The meeting was called to order at 6:00 p.m. Roll call taken by Melanie Videan, Planning Technician. MINUTES Regular Meeting of the Prosper Planning & Zoning Commission 108 W. Broadway St., Prosper, Texas Town of Prosper Municipal Chambers Tuesday, July 17, 2012, 6:00 p.m. Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Secretary Chris Keith, Bruce Carlin, and Rick Turner. *Jim Cox and Bill Senkel informed of their absence prior to the meeting. Staff present included: Chris Copple, Planning Director; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. 3. Consider and act upon minutes from the following Planning & Zoning Commission meetings: • July 2, 2012 Regular Meeting Motioned by Carlin, seconded by Keith to approve item 3. Motion approved 5-0 at 6:02 p.m. REGULAR AGENDA The Commission acted on item 5 prior to item 4. 4. A public hearing to consider and act upon a request to rezone 41.3t acres, located on the south side of Frontier Parkway, 2,600f feet west of Custer Road, from Agricultural (A) to Planned Development -Single Family -Estate (PD-SF-E). (Z12-0006). DeMattia excused himself from the meeting during item 4 due to a conflict of interest. Summary Copple: Summarized request to rezone. Briefed on surrounding zoning. From the proposed planned development (herein called the PD), cited the following: 1) development standards that differ from Single Family -Estate, 2) development criteria along major creeks, 3) fencing, 4) drainage, 5) subdivision access, and 6) cul-de-sac length. Noted the request conforms to the Future Land Use Plan. Informed notification was given in accordance with state law, and one public hearing notice reply form was received by the Planning Department, which was not in opposition. Reported the Parks and Recreation Board approved the location of the hike and bike trail along Frontier Parkway and the Town's receiving of fees in lieu of park dedication. Recommended approval. Discussion McClung: Asked questions about the location of the floodway easement and if the subdivision's streets will be the responsibility of the Homeowner's Association (herein called the HOA). Page 1 of 4 Carlin: Asked the following: 1) why another private subdivision is being developed, 2) if the access points to the floodway will be gated, 3) why lot -to -lot drainage is being proposed, 4) why a twenty-five (25) foot rear setback is being proposed on a one acre lot, and 5) questions regarding roadway construction standards. Copple: Answering McClung, informed the requirements of floodway easements are in the Subdivision Ordinance and that its access easement is finalized during the town engineer's review. Confirmed the streets will be maintained by the HOA. Answered Carlin with the following: 1) the request for a private subdivision was made by the applicant, 2) cited the relevant section of the fence ordinance regarding the town engineer's discretion, 3) noted the applicant did meet with the town engineer and can answer questions regarding drainage, 4) informed the requested rear setback complies with the minimum for Single Family -Estate, and 5) street construction is addressed in the PD and will also be required to meet Town standards. Motioned by Keith, seconded by Carlin to open the public hearing. Motion passed 4­0 at 6:15 p.m. Public Hearing Discussion Rex Glendenning (applicant): Offered history of property and plans for its development. Noted discussions with the Amberwood and Gentle Creek HOAs, as well as individual homeowners, all of whom have voiced support. McClung: Asked questions regarding fencing around the subdivision. Rex Glendenning: Answering McClung, preferred to retain the same standards that Amberwood and Gentle Creek practice, noting a desire to restrict use to the creek and keep subdivision residents in their own neighborhoods. Carlin: Concerned with fencing along the floodplain and that the lot lines along Wilson Creek do not extend to the center of the creek. Asked the following: 1) what the depths are for the lots that abut Wilson Creek, 2) for the project engineer to explain the drainage, and 3) if there are sewer lines in the floodplain. Matt Dorsett (representative): Addressing Carlin's concerns, offered a revised Exhibit D, showing lot lines extended to the center of the creek. Noted the flood elevation, from the latest FEMA floodplain map, is derived from topography data. Addressed Carlin's questions with the following: 1) lots along Wilson Creek are 150 feet deep, 2) swales are on lot lines, as it is not feasible to elevate the lots to drain into the street. Noted discussions with the town engineer regarding drainage solutions. George Dupont (Amberwood HOA president): Asked about drainage easement. Concerned about the following: 1) homeowners who have access to Wilson Creek and the drainage easement will be able to walk from one subdivision to the next, and 2) tree mitigation and landscaping along Frontier Parkway. Explained the history of the maintenance responsibilities for Wilson Creek. Voiced support, conditional upon drainage approval by the town engineer. Aaron Reed (Gentle Creek resident): Concerned about the following: 1) Common areas (requested elimination of such areas along Wilson Creek), 2) traffic onto private property in neighboring subdivisions, 3) twenty to thirty (20-30) foot drop from property down to floodway easement, 4) possibility of road cut down into the creek (requested a means to access floodway without constructing