and act upon the appointment of the Planning & Zoning Commission Secretary.
Chris Copple described the responsibilities of the Secretary.
McClung nominated Trenham for Planning & Zoning Secretary. Nomination approved 6-0.
CONSENT AGENDA
DeMattia pulled item 4b per Town staff s request.
Motioned by Blair, seconded by McClung to approve balance of consent agenda. Motion approved 6-0.
4a. Consider and act upon minutes from the following Planning & Zoning Commission meeting:
• October 19, 2010 Regular Meeting
4b. Consider and act upon a final plat of Hunter Gateway Centre, Block A, Lots 1 and 3-6 and a
conveyance plat of Hunter Gateway Centre, Block A, Lot 7, on 17.2f acres, located on the
northeast corner of U.S. 380 and La Cima Boulevard. The property is zoned Planned
Development-2 (PD-2). (D10-0026).
Motioned by Turner, seconded by Trenham to table item 4b until the November 16, 2010 Planning & Zoning
Commission meeting per the applicant's request. Motion approved 6-0.
REGULAR AGENDA
5. A public hearing to consider and act upon a final plat of Chapel Hill, Block B, Lot 5R, being a
replat of Chapel Hill, Block B, Lots 4 and 5, on 0.5t acre, on the west side of Chapel Hill Drive,
at the intersection with Brookside Drive (201 Chapel Hill Drive). The property is zoned
Planned Development-11 (PD-11). (D10-0025).

Summary
Videan: Summarized request to replat the properties, and cited conformance with Planned Development-11
standards. Informed notification was given in accordance with State law, and two reply forms were received
by the Planning Division with one in opposition that later recanted their position. Recommended approval.
Motioned by McClung, seconded by Trenham to open the public hearing. Motion passed 6-0.
Public Hearins Discussion
Calvin Howard (resident): Concerned about the following: 1) possible future use on the currently vacant
lot, 2) if the Covenants, Conditions, and Restrictions (herein called the CC&Rs) could be ignored by the
property owner, 3) lack of notification to the Homeowner's Association (herein called the HOA) by the
Town, and 4) the aesthetic decline of the subdivision.
DeMattia.• Explained the administrative process of replats according to State law, and assured Mr. Howard
any future construction would be subject to the CC&Rs and the development standards set by Town
ordinance(s).
McClung: Explained typical administration of CC&Rs and Homeowner's Associations.
Copple: Explained the Town's policy regarding HOA notification for zoning public hearings.
Motioned by Keith, seconded by Blair to close the public hearing. Motion passed 6-0.
Discussion
DeMattia: Asked staff questions regarding CC&R guidelines set by the Town.
Copple: Informed the Subdivision Ordinance sets certain requirements for HOAs, but does not include a
guideline for CC&Rs.
Motioned by McClung, seconded by Turner to approve item subject to Town staff s recommendations.
Motion approved 6-0
Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
Discussion
McClung.- Asked staff about dates for a joint work session with Town Council.
Copple: Noted the topic was discussed at the October 25, 2010 Council meeting, but a date has not been set
at this time.

Motioned by Trenham, seconded by Turner to adjourn. Motion approved 6-0.