a roadway), 5) building height (requested height limitation of two stories and thirty-five [35] feet), and 6) tree preservation (requested a revision to PD that trees will not be removed). Voiced support for the request to rezone contingent upon his cited concerns. Turner: Explained that both sides of the creek are at the same elevation; therefore, altering home height won't benefit Gentle Creek residents. Page 2 of 4 McClung: Asked that if the PD were revised to extend lot lines to the center of the creek, would doing so eliminate the need for access roads into the common area? Wendy Smith (Gentle Creek resident): Asked about the drainage of lots along Wilson Creek. Concerned about the open access into neighboring properties as subdivision is being developed. Preferred for the berm and gate along Frontier Parkway be constructed in a timely manner to protect the property and neighboring properties from recreational use by non -subdivision recreational ists. Rex Glendenning: Addressing Mr. Reed's concerns, assured that vegetation will remain in the floodplain due to the cost of removing them and then having to replace them. Answering Ms. Smith, assured there will be mitigation to protect private property and offered to erect a gate sooner if the need exists. Copple: Answering McClung, preferred to consult with the town engineer regarding extension of lot lines to the center of the creek. Cited items in the Tree Preservation Ordinance, noting its regulations. Assured Commission that many items are best tended to during the final platting process, rather than with the zoning process. Addressing Ms. Smith's concerns, noted the gate, screening wall, and landscaping is part of the final acceptance process and installation of such is required prior to the construction of homes. Dupont: Informed of discussions with Police Chief McFarlin regarding individual fencing along property lines that abut Wilson Creek and that due to floodplain laws, Chief McFarlin is looking into the matter. Motion by Turner, seconded by Keith to close the public hearing. Motion passed 4-0 at 7:05 p.m. Turner: Agreed with extending the lot lines of properties abutting Wilson Creek to the center of the creek. Preferred to remove the requirement for ornamental fencing on those properties along Wilson Creek, allowing the homeowner to make the decision as to whether or not to have ornamental metal fencing. Did not agree with restricting the height of homes to thirty-five (35) feet. Keith: Agreed with Turner regarding building height and extension of lot lines to the creek's center. Voiced that drainage issues need tending to and that tree mitigation can be implemented. Carlin: Preferred a revision to the twenty-five (25) foot rear setback. McClung: Agreed with the flexibility to change lot depth and with providing an option for fencing. Noted the request is consistent with the Comprehensive Plan. Preferred to not request a revision to building size or lot setback. Motioned by Turner, seconded by Carlin to approve the request to rezone 41.3± acres, located on the south side of Frontier Parkway, 2,600f feet west of Custer Road, from Agricultural (A) to Planned Development -Single Family -Estate (PD-SF-E) subject to: 1) the lots adjacent to Wilson Creek be platted to the centerline of the creek, which allows the HOA owned and maintained open space lot containing Wilson Creek to be removed as required by Section 14.2 of the Subdivision Ordinance; and 2) removing the ornamental metal fence along the rear of the residential lots adjacent to Wilson Creek as required by Section 14.3.6 of the Subdivision Ordinance, which allows each single family lot owner to construct an ornamental fence adjacent to the creek's floodway easement if they so choose. Motion approved 4-0 at 7:13 p.m. 5. A public hearing to consider and act upon a request to rezone 10.6f acres, located on the northwest corner of Custer Road and Prosper Trail, from Agricultural (A) to Planned Development -Office (PD-O). (Z12-0007). Page 3 of 4 Summary Copple: Informed of applicant's request to table the item until the August 7, 2012 Planning & Zoning Commission meeting. Reported the Planning Division will re -notify the public hearing for August 7, 2012. Recommended tabling item. Motioned by McClung, seconded by Turner to table the request to rezone 10.6f acres, located on the northwest corner of Custer Road and Prosper Trail, from Agricultural (A) to Planned Development -Office (PD-O) to the August 7, 2012 Planning & Zoning Commission meeting. Motion approved 5-0 at 6:04 p.m. 6. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. Discussion on Comoreliensive Plan Update Turner: Inquired about Council's direction to staff at their July 10, 2012 meeting regarding Coit Road and Frontier Parkway. Keith: Inquired about Council's direction to staff at their July 10, 2012 meeting regarding a building height of twelve (12) stories along the Dallas North Tollway corridor and what the previous height recommendation had been. Copple: Clarified Council's direction to staff. Discussion on Develooment Turner: Questioned the fagade of the 7-Eleven building on La Cima Boulevard and U.S. 380. Carlin: Asked staff if the Town can rezone property. Copple: Informed of the PD-2 standards, which were approved in 2000. Confirmed the Town may initiate the rezoning of a property per the Zoning Ordinance. 7. Adjourn Motioned by Turner, seconded by Keith to adjourn. Motion approved 5-0.
